While an advisory committee has largely focused on finding state hospital beds for that group, our team took a closer look at the backgrounds of individuals on the waitlist to determine trends experts say could help drive down numbers. Our research found data on this topic is often hidden or unreliable \u2013 a discovery sparking promise for change from state leaders. The resulting <a target=\"_blank\" href=\"https:\/\/media.psg.nexstardigital.net\/kxan\/story\/mental_competency_consequences\/index.html\" rel=\"noopener\">\u201cMental Competency Consequences\u201d <\/a>project is supported by the USC Annenberg Center for Health Journalism.<\/p>\n<\/div>\n<\/div>\n<p>AUSTIN (KXAN) \u2014 In Texas, people charged with crimes and found mentally incompetent to stand trial <a target=\"_blank\" rel=\"noreferrer noopener\" href=\"https:\/\/media.psg.nexstardigital.net\/kxan\/catalyst\/locked-in-limbo\/index.html\">most often obtain restoration treatment at a state hospital before<\/a> returning to jail and being able to actively participate in their defense. In recent years, there have been efforts to increase other competency restoration alternatives \u2013 like <a target=\"_blank\" rel=\"noreferrer noopener\" href=\"https:\/\/www.kxan.com\/locked-in-limbo-stories\/explore-solutions-alternatives-for-texas-inmates-competency-restoration\/\">jail-based or outp<\/a>atient methods \u2013 but for some people, those options are not always available.<\/p>\n<p>\u201cA long waiting list is not a good thing,\u201d Joint Committee on Access and Forensic Services Chair Stephen Glazier told KXAN in October when the state\u2019s mental competency waitlist hit a new record, soaring beyond 1,830 people. \u201cThere are all kinds of negative consequences that come from that. It\u2019s important, I think, to reinforce everybody\u2019s motivation to work as hard as we can to fix this problem.\u201d<\/p>\n<p>Working to identify trends on the waitlist, <a target=\"_blank\" rel=\"noreferrer noopener\" href=\"https:\/\/media.psg.nexstardigital.net\/kxan\/story\/mental_competency_consequences\/index.html\">KXAN investigators discovered deaths are just one of several crucial data points going untracked<\/a> by the JCAFS, an advisory panel that makes recommendations to <a target=\"_blank\" rel=\"noreferrer noopener\" href=\"https:\/\/www.hhs.texas.gov\/\">Texas Health and Human Services Commission<\/a> and state lawmakers, in part, to help drive down the waitlist numbers.<\/p>\n<p>During his conversation with KXAN, Glazier said he would make it a priority for the committee to address how it could track the housing status of people on the waitlist and other details related to homelessness. HHSC later told KXAN it had recently started collecting data on those individuals\u2019 race and ethnicity and would be providing those details to the committee by January 2022.<\/p>\n<div class=\"nlp-ignore-block article-content rich-text\">\n<aside class=\"promo-link\"><a target=\"_blank\" href=\"https:\/\/www.kxan.com\/investigations\/wrong-races-hidden-names-among-data-challenges-our-team-faced-with-jail-mental-health-project\/?ipid=mcc_promo_state_of_texas_26_december\" class=\"promo-link__link\" rel=\"noopener\"><br \/>\n\t\t<strong>Wrong races, hidden names among data challenges our team faced with jail mental health project<\/strong>\t<\/a><br \/>\n<\/aside>\n<\/div>\n<p>Mental health advocates like <a target=\"_blank\" href=\"https:\/\/www.lynfro.com\/\" rel=\"noreferrer noopener\">Lynda Frost<\/a>, formerly of the <a target=\"_blank\" href=\"https:\/\/hogg.utexas.edu\/\" rel=\"noreferrer noopener\">Hogg Foundation for Mental Health<\/a>, acknowledge the committee, established in 2015, has improved its data initiatives in recent years. That work has largely focused on statewide aggregate overviews with a recently formed data analysis subcommittee and updates from the state\u2019s forensic director. But Frost agrees more information could help the state better deliver services to individuals on the waitlist and possibly reduce their wait times.<\/p>\n<p>\u201cWe know that people are not treated equally across our criminal justice system,\u201d she said. \u201cWe want to know how that plays out. And, if we don\u2019t have that data, it\u2019s harder to figure out what we can do to ensure that our justice systems are truly just.\u201d<\/p>\n<p>Until the committee begins tracking those additional details statewide, it is only possible to understand the scope of such problems through data analysis by county. Because the identities on the state\u2019s waitlist are hidden for privacy reasons, <a target=\"_blank\" href=\"https:\/\/www.kxan.com\/investigations\/wrong-races-hidden-names-among-data-challenges-our-team-faced-with-jail-mental-health-project\" rel=\"noreferrer noopener\">KXAN took a backdoor approach, obtaining district clerks\u2019 lists of felony defendants found incompetent to stand trial,<\/a> then examining specific cases to learn more about their backgrounds. But county jails and courts in Texas do not have a uniform data collection system, and we discovered some of what they do collect is likely inaccurate and not always required to be passed along to HHSC.<\/p>\n<h3><strong>\u2018Fundamental obligation\u2019<\/strong><\/h3>\n<p>Names like Naquan Carter and Fernando Macias were two of at least 12 mentally incompetent, incarcerated individuals KXAN discovered died in Texas\u2019 most populated counties since early 2015. Because the state does not track that number, we had to cross-reference custodial deaths \u2013 which sheriffs\u2019 offices are required to submit to the attorney general\u2019s office \u2013 with district clerks\u2019 lists of people found mentally incompetent to stand trial \u2013 county by county. The total we compiled, so far, is just from Travis, Harris, Bexar, Dallas and Tarrant Counties. (KXAN Photo\/David Barer)<\/figcaption><\/figure>\n<\/div>\n<p>KXAN shared its tally with the JCAFS chair, who stopped short of saying the committee would begin tracking deaths. Yet Glazier called what we uncovered one of the \u201cconsequences of the waitlist\u201d that could \u201ccreate some momentum to get public policy change.\u201d When later pressed on whether it would begin tracking deaths, HHSC\u2019s spokesperson said it is still not part of agency plans.<\/p>\n<p>\u201cThere\u2019s no more fundamental obligation that jails have than to keep the people inside them safe and alive,\u201d said <a target=\"_blank\" href=\"https:\/\/lbj.utexas.edu\/deitch-michele\" rel=\"noreferrer noopener\">Michele Deitch<\/a>, a distinguished senior lecturer who focuses on criminal justice policy issues and deaths in custody at the <a target=\"_blank\" href=\"https:\/\/lbj.utexas.edu\/\" rel=\"noreferrer noopener\">University of Texas LBJ School of Public Affairs<\/a>. \u201cAnd, if we\u2019re not tracking what\u2019s happening to the people in there, we don\u2019t know what\u2019s going on inside those jails.\u201d<\/p>\n<h3><strong>\u2018Downward economic spiral\u2019<\/strong><\/h3>\n<p>Learning HHSC does not track deaths led KXAN to dig deeper into other data mental health advocates say could help spark change \u2013 if leaders had an evidence-based grasp of the problems facing people on the waitlist. Along with race and ethnicity, <a target=\"_blank\" href=\"https:\/\/www.kxan.com\/investigations\/how-austin-low-level-crime-court-helps-frequent-utilizers-experiencing-homelessness\" rel=\"noreferrer noopener\">poverty and indigency challenges were most frequently mentioned <\/a>when it came to the intersection of mental health and the criminal justice system.<\/p>\n<p>\u201cIf I\u2019m not independently wealthy, I may have trouble keeping a job and may have trouble making my rent,\u201d Frost explained. \u201cSerious unaddressed mental health challenges can lead someone in a downward economic spiral\u2026 that certainly could be a trigger to make it worse.\u201d<\/p>\n<div class=\"nlp-ignore-block article-content rich-text\">\n<aside class=\"promo-link\"><a target=\"_blank\" href=\"https:\/\/www.kxan.com\/investigations\/how-austin-low-level-crime-court-helps-frequent-utilizers-experiencing-homelessness\/?ipid=mcc_promo_state_of_texas_26_december\" class=\"promo-link__link\" rel=\"noopener\"><br \/>\n\t\t<strong>How Austin low-level crime court helps \u2018frequent utilizers\u2019 experiencing homelessness<\/strong>\t<\/a><br \/>\n<\/aside>\n<\/div>\n<p>KXAN wanted to know how those aspects factored into the mental competency backlog. But, because the state keeps identities on its waitlist secret and does not track socioeconomic backgrounds, we had to analyze district clerk data in specific counties to better understand financial challenges \u2013 specifically people who were incompetent to stand trial and could not afford to hire a lawyer. Almost every case, including Macias\u2019 and Carter\u2019s, met that criteria.<\/p>\n<p>Determining whether people had experienced homelessness is more difficult. HHSC admits \u2013 since those on the waitlist are not in the agency\u2019s care yet \u2013 it receives \u201climited information on them.\u201d Court documents are sent to the state hospital once restoration services are available, but they \u201cdo not necessarily include details on various socioeconomic factors, such as homelessness or indigence.\u201d People finally admitted to state hospitals do receive \u201ccomplete and accurate\u201d assessments of their demographic profiles \u2013 but hundreds of others still waiting in jail do not.<\/p>\n<p>\u201cWe\u2019ve seen how the waitlist can explode very quickly,\u201d Glazier said. \u201cWhere did all these new people come from? I think the committee would really like to\u2026 see if we can get some hard numbers to track. Where are we having the biggest problems? How highly correlated is homelessness to some of the outcomes that we\u2019re trying to avoid?\u201d<\/p>\n<div class=\"nlp-ignore-block article-content rich-text\">\n<aside class=\"promo-link\"><a target=\"_blank\" href=\"https:\/\/www.kxan.com\/investigations\/jail-waitlist-for-mental-health-help-hits-new-record-this-plan-proposes-a-statewide-fix\/?ipid=mcc_promo_state_of_texas_26_december\" class=\"promo-link__link\" rel=\"noopener\"><br \/>\n\t\t<strong>Jail waitlist for mental health help hits new record. This plan proposes a statewide fix.<\/strong>\t<\/a><br \/>\n<\/aside>\n<\/div>\n<p>In January 2020, an estimated\u00a0<strong>27,229<\/strong>\u00a0Texans experienced homelessness on any given day, according to the U.S. Department of Housing and Urban Developments\u2019 <a target=\"_blank\" href=\"https:\/\/www.huduser.gov\/portal\/sites\/default\/files\/pdf\/2020-AHAR-Part-1.pdf\" rel=\"noreferrer noopener\">Annual Homeless Assessment Report to Congress<\/a>.\u00a0That number was the fourth largest in the nation at the time. And, the <a target=\"_blank\" href=\"https:\/\/texascje.org\/system\/files?file=publications\/Return%20to%20Nowhere%20The%20Revolving%20Door%20Between%20Incarceration%20and%20Homelessness.pdf\" rel=\"noreferrer noopener\">Texas Criminal Justice Coalition cites a national study<\/a> finding, prior to incarceration, around 40% of people who experienced homelessness reported using mental health services or medications for a mental illness \u2013 a statistic twice that of non-homeless incarcerated individuals.<\/p>\n<p>Some mental health advocates predicted those numbers could go up, as Texas continues to criminalize certain aspects of homelessness. In September, <a target=\"_blank\" href=\"https:\/\/www.kxan.com\/news\/local\/austin\/statewide-homeless-camping-ban-begins-wednesday-in-texas-how-will-it-affect-austin\/\" rel=\"noreferrer noopener\">a new law went into effect banning homeless encampments in unapproved areas statewide<\/a>, punishable by a fine of up to $500. And several municipalities across the state already outlawed panhandling. While these charges might not directly land someone in jail, an incident could result in additional charges or it might send people into that \u201cdownward spiral\u201d Frost mentioned.<\/p>\n<p>\u201cSometimes people are arrested to get them off the street, because they\u2019re a nuisance to somebody who is more powerful,\u201d she said. \u201cSo, if somebody doesn\u2019t need to be in the criminal justice system, where can you divert somebody to something else that will address the needs they are manifesting?\u201d<\/p>\n<h3><strong>\u2018Significantly better outcomes\u2019<\/strong><\/h3>\n<p>At the most recent JCAFS meeting in October, members got an overview on this topic from HHSC\u2019s <a target=\"_blank\" href=\"https:\/\/www.hhs.texas.gov\/about-hhs\/process-improvement\/improving-services-texans\/behavioral-health-services\/office-mental-health-coordination\" rel=\"noreferrer noopener\">Office of Mental Health Coordination<\/a> \u2013 specifically, options for treatment diversion, step-down or small group homes, rapid re-housing and permanent supportive housing for people with severe mental illness who have also come into contact with the justice system. The discussion focused on state funding, staffing issues, regulations and licensing.<\/p>\n<p>While previous meetings largely focused on expanding state hospital services and the number of treatment beds available for people on the waitlist, the committee and presenters indicated the growing need to take a closer look at next steps, including more data sharing and future housing recommendations \u2013 even after mental competency treatment is complete and people leave jail.<\/p>\n<p>\u201cI think we need to start with getting an idea of what\u2019s available and what\u2019s the scope of the problem,\u201d Glazier said in the committee meeting. \u201cWe\u2019ll start exploring to see if it\u2019s possible to get some data on this\u2026 With stable housing, you can get significantly better outcomes.\u201d<em\/><\/p>\n<p>Glazier and the committee point to the COVID-19 pandemic as one of the main factors for Texas\u2019 waitlist experiencing greater delays in recent years. For 2021, the average wait time for a non-maximum security state hospital bed peaked at 204 days in April. For a maximum-security bed, the highest average wait was 510 days in May. But some people wait even longer.<\/p>\n<p>\u201cIn February of 2020, before COVID hit, we were down to 900 (people) on the waitlist, and then\u2026 we just went the wrong direction,\u201d he said. \u201cCOVID has caused a lot of things like beds to go offline, courts to slow down. It\u2019s caused a lot of problems, but I\u2019m hoping we\u2019re getting past that.\u201d<\/p>\n<h3><strong>\u2018We can make a difference\u2019<\/strong><\/h3>\n<p>In October, following almost two years of KXAN investigating this topic, a statewide plan to \u201c<a target=\"_blank\" href=\"https:\/\/www.texaspolicechiefs.org\/plugins\/show_image.php?id=2749\" rel=\"noopener\">Elim<\/a><a target=\"_blank\" href=\"https:\/\/www.texaspolicechiefs.org\/plugins\/show_image.php?id=2749\" rel=\"noreferrer noopener\">i<\/a><a target=\"_blank\" href=\"https:\/\/www.texaspolicechiefs.org\/plugins\/show_image.php?id=2749\" rel=\"noopener\">nate the Wait<\/a>\u201d surfaced at the <a target=\"_blank\" href=\"http:\/\/texasjcmh.gov\/\" rel=\"noreferrer noopener\">Texas Judicial Commission on Mental Health<\/a>\u2019s annual conference. <a target=\"_blank\" href=\"https:\/\/www.kxan.com\/investigations\/jail-waitlist-for-mental-health-help-hits-new-record-this-plan-proposes-a-statewide-fix\/\" rel=\"noreferrer noopener\">The commission rolled out a partnership with HHSC to \u201crightsize competency restoration services\u201d<\/a> across Texas.<\/p>\n<div class=\"nlp-ignore-block article-content rich-text\">\n<aside class=\"promo-link\"><a target=\"_blank\" href=\"https:\/\/media.psg.nexstardigital.net\/kxan\/story\/mental_competency_consequences\/index.html?ipid=mcc_promo_state_of_texas_26_december\" class=\"promo-link__link\" rel=\"noopener\"><br \/>\n\t\t<strong>Mental competency consequences: the hidden, unreliable data Texas tracks\u2026 or doesn\u2019t<\/strong>\t<\/a><br \/>\n<\/aside>\n<\/div>\n<p>Citing a \u201c38 percent increase in people who are found incompetent to stand trial\u201d over the past 20 years, the \u201cstate roadmap\u201d includes a toolkit shared \u201cwith judges, prosecutors, defense attorneys, sheriffs and jail staff, police, and behavioral health providers to join their collaborative effort to change how Texas serves people at the intersection of mental health and criminal justice.\u201d<\/p>\n<p>The effort is primarily aimed at developing new trainings and educational materials \u201cfocused on opportunities for diversion to treatment at all points in the criminal justice system\u201d instead of relying so heavily on state hospital expansions and the addition of more beds in those facilities.
