{"id":27744,"date":"2022-01-14T17:35:46","date_gmt":"2022-01-14T17:35:46","guid":{"rendered":"https:\/\/cjstudents.com\/?p=27744"},"modified":"2022-01-14T17:35:46","modified_gmt":"2022-01-14T17:35:46","slug":"nearly-every-state-uses-speeding-ticket-fines-and-fees-to-fund-its-justice-system","status":"publish","type":"post","link":"https:\/\/cjstudents.com\/index.php\/2022\/01\/14\/nearly-every-state-uses-speeding-ticket-fines-and-fees-to-fund-its-justice-system\/","title":{"rendered":"Nearly every state uses speeding-ticket fines and fees to fund its justice system"},"content":{"rendered":"<p> [ad_1]<\/p>\n<div id=\"js-article__body\" itemprop=\"articleBody\" data-sbid=\"WP-MKTW-0000554049\" role=\"document\">\n<p>In 2015, the Department of Justice released <a target=\"_blank\" href=\"https:\/\/www.justice.gov\/opa\/speech\/attorney-general-holder-delivers-update-investigations-ferguson-missouri\" class=\"icon none\" rel=\"nofollow noopener\">a report<\/a> on the causes of the shooting death, a year earlier, of 18-year-old Michael Brown in Ferguson, Missouri.<\/p>\n<p>Ferguson was \u201ca community where local authorities consistently approached law enforcement not as a means for protecting public safety, but as a way to generate revenue,\u201d then-attorney general Eric Holder wrote. <\/p>\n<div class=\"paywall\">\n<p>The report also found that revenue raising was racially biased and had \u201cnot only severely undermined the public trust, eroded police legitimacy, and made local residents less safe \u2014 but created an intensely charged atmosphere where people feel under assault and under siege\u00a0by those charged to serve and protect them.\u201d<\/p>\n<p>But years later, the practice remains widespread \u2014 so much so that in at least 43 states, some portion of speeding ticket revenue goes to a court or law enforcement fund, suggesting the potential for conflicts of interest like in Ferguson, according to a new paper.<\/p>\n<p>The Washington-based Tax Policy Center\u2019s new paper, <a target=\"_blank\" href=\"https:\/\/www.taxpolicycenter.org\/publications\/following-money-fines-and-fees\/full\" class=\"icon none\" rel=\"nofollow noopener\">Following the Money on Fines and Fees<\/a>, looks at what the authors call \u201cthe misaligned fiscal incentives in speeding tickets.\u201d The paper\u2019s contribution to the issue, according to co-author Arvind Boddupalli, is novel in that it matches revenues from fine and fees to how they are allocated, thereby drawing a money trail of potential conflicts of interest.<\/p>\n<div data-layout=\"inline&#10;                \" data-layout-mobile=\"\" class=\"&#10;          media-object&#10;          type-InsetMediaIllustration&#10;            inline&#10;  article__inset&#10;          article__inset--type-InsetMediaIllustration&#10;            article__inset--inline&#10;  \">\n<figure class=\"&#10;        media-object-image&#10;        enlarge-image&#10;        img-inline&#10;        article__inset__image&#10;      \" itemscope=\"\" itemtype=\"http:\/\/schema.org\/ImageObject\">\n<div style=\"padding-bottom:86.57142857142858%;\" data-subtype=\"photo\" class=\"image-container  responsive-media article__inset__image__image\">\n        <img decoding=\"async\" srcset=\"https:\/\/images.mktw.net\/im-468208?width=540&amp;size=1.1541929666366095 540w, https:\/\/images.mktw.net\/im-468208?width=620&amp;size=1.1541929666366095 620w, https:\/\/images.mktw.net\/im-468208?width=639&amp;size=1.1541929666366095 639w, https:\/\/images.mktw.net\/im-468208?width=700&amp;size=1.1541929666366095 700w, https:\/\/images.mktw.net\/im-468208?width=700&amp;size=1.1541929666366095&amp;pixel_ratio=1.5 1050w, https:\/\/images.mktw.net\/im-468208?width=700&amp;size=1.1541929666366095&amp;pixel_ratio=2 1400w, https:\/\/images.mktw.net\/im-468208?width=700&amp;size=1.1541929666366095&amp;pixel_ratio=3 2100w\" sizes=\"(max-width: 639px) 100vw, (max-width: 979px) 620px, (max-width: 1299px) 540px, 700px\" src=\"https:\/\/images.mktw.net\/im-468208?width=700&amp;height=606\" alt=\"\" title=\"\"\/><\/div><figcaption class=\"wsj-article-caption article__inset__image__caption\" itemprop=\"caption\"><span class=\"wsj-article-credit article__inset__image__caption__credit\" itemprop=\"creator\"><br \/>\n            Source: Tax Policy Center analysis of Census Bureau data<br \/>\n          <\/span><br \/>\n  <\/figcaption><\/figure>\n<\/div>\n<p>The paper also finds that many states use speeding ticket revenue to fund general government services unrelated to the justice system. That\u2019s a gray area, Boddupalli told MarketWatch.<\/p>\n<p>\u201cIt\u2019s not conclusively better to send the money to a general fund,\u201d Boddupalli said. \u201cRevenue-motivated policing and sentencing, in and of itself, can be pretty problematic and especially inequitable. The practice disproportionately targets Black Americans, <a target=\"_blank\" href=\"https:\/\/nyuscholars.nyu.edu\/en\/publications\/who-pays-for-government-descriptive-representationb-and-exploitat\" class=\"icon none\" rel=\"nofollow noopener\">a raft of earlier research has shown<\/a>, and it can trap people in cycles of debt, bankruptcy, and a history with the justice system, which can make getting a job or a fresh start much harder.<\/p>\n<p>What\u2019s more, by creating such incentives for law enforcement, it can set up a situation where the financial health of a community is better if people are fined more for breaking the law.
