{"id":28221,"date":"2022-01-29T02:45:58","date_gmt":"2022-01-29T02:45:58","guid":{"rendered":"https:\/\/cjstudents.com\/?p=28221"},"modified":"2022-01-29T02:45:58","modified_gmt":"2022-01-29T02:45:58","slug":"state-leaders-resisting-mayor-adams-on-bail-reform-dont-have-a-leg-to-stand-on","status":"publish","type":"post","link":"https:\/\/cjstudents.com\/index.php\/2022\/01\/29\/state-leaders-resisting-mayor-adams-on-bail-reform-dont-have-a-leg-to-stand-on\/","title":{"rendered":"State leaders resisting Mayor Adams on bail reform don&#8217;t have a leg to stand on"},"content":{"rendered":"<p> [ad_1]<\/p>\n<div>\n<aside class=\"single__inline-module alignleft\">\n\t\t<\/aside>\n<p>The state Legislature\u2019s leaders instantly <a target=\"_blank\" href=\"https:\/\/nypost.com\/2022\/01\/25\/leading-lawmakers-reject-eric-adams-legislative-proposals-to-stem-shootings-in-nyc\/\" rel=\"noopener\">poured cold water<\/a> on Mayor Eric Adams\u2019 request for tweaks to disastrous criminal-justice reforms imposed in recent years, and Gov. Kathy Hochul basically says she won\u2019t fight the issue. Yet their objections are <em>ridiculous<\/em>.<\/p>\n<p>Assembly Speaker Carl Heastie (D-Bronx) complains about \u201cmisinformation\u201d and told Adams to \u201creview and improve pretrial services in the probation department which he oversees\u201d as if that\u2019s the problem. (Not that Heastie has committed to adequate state funding for those state-mandated services, two years after the fact.)<\/p>\n<p>Senate Majority Leader Andrea Stewart-Cousins (D-Yonkers) says that letting judges order jail for suspects they deem clearly dangerous would disproportionately affect \u201cblack and brown and poor defendants.\u201d Does she really believe that New York judges are a bunch of racists? And: Crime <em>victims<\/em> in this state are also disproportionately \u201c\u201cblack and brown and poor\u201d \u2014 why do legislators never worry about <em>them?<\/em><\/p>\n<p>On Adams\u2019 other request, to allow gun cases involving uncooperative minors to go to criminal court, Stewart-Cousins insists that \u201cdata\u201d and \u201cscience\u201d support sending young teens to family court instead. How about the data on the rising number of shootings involving teens? <\/p>\n<p>Hochul similarly pleads that she needs to look at the data before deciding anything. Well, here\u2019s some data: the stats involving defendants arrested for felonies in the first two months under their \u201cfixed\u201d no-bail law (July 1, 2020, to Aug. 30, 2020), as <a target=\"_blank\" href=\"https:\/\/nypost.com\/2022\/01\/21\/heres-the-real-cost-of-nys-disastrous-bail-reform-laws\/\" rel=\"noopener\">ex-Queens prosecutor Jim Quinn did for The Post<\/a>.<\/p>\n<p>In those two months, New York City saw 3,680 defendants arraigned for felonies, two-thirds of whom (2,564) had a prior or pending case at time of arrest. And court data show that 31% of\u00a0the 2,564 were re-arrested before their case was disposed, and many more were arrested while awaiting sentencing or after sentencing.<\/p>\n<p>Under the <em>pre-reform <\/em>law, bail was rarely set for first-time nonviolent felony offenders or those charged with a range of misdemeanor crimes. Yet status-quo defenders pretend that giving judges discretion will somehow wind up endangering such people. <\/p>\n<p>Again: The overwhelming majority of crime victims happen to be other people of color. They and their neighbors deserve the peace of mind knowing that the local menaces will be off the street pending trial.<\/p>\n<p>President Joe Biden called Adams on Monday night to offer his \u201cfirm support.\u201d In response, Adams <a target=\"_blank\" href=\"https:\/\/twitter.com\/NYCMayor\/status\/1486045114384502786\" rel=\"noopener\">tweeted<\/a>: \u201c[Biden\u2019s] support will be invaluable in getting the job done.\u201d<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"\/>\n<p>Now the prez will <a target=\"_blank\" href=\"https:\/\/nypost.com\/2022\/01\/26\/joe-biden-will-visit-nyc-to-talk-gun-violence-with-eric-adams-in-wake-of-cop-killings\/\" rel=\"noopener\">visit the city next week<\/a> to discuss combatting gun violence. We hope it\u2019s more than an \u201cillegal gun imports\u201d dog-and-pony show.
