She remembered locking eyes with a gunman and diving behind the bed <\/span><span data-contrast=\"auto\">as a bullet hit the wall. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Nearly a decade later, she was coming back from <\/span><span data-contrast=\"auto\">Cuyamaca College<\/span><span data-contrast=\"auto\"> when she got a phone call. <\/span><span data-contrast=\"auto\">Johnnie Ray<\/span><span data-contrast=\"auto\">, her twin brother, who\u2019d long been a source of support, was killed in a drive-by while visiting a friend.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Andre\u2019s killer was <\/span><a target=\"_blank\" href=\"https:\/\/www.sandiego.gov\/sites\/default\/files\/09-28-16unsolvedmurderandremahan.pdf\" rel=\"noopener\"><span data-contrast=\"none\">never caught<\/span><\/a><span data-contrast=\"auto\"> and, without anywhere else to turn, she wondered how she might take matters into her own hands.<\/span><span data-contrast=\"auto\"> Instead, she went to Denny\u2019s and started journaling. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Today, Essie seeks closure and accountability, on the one hand, while <\/span><a target=\"_blank\" href=\"https:\/\/www.pavinggreatfutures.org\/essie\/\" rel=\"noopener\"><span data-contrast=\"none\">preaching compassion<\/span><\/a><span data-contrast=\"auto\"> even for the people who robbed her, arguing that there\u2019s trauma on both sides. \u201cHurt people hurt people\u201d is how Essie summarized her thinking. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Four were arrested for Johnnie Ray\u2019s death. Two were sentenced to more than 200 years behind bars for their role in a series of violent crimes. An accomplice got 15 years. The driver, who was a juvenile at the time of the murder, took a plea deal in adult court and got eight years.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Essie was satisfied with the outcome.<\/span><span data-contrast=\"auto\"> What her brother\u2019s killers did was obviously wrong, but she doesn\u2019t thirst for blood. She forgave everyone involved and hopes they get the help they need. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">\u201cThese kids were old enough to be my kids,\u201d she said. \u201cIf mine did something like that, I would hope others had empathy.\u201d\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Crime rates in San Diego are <\/span><a target=\"_blank\" href=\"https:\/\/www.voiceofsandiego.org\/topics\/public-safety\/despite-the-recent-increase-crime-in-san-diego-is-still-well-below-its-1990s-peak\/\" rel=\"noopener\"><span data-contrast=\"none\">relatively low these days<\/span><\/a><span data-contrast=\"auto\"> when compared to past decades and even with an uptick of gun-related assaults. Still, anxieties over crime are mounting and feeding into the upcoming election. Some of the same politicians who expressed support for law-enforcement reform are now <\/span><a target=\"_blank\" href=\"https:\/\/calmatters.org\/commentary\/2022\/01\/california-politicos-now-talking-tough-on-crime\/\" rel=\"noopener\"><span data-contrast=\"none\">demanding crackdowns<\/span><\/a><span data-contrast=\"auto\"> in what sounds like a redux of the reactionary rhetoric of the \u201880s and \u201890s. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Stripped of its material and social context, the management of crime has fallen on police and prisons for decades. The United States <\/span><a target=\"_blank\" href=\"https:\/\/www.pewresearch.org\/fact-tank\/2021\/08\/16\/americas-incarceration-rate-lowest-since-1995\/\" rel=\"noopener\"><span data-contrast=\"none\">incarcerates a greater proportion of its population<\/span><\/a><span data-contrast=\"auto\"> than any other country.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Once again, the public discourse is shifting to more tough-on-crime policies, and we shouldn\u2019t be surprised if the result is more trauma, more violence, more fear. But this moment also presents an opportunity to look at the lessons of the past and consider what one group in particular, victims, has to offer.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Essie\u2019s view \u2014 that crime cannot be ignored and also cannot be condensed into a simple good versus evil binary \u2014 runs counter to the one we\u2019re accustomed to hearing in media and political campaigns. They support replacing lengthy mandatory sentences with more judicial discretion and reducing prison terms for those deemed low risk by 20 percent. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Most want people suffering from mental illness to have alternatives to traditional courts and jails, and support using an additional 10 percent of the state\u2019s prison budget on treatment and trauma-recovery services. That budget was approximately <\/span><a target=\"_blank\" href=\"https:\/\/calbudgetcenter.org\/resources\/examining-californias-spending-on-corrections\/\" rel=\"noopener\"><span data-contrast=\"none\">$12 billion<\/span><\/a><span data-contrast=\"auto\"> when the survey was taken in 2019. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Violence tends to afflict <\/span><a target=\"_blank\" href=\"https:\/\/www.sandiegouniontribune.com\/news\/public-safety\/story\/2019-06-05\/more-city-neighborhoods-see-increase-in-violent-crimes-new-data-analysis-shows\" rel=\"noopener\"><span data-contrast=\"none\">certain neighborhoods<\/span><\/a><span data-contrast=\"auto\">, even certain blocks, and so those with criminal convictions can also be, and often are, victims of crime. There\u2019s plenty of evidence showing that a lot of it <\/span><a target=\"_blank\" href=\"https:\/\/www.pewresearch.org\/fact-tank\/2017\/03\/01\/most-violent-and-property-crimes-in-the-u-s-go-unsolved\/\" rel=\"noopener\"><span data-contrast=\"none\">goes unreported<\/span><\/a><span data-contrast=\"none\"> because victims themselves don\u2019t believe it\u2019ll solve anything long term<\/span><span data-contrast=\"auto\">. When trust is eroded, people begin thinking about their own forms of self-protection. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Being the victim of a crime <\/span><a target=\"_blank\" href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC4664019\/\" rel=\"noopener\"><span data-contrast=\"none\">increases the risk of<\/span><\/a> <a target=\"_blank\" href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC6602553\/\" rel=\"noopener\"><span data-contrast=\"none\">substance abuse<\/span><\/a> <a target=\"_blank\" href=\"https:\/\/www.bbc.com\/news\/health-31616242\" rel=\"noopener\"><span data-contrast=\"none\">and depression<\/span><\/a><span data-contrast=\"auto\">, which can lead to a host of other problems that undermine one\u2019s ability to earn a living and raise a family. Yet fewer than one in five of the survey\u2019s nearly 700 participants \u2014 who aligned with the state\u2019s racial demographics and geography and testified to a range of violent and non-violent offenses \u2014 said they\u2019d received financial, counseling, medical and other assistance. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Tinisch Hollins, executive director of Californians for Safety and Justice, said her organization commissioned the survey to take politics out of debates over criminal justice. It suggests that many crime victims don\u2019t believe our system of punishment and rehabilitation works very well, and they have a much more redemptive view of human nature. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">\u201cBut if we\u2019re looking at it from a commonsense approach, we can\u2019t just keep arresting, prosecuting and convicting,\u201d she said. \u201cWe need to deal with multiple layers of harm.\u201d\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Not all victims support weakening law enforcement\u2019s funding or powers, of course. Groups like Alliance for Hope International, co-founded by former San Diego City Attorney Casey Gwinn, argue that victims of domestic violence, in particular, are not in favor of various reforms to bail, police funding and so on. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">\u201cIn contrast, they want law enforcement to do more and do better,\u201d he wrote last year <\/span><a target=\"_blank\" href=\"https:\/\/www.civicresearchinstitute.com\/online\/article_abstract.php?pid=18&amp;iid=1461&amp;aid=9499\" rel=\"noopener\"><span data-contrast=\"none\">alongside the results<\/span><\/a><span data-contrast=\"auto\"> of his own survey.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">They all seem to agree, though, that crime victims are owed <\/span><span data-contrast=\"auto\">better care<\/span><span data-contrast=\"auto\">. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">California was the first state to establish a victims compensation fund in the 1960s, drawing on federal dollars, restitution fines and penalty assessments. It c<\/span><span data-contrast=\"auto\">an be <\/span><a target=\"_blank\" href=\"https:\/\/victims.ca.gov\/for-victims\/\" rel=\"noopener\"><span data-contrast=\"none\">applied toward<\/span><\/a><span data-contrast=\"auto\"> things like medical bills, lost income, broken property and relocation.<\/span><span data-contrast=\"auto\"> But for years, certain people were blocked from taking advantage of the benefits, making their lives unnecessarily harder.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Until 2013, for instance, California <\/span><a target=\"_blank\" href=\"https:\/\/www.nbcnews.com\/news\/us-news\/california-prostitutes-win-right-victim-compensation-flna2D11737860\" rel=\"noopener\"><span data-contrast=\"none\">blocked sex workers<\/span><\/a><span data-contrast=\"auto\"> from receiving compensation after being raped or beaten. Another bill introduced in the Legislature last year would <\/span><a target=\"_blank\" href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202120220SB299\" rel=\"noopener\"><span data-contrast=\"none\">expand victims compensation to families of police violence<\/span><\/a><span data-contrast=\"auto\">.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The recent spike in violence in San Diego appears to the result of escalating tensions during the pandemic. The very people who could most benefit from getting out of that cycle of trauma, though, have been left to linger for many years without support. And\u00a0one of the biggest impediments was the state\u2019s gang database, a <\/span><a target=\"_blank\" href=\"https:\/\/www.kpbs.org\/news\/midday-edition\/2020\/09\/24\/activists-sue-california-attorney-general-block-us\" rel=\"noopener\"><span data-contrast=\"none\">controversial<\/span><\/a><span data-contrast=\"auto\">, <\/span><a target=\"_blank\" href=\"https:\/\/www.latimes.com\/california\/story\/2020-07-10\/3-lapd-officers-charged-with-falsifying-records-to-claim-people-were-gang-members-associates\" rel=\"noopener\"><span data-contrast=\"none\">dubious<\/span><\/a><span data-contrast=\"auto\"> and <\/span><a target=\"_blank\" href=\"https:\/\/revealnews.org\/article\/you-may-be-in-californias-gang-database-and-not-even-know-it\/\" rel=\"noopener\"><span data-contrast=\"none\">secretive list<\/span><\/a><span data-contrast=\"auto\"> that included <\/span><a target=\"_blank\" href=\"https:\/\/www.voiceofsandiego.org\/topics\/public-safety\/few-people-have-successfully-removed-themselves-from-state-gang-database\/\" rel=\"noopener\"><span data-contrast=\"none\">dozens of infants<\/span><\/a><span data-contrast=\"auto\"> at one time. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">A U.S. Department of Justice-funded report in 2003 noted that some states were <\/span><a target=\"_blank\" href=\"https:\/\/www.ojp.gov\/pdffiles1\/nij\/grants\/203198.pdf\" rel=\"noopener\"><span data-contrast=\"none\">denying claims for funeral services<\/span><\/a><span data-contrast=\"auto\"> if the victim of a drive-by was a gang member. Others, the researchers wrote, \u201cmight pay in full, viewing an inner-city adolescent\u2019s gang membership as no more blameworthy than a battered woman who continues to reside with her abusive spouse.\u201d\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">In California, the Victims Compensation Board that reviews applications was not authorized to access the gang database, but it was still possible that staff could learn about gang ties through police reports included in the paperwork. Lawmakers <\/span><a target=\"_blank\" href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=201720180AB1639\" rel=\"noopener\"><span data-contrast=\"none\">put a stop<\/span><\/a><span data-contrast=\"auto\"> to this practice in 2018. The board is no longer allowed to deny benefits based solely on the gang affiliation of either the victim or the family member seeking assistance.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The window to apply was also extended from <\/span><a target=\"_blank\" href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=201920200SB375\" rel=\"noopener\"><span data-contrast=\"none\">three to seven years<\/span><\/a><span data-contrast=\"auto\"> in 2019. He wanted to own his own business \u2014 others thought he might have made a good lawyer \u2014 but he was pessimistic about his own prospects in San Diego at age 18. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Daniel made plans to move to Atlanta, his mother said, but he was shot on March 12, 1994, and died four days later. Daniel was one of several people killed near Lincoln Park that spring, provoking a candlelight vigil and march. \u201cNo more violence,\u201d Walter Kudumu, a longtime activist, was quoted in the Union-Tribune at the time. \u201cYou\u2019re our younger brothers, you\u2019re our blood, you\u2019re our flesh.\u201d <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Penny wasn\u2019t willing to wait for change. Instead, she did what Daniel could never do.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">She left San Diego \u2014 not because she feared for her own life but because she feared speaking one day with the murderer and not knowing it. The case is still open and those who knew him wonder to this day whether he was set up or killed accidentally. She packed up the family and hit the road in Daniel\u2019s car.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">\u201cIt still had the bullet holes in it,\u201d she said.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">State assistance would have helped, but Penny was grieving and couldn\u2019t bring herself to fill out the application, believing she\u2019d just get denied in the end because of <\/span><span data-contrast=\"auto\">Daniel\u2019s affiliation with a gang. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">He was laid to rest in Mount Hope Cemetery. <\/span><span data-contrast=\"auto\">The cost of the headstone alone would take the family years to pay off.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Laila Aziz, Daniel\u2019s girlfriend at the time, is still bothered that Penny couldn\u2019t get support through official channels. Through her work now at Pillars of the Community, Aziz encourages others to view public safety through the lens of a wide range of societal failures that include poverty and education, and consider that the line between victim and perpetrator is blurry.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">\u201cTheir trauma is just as deep as the victims of violence,\u201d she said. \u201cWhen you\u2019re on the victim\u2019s end, it\u2019s hard to see that.\u201d<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The number of resources available to crime victims has grown since Daniel\u2019s death. And so has the network of support.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">A few weeks ago, I stopped by a luncheon for crime victims in City Heights, where a dozen or so families socialized and raffled off prizes. One of the organizers, Elizabeth Mu\u00f1oz, started a trauma care institute <\/span><a target=\"_blank\" href=\"https:\/\/timesofsandiego.com\/opinion\/2019\/09\/23\/we-survived-our-sons-killing-by-assisting-others-now-california-must-help\/\" rel=\"noopener\"><span data-contrast=\"none\">following the death of her son<\/span><\/a><span data-contrast=\"auto\">. It provides counseling, helps with funeral preparations and acts as a liaison between families and law enforcement.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">In addition to the state victim compensation fund, the local district attorney\u2019s office is the largest provider of <\/span><a target=\"_blank\" href=\"https:\/\/www.sdcda.org\/content\/helping\/victims\/2021%20District%20Attorney%20Blueprint%20for%20Transforming%20Victim%20and%20Survivor%20Care.pdf\" rel=\"noopener\"><span data-contrast=\"none\">crime victim services<\/span><\/a><span data-contrast=\"auto\"> in the county. It established an emergency relief fund in 2005 and allocates millions of dollars through grants every year.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Aziz told me that she noticed crime victims voicing support for harsher punishments in political campaigns about two decades ago as talk of reform was heating up. \u201cBut at the same time, I would never disrespect or demean a mother who\u2019s lost their child to violence,\u201d she said. \u201cIt\u2019s better to do the work and prevent harm over the long term.\u201d <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Mu\u00f1oz shares the same goal. Her partnership with law enforcement, she said, is an opportunity to bend the ear of prosecutors while lobbying policy makers for reforms.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Her life was <\/span><a target=\"_blank\" href=\"https:\/\/www.sandiegouniontribune.com\/news\/public-safety\/sd-me-national-city-2015-shooting-homicide-arrests-20181128-story.html\" rel=\"noopener\"><span data-contrast=\"none\">turned upside down<\/span><\/a><span data-contrast=\"auto\"> when her son died. But she also knows that people convicted of crimes will leave their own homes broken. No one wins in that case.
