{"id":28455,"date":"2022-02-05T07:13:52","date_gmt":"2022-02-05T07:13:52","guid":{"rendered":"https:\/\/cjstudents.com\/?p=28455"},"modified":"2022-02-05T07:13:52","modified_gmt":"2022-02-05T07:13:52","slug":"can-lgbtq-people-trust-the-criminal-justice-system","status":"publish","type":"post","link":"https:\/\/cjstudents.com\/index.php\/2022\/02\/05\/can-lgbtq-people-trust-the-criminal-justice-system\/","title":{"rendered":"Can LGBTQ people trust the criminal justice system?"},"content":{"rendered":"<p> [ad_1]<\/p>\n<p>\n  Partygate has shambled on this week &#8211; but outside the continuing scramble over who ate which cake and where, this has also been, as is increasingly the case, a big one for desperately bleak news.\n<\/p>\n<div id=\"subscription-content\">\n<p>\n  We had a <a target=\"_blank\" href=\"https:\/\/www.thenational.wales\/news\/19897451.three-convicted-murdering-psychiatrist-dr-gary-jenkins-bute-park\/\" rel=\"noopener\">conviction in the case of Dr Gary Jenkins<\/a>, who, if you&#8217;re not familiar, was brutally murdered in Cardiff&#8217;s Bute Park last summer.\u00a0\n<\/p>\n<p>\n  An openly bisexual man, Dr Jenkins had seemingly gone to the park to meet men, as he often did, when two adult men and a teenage girl attacked and robbed him, shouting homophobic abuse as they did.\n<\/p>\n<p>\n  He died of his injuries around two weeks later.\n<\/p>\n<p>\n  The court heard how the trio had specifically targeted Bute Park because of its nocturnal cruising scene, with one of Jenkins\u2019 attackers referring to it as a \u201cdirty park\u201d.\n<\/p>\n<p>\n  <strong>READ MORE:\u00a0<\/strong><a target=\"_blank\" href=\"https:\/\/www.thenational.wales\/news\/19897579.bute-park-murder-trial-concerns-homophobia-prosecution\/\" rel=\"noopener\">Psychiatrist murder a \u2018reminder of hate communities face for simply existing\u2019<\/a>\n<\/p>\n<p>\n  If the details of this attack were not chilling enough for LGBTQ people to read, a secondary blow came with the words of prosecutor Dafydd Enoch QC, who told the jury in his opening speech: \u201c(Dr Jenkins\u2019) sexual predilections would be his undoing.\n<\/p>\n<p>\n  \u201cBy engaging in that activity he rendered himself hopelessly vulnerable and he was an easy target as he wandered around Bute Park.\n<\/p>\n<p>\n  \u201cBy its nature the activity he engaged in was risky.\u201d\n<\/p>\n<p>\n  <img decoding=\"async\" src=\"https:\/\/www.thenational.wales\/resources\/images\/3783044.jpg?type=article-full\" title=\"The National Wales: The attack took place in Cardiff's Bute Park last summer.\" alt=\"The National Wales: The attack took place in Cardiff's Bute Park last summer.\" class=\"editor-image\"\/><span class=\"inline-image-caption\">The attack took place in Cardiff&#8217;s Bute Park last summer. <\/span>\n<\/p>\n<p>\n  These comments, grounded as they were in familiar prejudices about the sex lives of gay men and bisexual people &#8211; uniquely deviant, slutty, \u201cdirty\u201d &#8211; were rightly called out as homophobic and victim-blaming, but they also raised a larger question about the criminal justice system.\n<\/p>\n<p>\n  <strong>READ MORE:\u00a0<\/strong><a target=\"_blank\" href=\"https:\/\/www.thenational.wales\/news\/19851645.raf-tortured-serviceman-simon-hinchley-robson-gay\/\" rel=\"noopener\">Gay serviceman \u2018tortured\u2019 at Welsh RAF base wants justice for others<\/a>\n<\/p>\n<p>\n  I\u2019ll preface this next little nugget with this: I\u2019m by no means an expert in queer history and culture. I am merely a queer person, with queer friends, speaking from my own experience and broad knowledge.\n<\/p>\n<p>\n  So if what I say is a bit basic, that\u2019s because unfortunately, I am myself a bit basic. Sorry!\n<\/p>\n<p>\n  It\u2019s not the main point I want to discuss, but it does clearly bear repeating that the sexual and romantic lives of LGBTQ people are often different in character to those of the straights, and &#8211; not always, but frequently &#8211; necessarily so.\n<\/p>\n<p>\n  If you\u2019ve grown up absorbing the message that your sexuality and\/or gender identity is abnormal, a cause for\u00a0embarrassment, \u201cicky\u201d &#8211; <a target=\"_blank\" href=\"https:\/\/www.thenational.wales\/news\/19723904.queer-wales-anniversary-section-28-repeal\/\" rel=\"noopener\">Section 28<\/a> was only lifted in 2003, remember &#8211; exploring and growing comfortable with that part of yourself can carry with it an extra weight.\u00a0\n<\/p>\n<p>\n  Even if you\u2019re confident enough to be open about it &#8211; as I am, and as, by all accounts, Dr Gary Jenkins was &#8211; feelings can fluctuate. It\u2019s a complicated thing.\n<\/p>\n<p>\n  <img decoding=\"async\" src=\"https:\/\/www.thenational.wales\/resources\/images\/13406796.jpg?type=article-full\" title=\"The National Wales: Dr Gary Jenkins was a consultant psychiatrist. \" alt=\"The National Wales: Dr Gary Jenkins was a consultant psychiatrist. \" class=\"editor-image\"\/><span class=\"inline-image-caption\">Dr Gary Jenkins was a consultant psychiatrist.  <\/span>\n<\/p>\n<p>\n  (This said,\u00a0I didn&#8217;t know Dr Jenkins &#8211; so please don&#8217;t think I&#8217;m purporting to explain this evidently much-loved\u00a0man or his life here.)\n<\/p>\n<p>\n  Anonymous, casual sex &#8211; asides from being, you know, fun &#8211; allows for pressure-free intimacy. In short: Human beings largely enjoy sex, sometimes without strings, and that\u2019s profoundly normal and fine and healthy.\n<\/p>\n<p>\n  Ideally this fact would be taken for granted in the year of our Lord 2022, but we know that this isn\u2019t the case. Where do LGBTQ people go when they need help?\n<\/p>\n<p>\n  Who can we trust?\n<\/p>\n<p>\n  Because this really isn\u2019t an isolated incident &#8211; Look at the police handling of the <a target=\"_blank\" href=\"https:\/\/www.pinknews.co.uk\/2022\/01\/03\/stephen-port-grindr-killer-murder-four-lives\/\" rel=\"nofollow noopener\">so-called &#8220;Grindr Killer&#8221; case<\/a>.\u00a0\n<\/p>\n<p>\n  Stephen Port drugged, raped and killed four young men with GHB (commonly known as \u201cthe date-rape drug\u201d) in London over the course of 16 months between 2014-2015.\n<\/p>\n<p>\n  <img decoding=\"async\" src=\"https:\/\/www.thenational.wales\/resources\/images\/10679986.jpg?type=article-full\" title=\"The National Wales: Stephen Port killed four young gay men over the course of 16 months between 2014-2015.\" alt=\"The National Wales: Stephen Port killed four young gay men over the course of 16 months between 2014-2015.\" class=\"editor-image\"\/><span class=\"inline-image-caption\">Stephen Port killed four young gay men over the course of 16 months between 2014-2015. <\/span>\n<\/p>\n<p>\n  He\u2019d met his victims on Grindr, a gay dating app, and had hired at least one &#8211; 23 year-old fashion student Anthony Walgate &#8211; as a sex worker.\n<\/p>\n<p>\n  Port didn\u2019t make any particularly clever, elaborate effort to conceal his murders.\n<\/p>\n<p>\n  In Anthony Walgate\u2019s case, he\u2019d simply dumped the young man\u2019s body in the street outside his house, and told police he\u2019d just found him there. When police discovered he was lying, he told them that Mr Walgate had overdosed on drugs, and no further action was taken.\n<\/p>\n<p>\n  <strong>READ MORE:\u00a0<\/strong><a target=\"_blank\" href=\"https:\/\/www.thenational.wales\/news\/19885288.cranogwen-poet-preacher-campaigner\/\" rel=\"noopener\">The remarkable life of Cranogwen who broke every convention of the Victorian age<\/a>\n<\/p>\n<p>\n  Port\u2019s other victims were also dumped just yards from his home, but once again, none of their deaths were treated as suspicious. It took pressure and extensive research from the victims\u2019 families and friends for the police to investigate the deaths as linked.\u00a0\n<\/p>\n<p>\n  The mother of Anthony Walgate, Sarah Sak, maintains that the police&#8217;s inaction stemmed from homophobia. She told\u00a0<em>Good Morning Britain\u00a0<\/em>recently: &#8220;Listening to all the officers, I realised whatever I did they wouldn&#8217;t investigate it.\u00a0\n<\/p>\n<p>\n  &#8220;Nothing would have made any difference.\n<\/p>\n<p>\n  &#8220;They just weren&#8217;t interested.\u201d\n<\/p>\n<p>\n  As it later turned out, Port had previously drugged and raped at least seven other young men, sexually assaulting others. They came forward after hearing about his arrest.\n<\/p>\n<p>\n  An <a target=\"_blank\" href=\"https:\/\/www.policeconduct.gov.uk\/news\/iopc-considering-reopening-investigation-met-police-handling-deaths-anthony-walgate-gabriel\" rel=\"nofollow noopener\">investigation by the Independent Office for Police Conduct<\/a> found \u201csystemic failings\u201d by the Metropolitan Police, and an inquest jury ruled last month that those mistakes \u201cprobably\u201d contributed to the deaths of Stephen Port\u2019s victims.\u00a0\n<\/p>\n<p>\n  <img decoding=\"async\" src=\"https:\/\/www.thenational.wales\/resources\/images\/13445879.jpg?type=article-full\" title=\"The National Wales: The Met Police has been under heightened scrutiny since the murder of Sarah Everard in March last year.
