{"id":28681,"date":"2022-02-11T23:58:11","date_gmt":"2022-02-11T23:58:11","guid":{"rendered":"https:\/\/cjstudents.com\/?p=28681"},"modified":"2022-02-11T23:58:11","modified_gmt":"2022-02-11T23:58:11","slug":"utah-death-penalty-repeal-questions-raised-in-case-of-death-row-inmate-douglas-carter","status":"publish","type":"post","link":"https:\/\/cjstudents.com\/index.php\/2022\/02\/11\/utah-death-penalty-repeal-questions-raised-in-case-of-death-row-inmate-douglas-carter\/","title":{"rendered":"Utah death penalty repeal: Questions raised in case of death row inmate Douglas Carter"},"content":{"rendered":"<p> [ad_1]<\/p>\n<div>\n<p id=\"bRvf3m\">The latest filings in a new hearing for one of Utah\u2019s death row inmates is raising concerns and stirring debate on Utah\u2019s Capitol Hill as lawmakers consider whether to do away with the state\u2019s death penalty. <\/p>\n<p id=\"w4Di1c\">While some Republican supporters of Utah\u2019s capital punishment have said they have confidence in Utah\u2019s justice system \u2014 contending the Beehive State has not seen the same issues other states have had with the death penalty \u2014 the penalty\u2019s detractors say the case\u2019s latest filings indicate Utah is not immune to problems with the finality of a death sentence, especially when new revelations surface sometimes decades later. <\/p>\n<p id=\"Au2CDV\">Among those alleged revelations that are causing concern in this case? Douglas Stewart Carter, who is Black, was convicted and sentenced using testimony from star witnesses who his defense attorneys say were threatened, paid thousands of dollars and told to lie by the Provo Police Department in the 1980s. Almost three years ago, the <a target=\"_blank\" href=\"https:\/\/www.deseret.com\/2019\/3\/23\/20669134\/utah-s-high-court-orders-fresh-review-of-evidence-for-man-on-death-row\" rel=\"noopener\">Utah Supreme Court ordered that Carter receive a new evidence hearing in 4th District Court<\/a>, pointing to \u201cdamning revelations\u201d from those witnesses.<\/p>\n<p id=\"szAFDm\">Carter, 66, is among the <a target=\"_blank\" href=\"https:\/\/www.deseret.com\/utah\/2021\/10\/4\/22684978\/men-utah-death-row-capital-punishment-deaht-penalty-murder-inmates-killers\" rel=\"noopener\">seven men currently sitting on Utah\u2019s death row<\/a>. He\u2019s been there for 35 years after he was convicted of aggravated murder for stabbing and shooting a Provo grandmother, 57-year-old Eva Olesen, who was also the aunt of a former Provo police chief. <\/p>\n<p id=\"H2muWt\">Late last month Carter\u2019s defense team submitted its post-hearing brief to the court asking that his conviction be thrown out \u2014 or at least his death sentence overturned. 334px), 100vw\" alt=\"\" data-upload-width=\"4500\" src=\"https:\/\/cdn.vox-cdn.com\/thumbor\/ZAuxG3Y4eJ11pO_mHg9COhW--_s=\/0x0:4500x3397\/1200x0\/filters:focal(0x0:4500x3397):no_upscale()\/cdn.vox-cdn.com\/uploads\/chorus_asset\/file\/23236168\/Marijuana_Presser_57077.jpg\"\/><\/source><\/picture><\/span><\/p>\n<p>  <\/span><\/p>\n<p>    <span class=\"e-image__meta\"><figcaption>Connor Boyack, president of the Utah-based libertarian think tank Libertas Institute, speaks at a press conference at the Capitol in Salt Lake City on Oct. 4, 2018.<\/figcaption><cite>Kristin Murphy, Deseret News<\/cite><\/p>\n<p>    <\/span><\/p>\n<\/figure>\n<p id=\"cHENki\">\u201cThe Carter brief in particular,\u201d Boyack said, \u201cfor pages and pages it says, \u2018Here\u2019s all these new revelations,\u2019 and had a jury known about this or about this or about this, then it\u2019s possible \u2014 I would argue likely \u2014 that at least one juror would have voted for life (in prison rather than the death penalty) had they known that.\u201d <\/p>\n<p id=\"2Z56Ky\">\u201cThat is why we\u2019re going to be talking a lot about this case,\u201d Boyack said. \u201cBecause it\u2019s the permanence of the death penalty that prevents those new revelations from coming to light.\u201d <\/p>\n<p id=\"0sogCm\">It\u2019s possible that evidence and arguments brought forth by Carter\u2019s defense attorneys could ultimately show Utah got Carter\u2019s sentence \u2014 and possibly his conviction \u2014 wrong, Boyack said. <\/p>\n<p id=\"kkwi31\">\u201cAs we\u2019ve worked on this issue over the years, the attorney general\u2019s office has long claimed, and many have believed, that Utah is somehow immune from the problems experienced in other states with the criminal justice and the death penalty specifically,\u201d Boyack said. \u201cThat claim being, \u2018We don\u2019t have any innocent people (on death row), Utah does it right.\u2019\u201d<\/p>\n<p id=\"KR9cCh\">Boyack pointed out that <a target=\"_blank\" href=\"https:\/\/innocenceproject.org\/petitions\/utah-death-penalty\/\" rel=\"noopener\">18 individuals have been exonerated in Utah<\/a>. Though not capital cases, that alone shows \u201cclearly there are issues with innocent people being convicted of crimes they did not commit.\u201d<\/p>\n<aside id=\"ewabSl\">\n<\/aside>\n<p id=\"62mfE3\">\u201cAnd now with the Carter case it\u2019s quite possible that this individual is factually innocent of the crime he was sentenced to die for committing,\u201d Boyack said. \u201cThat doesn\u2019t mean he\u2019s a good person &#8230; he might be a total scumbag. But, nevertheless, it may be that this guy that\u2019s been on death row for 35 years should not be on death row at all.\u201d <\/p>\n<p id=\"qtMLfy\">Boyack said the case \u201creally taints the claims\u201d by death penalty supporters that Utah is insulated from the issues other states have seen. <\/p>\n<p id=\"R1XK7A\">Nationally, 185 people on death row have been exonerated, according to the <a target=\"_blank\" href=\"https:\/\/innocenceproject.org\/petitions\/utah-death-penalty\/\" rel=\"noopener\">Innocence Project<\/a>. But it\u2019s not facing an easy path. <\/p>\n<p id=\"EzeLI4\">Two of the Utah House\u2019s top Republican leaders, House Speaker Brad Wilson, R-Kaysville, and House Majority Leader Mike Schultz, R-Hooper, told reporters last week they <a target=\"_blank\" href=\"https:\/\/www.deseret.com\/utah\/2022\/2\/4\/22918044\/utah-death-penalty-repeal-replace-bill-capital-punishment-republican-leaders-oppose-ron-lafferty\" rel=\"noopener\">personally oppose the bill, though they welcome the debate<\/a>. <\/p>\n<p id=\"8j6UZL\">\u201cI look at the <a target=\"_blank\" href=\"https:\/\/www.deseret.com\/utah\/2021\/10\/4\/22684978\/men-utah-death-row-capital-punishment-deaht-penalty-murder-inmates-killers\" rel=\"noopener\">people that are on death row in Utah<\/a>, and it makes me sick to my stomach,\u201d Schultz said. \u201cThese are the worst of the worst offenders.\u201d <\/p>\n<p id=\"gCOuNG\">Schultz also expressed his confidence in Utah\u2019s justice system. <\/p>\n<p id=\"pYcboa\">\u201cI get that there\u2019s probably been some things around the country that would make people question the death penalty, but I think we\u2019ve got a pretty fair process in the state of Utah.\u201d<\/p>\n<p id=\"8PkK8w\">Schultz on Thursday did not respond to a request for comment for this story when asked specifically about Carter\u2019s case. <\/p>\n<aside id=\"V5e4Vj\">\n<\/aside>\n<p id=\"wGd1o6\">The <a target=\"_blank\" href=\"https:\/\/www.deseret.com\/utah\/2022\/2\/4\/22918044\/utah-death-penalty-repeal-replace-bill-capital-punishment-republican-leaders-oppose-ron-lafferty\" rel=\"noopener\">Utah Attorney General\u2019s office also stands against repealing the death penalty<\/a>. Tom Brunker, assistant solicitor general in the Utah Attorney General\u2019s Office, called the death penalty an \u201cappropriate punishment for the worst of the worst of the worst violent criminals \u2014 those who commit violent unspeakable crimes.\u201d<\/p>\n<p id=\"OTP1P2\">While death penalty opponents say the death penalty and its often decadeslong appeals process offers only a false sense of justice and retraumatizes victims\u2019 loved ones, Brunker argues doing away with it won\u2019t prevent litigation \u2014 but add to it. <\/p>\n<p id=\"mL5Q9u\">\u201cWorse,\u201d Brunker said, \u201crepealing the death penalty will add many years of delay to the existing cases, exacerbating the pain the victims\u2019 family members are already suffering. And there will be little savings on the other end \u2014 Utah hasn\u2019t imposed a death sentence in more than 14 years.\u201d<\/p>\n<h3 id=\"5BNjBz\">Stirring debate on Capitol Hill<\/h3>\n<p id=\"K7Sp7d\">Boyack said he in recent days has begun discussing Carter\u2019s case with lawmakers on Utah\u2019s Capitol Hill, starting with members of the House Law Enforcement Committee that\u2019s slated to consider the bill Monday afternoon. <\/p>\n<p id=\"yj9gFl\">As lawmakers learn of the case and the questions it raises, \u201cit is a stunning revelation for even legislators who are opposed to the bill,\u201d Boyack said. <\/p>\n<p id=\"tgDfO9\">\u201cI think once the word gets out more broadly it\u2019s going to cause some reflection for some people who have been so certain about their position and certain about the unimpeachability of Utah\u2019s criminal justice system as it pertains to the death penalty.\u201d <\/p>\n<p id=\"FIXQwp\">Two influential conservative Republicans are spearheading this year\u2019s effort to repeal Utah\u2019s death penalty and replace it with a new sentence of 45 years to life in prison: Rep. Lowry Snow, R-St. George, and Sen. Dan McCay, R-Riverton. <\/p>\n<p id=\"1aZwN3\">Snow told the Deseret News on Thursday he was not fully familiar with the latest filings of the Carter case, but he said it does raise questions relevant to the larger debate about Utah\u2019s death penalty. <\/p>\n<p id=\"EkoLlV\">\u201cWe want to believe that we do things better here,\u201d Snow said. \u201cAnd in many ways we do. Having been a prosecutor, I still think Utah\u2019s criminal justice system is a good one and it works well. But it\u2019s not perfect.\u201d <\/p>\n<p id=\"6XiXGS\">Snow said Utah\u2019s system, like those in other states, is \u201csubject to the limitations and frailties of us as mortals.\u201d <\/p>\n<p id=\"0ZWnVn\">\u201cWhen it comes to imposing a death sentence and carrying it out, we are &#8230; mortals using our best evidence and best judgment possible,\u201d he said. \u201cBut we\u2019re still human.
