It doesn\u2019t mean people can steal up to $950 in goods without consequences.<\/p>\n<div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>Proposition 47, a law enacted in California in 2014, has been brought back into the public eye following a segment that aired on Fox News.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>The proposition reduces the penalties for some non-violent drug and petty theft offenses. Some Republican lawmakers in California are now pushing for a bill to repeal Proposition 47, <a target=\"_blank\" href=\"https:\/\/www.wusa9.com\/video\/news\/local\/prop-47-back-in-the-spotlight-as-republicans-and-democrats-introduce-bills-to-repeal-or-amend-it\/509-66133751-1c10-48db-8130-59e463c9226f\" rel=\"noopener noreferrer\">while other lawmakers are looking to amend it<\/a>. A recent poll also found that most voters surveyed would support changes to Proposition 47, <a target=\"_blank\" href=\"https:\/\/www.latimes.com\/california\/story\/2022-02-15\/california-voters-support-a-do-over-of-loosened-theft-crimes-under-prop-47\" rel=\"noopener noreferrer\">the Los Angeles Times reports<\/a>.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>\u201cWe&#8217;re proposing a pretty radical idea. Make crime illegal again in California,\u201d Assemblyman Kevin Kiley (R-Calif.), who appeared on Fox News in support of the bill to repeal Proposition 47, wrote <a target=\"_blank\" href=\"https:\/\/twitter.com\/KevinKileyCA\/status\/1495832648027095044\" rel=\"noopener noreferrer\">in a tweet<\/a>.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p><a target=\"_blank\" href=\"https:\/\/video.foxnews.com\/v\/6298372202001#sp=show-clips\" rel=\"noopener noreferrer\">During his February appearance on Fox News<\/a>, Kiley said, \u201cWe removed the consequence for stealing \u2013 and what do you know, it caused a lot more stealing. Under Prop 47, you can go into a store and steal up to $950 worth of merchandise and it\u2019s not even charged as a felony. It\u2019s not even a slap on the wrist.\u201d<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>Some social media users have also claimed that the California law <a target=\"_blank\" href=\"https:\/\/twitter.com\/LPaingood\/status\/1494280146479636485\" rel=\"noopener noreferrer\">permits shoplifting<\/a> and that shoplifting items worth less than $950 <a target=\"_blank\" href=\"https:\/\/twitter.com\/WCRP_WI\/status\/1495411843891929088\" rel=\"noopener noreferrer\">is not a crime<\/a>.\u00a0<\/p>\n<\/p><\/div>\n<p>&#13;<\/p>\n<h3>THE QUESTION<\/h3>\n<\/p>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>Can you steal up to $950 worth of merchandise in California without consequence?<\/p>\n<\/p><\/div>\n<p>&#13;<\/p>\n<h3>THE SOURCES<\/h3>\n<\/p>\n<p>&#13;<\/p>\n<h3>THE ANSWER<\/h3>\n<\/p>\n<div data-module=\"article-verify-claim\" class=\"article-verify-claim\">\n            <img decoding=\"async\" class=\"article-verify-claim__badge article-verify-claim__badge_checkmark_false\" alt=\"This is false.\" src=\"https:\/\/www.wusa9.com\/assets\/shared-images\/icons\/verify\/badge-false.png\"\/><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>No, you can\u2019t steal up to $950 worth of merchandise in California without consequence. Proposition 47 reduced the punishment for certain theft crimes, but it still classifies shoplifting as a misdemeanor.<\/p>\n<\/p><\/div>\n<p>&#13;<\/p>\n<h3>WHAT WE FOUND\u00a0<\/h3>\n<\/p>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>Proposition 47 reclassified certain theft offenses from felony charges to misdemeanors, <a target=\"_blank\" href=\"https:\/\/www.courts.ca.gov\/prop47.htm\" rel=\"noopener noreferrer\">according to California Courts<\/a>.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>The proposition created a new <a target=\"_blank\" href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=PEN&amp;sectionNum=459.5\" rel=\"noopener noreferrer\">misdemeanor offense called \u201cshoplifting,\u201d<\/a> which is punishable by up to six months in county jail, <a target=\"_blank\" href=\"https:\/\/www.courts.ca.gov\/documents\/Prop47FAQs.pdf\" rel=\"noopener noreferrer\">according to California Courts<\/a>. Attorneys (<a target=\"_blank\" href=\"https:\/\/www.kannlawoffice.com\/petty-theft.html\" rel=\"noopener noreferrer\">here<\/a>, <a target=\"_blank\" href=\"https:\/\/www.egattorneys.com\/shoplifting-penal-code-459-5\" rel=\"noopener noreferrer\">here<\/a> and <a target=\"_blank\" href=\"https:\/\/www.shouselaw.com\/ca\/defense\/penal-code\/459-5\/\" rel=\"noopener noreferrer\">here<\/a>) say shoplifters could also face a fine of up to $1,000, or both a fine and jail time. Shoplifting is defined under California\u2019s penal code as \u201centering a commercial establishment with intent to commit larceny while that establishment is open during regular business hours, where the value of the property that is taken or intended to be taken does not exceed $950.\u201d<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>Before the passage of Proposition 47, shoplifters were usually charged under the state\u2019s burglary laws, which carried felony penalties, <a target=\"_blank\" href=\"https:\/\/www.robertmhelfend.com\/criminal-defense\/california-shoplifting-laws\/\" rel=\"noopener noreferrer\">according to Robert Helfend, a criminal defense attorney in California<\/a>.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>In California, <a target=\"_blank\" href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=459.&amp;lawCode=PEN\" rel=\"noopener noreferrer\">burglary<\/a> means a person enters an inhabited residence \u2013 such as a home, apartment, boat or warehouse \u2013 \u201cwith intent to commit grand or petit larceny or any felony,\u201d the state\u2019s penal code says. First-degree burglary is punishable by up to six years in prison, felony probation and\/or fines.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>A person charged with shoplifting in California cannot also be charged with burglary or theft of the same property.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p><a target=\"_blank\" href=\"https:\/\/law.stanford.edu\/directory\/michael-romano\/\" rel=\"noopener noreferrer\">Michael Romano<\/a>, co-sponsor of Proposition 47 and chairperson of the <a target=\"_blank\" href=\"http:\/\/clrc.ca.gov\/CRPC.html\" rel=\"noopener noreferrer\">California Committee on the Revision of the Penal Code<\/a>, wrote in an email to VERIFY that the state directs savings from reduced incarceration into services such as mental health treatment and schools.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>Opponents of the law say it\u2019s led to an uptick in theft incidents, but Romano says Proposition 47 has had \u201cno measurable negative impact on crime rates.\u201d California\u2019s property crime rate in 2020 was \u201csignificantly below\u201d what it was in 2000 \u2013 down by 32%, <a target=\"_blank\" href=\"https:\/\/www.ppic.org\/blog\/recent-state-crime-trends-mostly-mirror-the-nation\/\" rel=\"noopener noreferrer\">according to the Public Policy Institute of California (PPIC) California<\/a>. However, there were statewide increases in property crime in 2012 and 2015.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>\u201cSince 2000, California has implemented many criminal justice reforms. No research to date has linked any of these reforms to changes in violent crime, but they have been found to be contributing factors to coinciding temporary increases in auto theft and larceny,\u201d the PPIC writes.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p><a target=\"_blank\" href=\"https:\/\/onlinelibrary.wiley.com\/doi\/abs\/10.1111\/1745-9133.12378#:~:text=As%20the%20United%20States%20engages,forefront%20of%20criminal%20justice%20reform.&amp;text=Thus%2C%20our%20findings%20suggest%20that,jails%20without%20compromising%20public%20safety.\" rel=\"noopener noreferrer\">In a 2018 research article<\/a> published in the Criminology and Public Policy journal, the authors explain that Proposition 47 also reduced other crimes in which the stolen property was less than $950 from felonies to misdemeanors. Those crimes include grand theft, receiving stolen property, forgery, fraud and writing a bad check.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>\u201cProp 47 was intended to impact future convictions and sentencing but also allowed for individuals incarcerated at the time for crimes covered by the measure to petition for resentencing,\u201d the article says. \u201cNotably, Prop 47 required thorough review of an individual\u2019s criminal history and proper risk assessment before resentencing to ensure public safety.\u201d<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p><a target=\"_blank\" href=\"https:\/\/faculty.sites.uci.edu\/ckubrin\/\" rel=\"noopener noreferrer\">Charis Kubrin, Ph.D<\/a>, professor of Criminology, Law and Society at the University of California, Irvine, is one of the article\u2019s authors.
