Tubbs was charged in 2021 after she was arrested in Idaho and her DNA linked her to the assault. She pleaded guilty and was <a target=\"_blank\" href=\"https:\/\/www.latimes.com\/california\/story\/2022-01-27\/26-year-old-who-sexually-assaulted-girl-while-underage-will-serve-two-year-term-in-juvenile-facility-judge-rules\" data-link-name=\"in body link\" rel=\"noopener\">sentenced<\/a> to two years in juvenile hall. Last week, however, <a target=\"_blank\" href=\"https:\/\/www.foxnews.com\/us\/los-angeles-hannah-tubbs-jailhouse-phone-calls?fbclid=IwAR2ZxJMS9Advu_j9aFcifxppcX-LOLCCoOFCTItFoPvFL2_q2tJ0HPq3JTE\" data-link-name=\"in body link\" rel=\"noopener\">Fox News<\/a> obtained jail recordings in which Tubbs <a target=\"_blank\" href=\"https:\/\/www.latimes.com\/california\/story\/2022-02-21\/gascon-reversed-himself-sentence-hannah-tubbs-who-assaulted-child\" data-link-name=\"in body link\" rel=\"noopener\">said<\/a> she \u201clucked out\u201d with a juvenile sentence and made disparaging and disturbing<strong> <\/strong>comments about the victim.<\/p>\n<p class=\"dcr-1wj398p\">The Tubbs case and its backlash come as progressive DAs across the US face mounting pressure from police, prosecutors, rightwing groups, media commentators, politicians and some communities to abandon reforms and restore harsher punishments amid <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/world\/2021\/dec\/20\/pandemic-gun-violence-us-communities\" data-link-name=\"in body link\" rel=\"noopener\">rising gun violence<\/a> and <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/us-news\/2021\/sep\/27\/us-murder-rate-increase-2020\" data-link-name=\"in body link\" rel=\"noopener\">homicide rates<\/a>. There\u2019s an ongoing <a target=\"_blank\" href=\"https:\/\/www.forbes.com\/sites\/cyrusfarivar\/2022\/01\/28\/chesa-boudin-recall-silicon-valley\/?sh=3044d39b6922\" data-link-name=\"in body link\" rel=\"noopener\">recall effort<\/a> against the San Francisco DA, who has fought against mass incarceration and police misconduct. In New York, the DA <a target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2022\/02\/04\/nyregion\/manhattan-da-alvin-bragg-memo-prosecution.html\" data-link-name=\"in body link\" rel=\"noopener\">reversed<\/a> some of his policies meant to reduce incarceration \u2013 just one month in office.<\/p>\n<p class=\"dcr-1wj398p\">Experts and advocates say the LA case highlighted the precarious nature of even modest reforms and how media coverage of individual horrific crimes can derail criminal justice reform.<\/p>\n<p class=\"dcr-1wj398p\">In a surprise statement on Sunday, Gasc\u00f3n said he would have handled the case differently had he known about the recordings and announced that he was now implementing a \u201cdifferent pathway for outlier cases\u201d. A panel of \u201ctrusted advisors\u201d would consider prosecuting youth as adults in extraordinary cases. Another committee could also consider whether to seek life without parole for some adult<strong> <\/strong>defendants, backtracking on his ban on sentencing people to die in prison.<\/p>\n<p class=\"dcr-1wj398p\">Shifting policies was a \u201creally difficult decision\u201d, Gasc\u00f3n told The Guardian. He noted how other countries keep youth out of the adult criminal system and have better results: \u201cIt is very clear to me the harm that we\u2019ve done for years in prosecuting juveniles as adults,\u201d Gasc\u00f3n said. He acknowledged the audio obtained by Fox News prompted him to shift his thinking.<\/p>\n<p class=\"dcr-1wj398p\">Gasc\u00f3n, who won office on promises of ending harsh punishments and prioritizing racial justice, also argued that the current juvenile system in <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/us-news\/california\" data-component=\"auto-linked-tag\" data-link-name=\"in body link\" rel=\"noopener\">California<\/a> could not adequately handle a case as complex as Tubbs, who has faced charges in other counties, but \u201cnever received any services\u201d.<\/p>\n<aside class=\"dcr-1pgonlz\"><svg viewbox=\"4 4 24 16\" class=\"dcr-knbk2a\"><path d=\"M9.2776 8H14.0473C13.4732 12.5489 12.9653 17.0095 12.7445 22H4C4.79495 17.142 6.4511 12.5489 9.2776 8ZM20.3852 8H25.0887C24.5808 12.5489 24.0067 17.0095 23.7859 22H15.0635C15.9688 17.142 17.5587 12.5489 20.3852 8Z\"\/><\/svg><\/p>\n<blockquote class=\"dcr-1u4hpl4\"><p>As a country, we tend to make decisions that are reactionary based on one or two high-profile incidents, instead of following the evidence and research on what is most effective and equitable<\/p><\/blockquote>\n<footer><cite class=\"dcr-1irn6li\">Kristin Henning<\/cite><\/footer>\n<\/aside>\n<p class=\"dcr-1wj398p\">He emphasized that it would be \u201cvery rare\u201d for his office to try youth as adults: \u201cI will not allow this to be something that happens regularly.\u201d<\/p>\n<p class=\"dcr-1wj398p\">The shift has not appeased Gasc\u00f3n\u2019s critics, with the furor over his policies only growing. The <a target=\"_blank\" href=\"https:\/\/www.politico.com\/news\/2022\/02\/22\/los-angeles-prosecutors-progressive-da-gascon-00010798\" data-link-name=\"in body link\" rel=\"noopener\">majority<\/a> of rank-and-file prosecutors voted Tuesday to support a campaign to recall him from office.<\/p>\n<p class=\"dcr-1wj398p\">Liz Braunstein, an attorney for Tubbs, said the leak of audio violated confidentiality rules in juvenile cases and the judge\u2019s orders.<\/p>\n<p class=\"dcr-1wj398p\">\u201cHannah was a teenager when this happened. Most of the children that we see in delinquency court have experienced multiple traumas and adverse life experiences,\u201d Braunstein said. \u201cOur collective goal should be rehabilitation, which will improve the lives of that young person and also offer a greater degree of public safety.\u201d<\/p>\n<p class=\"dcr-1wj398p\">The victim released a <a target=\"_blank\" href=\"https:\/\/www.latimes.com\/california\/story\/2022-02-21\/gascon-reversed-himself-sentence-hannah-tubbs-who-assaulted-child\" data-link-name=\"in body link\" rel=\"noopener\">statement<\/a> after the sentencing that described the assault as \u201cbeyond horrible\u201d and criticized Gasc\u00f3n for his handling of the case.<\/p>\n<p class=\"dcr-1wj398p\">\u201cNot only do I have to live with that awful memory for the rest of my life, but I\u2019m also given no true justice as to what happened to me.\u201d<\/p>\n<h2>\u2018Reactionary\u2019 backlash across the US<\/h2>\n<p class=\"dcr-1wj398p\">An uptick in gun violence and killings during the pandemic has caused significant concern in communities across the US, even though the current crime rate is significantly lower than decades prior. District attorneys have faced widespread scrutiny in media coverage of individual cases of violence. At times, they\u2019ve been criticized for issues they have very little control over such as worsening homelessness crisis and mental health challenges.<\/p>\n<p class=\"dcr-1wj398p\">The critics of more liberal DAs have argued that these problems warrant a tough response. But champions of reform note <a target=\"_blank\" href=\"https:\/\/www.ojp.gov\/pdffiles1\/nij\/247350.pdf\" data-link-name=\"in body link\" rel=\"noopener\">studies<\/a> have <a target=\"_blank\" href=\"https:\/\/www.sentencingproject.org\/wp-content\/uploads\/2016\/01\/Deterrence-in-Criminal-Justice.pdf\" data-link-name=\"in body link\" rel=\"noopener\">shown<\/a> that harsher punishments <a target=\"_blank\" href=\"https:\/\/newsroom.unsw.edu.au\/news\/business-law\/do-harsher-punishments-deter-crime\" data-link-name=\"in body link\" rel=\"noopener\">do not<\/a> prevent or deter crime and instead can lead to worse public safety <a target=\"_blank\" href=\"https:\/\/www.theatlantic.com\/education\/archive\/2016\/01\/the-cost-of-keeping-juveniles-in-adult-prisons\/423201\/\" data-link-name=\"in body link\" rel=\"noopener\">outcomes<\/a> while also disproportionately hurting Black and brown communities. They also note that in some cases, progressive DAs have been blamed for high-profile incidents of violence in cases where there was <a target=\"_blank\" href=\"https:\/\/sfist.com\/2022\/01\/28\/lawsuit-against-boudin-over-brutal-chinatown-attack-seems-a-little-shaky-as-further-details-emerge\/\" data-link-name=\"in body link\" rel=\"noopener\">no indication<\/a> that the <a target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2022\/02\/02\/opinion\/crime-new-york-district-attorney.html\" data-link-name=\"in body link\" rel=\"noopener\">offenses<\/a> had any ties to specific DA decisions or <a target=\"_blank\" href=\"https:\/\/nypost.com\/2020\/07\/08\/nypds-own-stats-debunk-claims-about-bail-reform-link-to-shootings\/\" data-link-name=\"in body link\" rel=\"noopener\">policies<\/a>.<\/p>\n<p class=\"dcr-1wj398p\">\u201cAs a country, we tend to make decisions that are reactionary based on one or two<strong> <\/strong>high-profile incidents, instead of following the evidence and research on what is most effective and equitable,\u201d said Kristin Henning, a Georgetown Law professor and author of The Rage of Innocence: How America Criminalizes Black Youth. She added Tubbs\u2019 prosecution was \u201can unfortunate case\u201d to be at the center of a debate on prosecuting children as adults because of its complexities.<\/p>\n<figure reports of rising crime in the late 80s and 90s that led to the racist \u201csuperpredator\u201d myth, which was the basis for laws that made it easier to transfer youth to adult prisons, Henning noted. In New York, for example, a crime spree by a 15-year-old in 1978 led to a <a target=\"_blank\" href=\"https:\/\/thecrimereport.org\/2018\/03\/20\/how-nyc-case-led-to-trying-juveniles-as-adults\/\" data-link-name=\"in body link\" rel=\"noopener\">new state law<\/a> allowing children as young as 13 to be tried as adults.<\/p>\n<p class=\"dcr-1wj398p\">Henning added that there was now much more research about adolescent development and the harms of imprisoning youth, as well as momentum for racial justice reforms after George Floyd\u2019s murder.<\/p>\n<p class=\"dcr-1wj398p\">Kami Chavis, law professor and director of the criminal justice program at Wake Forest University, lamented that reforms and crime prevention were often framed as opposing forces: \u201cThere is a real danger that the electorate is going to conflate progressive criminal justice policies with a rise in crime.\u201d<\/p>\n<p class=\"dcr-1wj398p\">Gasc\u00f3n himself said he concerned that \u201cthe rightwing narrative is permeating very effectively into the mainstream of our community, even to some progressive members\u201d, adding, \u201cPeople are running scared, because they\u2019re hearing the same things over and over.\u201d<\/p>\n<p class=\"dcr-1wj398p\">He said there were rises in crime in jurisdictions with conservative DAs, which demonstrated \u201cthe whole concept of simply locking people up doesn\u2019t work \u2026 if it did, most places would be extremely safe.\u201d<\/p>\n<aside class=\"dcr-1pgonlz\"><svg viewbox=\"4 4 24 16\" class=\"dcr-knbk2a\"><path d=\"M9.2776 8H14.0473C13.4732 12.5489 12.9653 17.0095 12.7445 22H4C4.79495 17.142 6.4511 12.5489 9.2776 8ZM20.3852 8H25.0887C24.5808 12.5489 24.0067 17.0095 23.7859 22H15.0635C15.9688 17.142 17.5587 12.5489 20.3852 8Z\"\/><\/svg><\/p>\n<blockquote class=\"dcr-1u4hpl4\"><p>He has to respond in a way that will allow him to stay in the job to continue to do the good work even if it means softening his blanket policy<\/p><\/blockquote>\n<footer><cite class=\"dcr-1irn6li\">Frankie Guzman<\/cite><\/footer>\n<\/aside>\n<h2>\u2018No such thing as a progressive prosecutor\u2019<\/h2>\n<p class=\"dcr-1wj398p\">In Los Angeles, Gasc\u00f3n\u2019s handling of the Tubbs case and subsequent policy shift has angered people on all sides, said Anthony Robles, campaigns coordinator with Youth Justice Coalition, who is part of a group working to end youth incarceration in LA county.<\/p>\n<p class=\"dcr-1wj398p\">\u201cI don\u2019t think anybody is happy \u2026 The people who really want a transformed justice system \u2013 he\u2019s reneging on us,\u201d Robles said. \u201cIt\u2019s shocking and disappointing.\u201d<\/p>\n<p class=\"dcr-1wj398p\">Frankie Guzman, an attorney at the National Center for Youth Law, who served on Gasc\u00f3n\u2019s transition team, noted that California has come a long way in the last decade. In 2020, 25 youth total across the state were <a target=\"_blank\" href=\"https:\/\/data-openjustice.doj.ca.gov\/sites\/default\/files\/2021-06\/Juvenile%20Justice%20In%20CA%202020.pdf\" data-link-name=\"in body link\" rel=\"noopener\">transferred<\/a> to the adult system, <a target=\"_blank\" href=\"https:\/\/oag.ca.gov\/sites\/all\/files\/agweb\/pdfs\/cjsc\/publications\/misc\/jj\/jj08-full-report.pdf\" data-link-name=\"in body link\" rel=\"noopener\">compared<\/a> to 1,200 youth in 2008.
