Marijuana Sales Ban In Place But Continues Protections For Medical Cannabis States In Spending Legislation"},"content":{"rendered":"<p> [ad_1]<\/p>\n<div>\n<p>Military veterans would be \u201cencouraged\u201d to discuss medical marijuana treatment without the fear of losing federal benefits under a new bill being sponsored by Rep. Seth Moulton (D-MA).<\/p>\n<p>The main thrust of the legislation is to codify existing policies that allow VA doctors to talk about medical cannabis with patients as well as protections for veterans who are candid about their history with marijuana treatment. This is why we need to normalize the use of medical marijuana among veterans as a safer, non-addictive alternative for chronic pain relief,\u201d Moulton said in a <a target=\"_blank\" href=\"https:\/\/moulton.house.gov\/press-releases\/moulton-bill-would-destigmatize-medical-marijuana-in-va-care\" rel=\"noopener\">press release<\/a>. \u201cVeterans chose to serve our country, and many will deal with resulting health issues for the rest of their lives. It\u2019s our responsibility to ensure that returning service members have access to every solution that allows them to live free of pain or anxiety.\u201d<\/p>\n<p>Under the proposal, VA practitioners would be required to \u201chonor the desires of their patients to seek alternative forms of treatment\u201d\u2014but the measure would not explicitly allow doctors at the department to issue recommendations that veterans need to participate in state medical cannabis laws as would be the case under separate, previously filed legislation,<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Veterans are twice as likely to die from an opioid overdose than civilian Americans. <\/p>\n<p>Today, I introduced legislation that would destigmatize the use of medical marijuana among veterans as a safer, non-addictive alternative for chronic pain &amp; anxiety. <a target=\"_blank\" href=\"https:\/\/t.co\/eMPFr0VSUX\" rel=\"noopener\">https:\/\/t.co\/eMPFr0VSUX<\/a><\/p>\n<p>\u2014 Rep. Seth Moulton (@RepMoulton) <a target=\"_blank\" href=\"https:\/\/twitter.com\/RepMoulton\/status\/1501271889737617411?ref_src=twsrc%5Etfw\" rel=\"noopener\">March 8, 2022<\/a><\/p>\n<\/blockquote>\n<p>VA \u201cacknowledges medical cannabis use may be a legitimate alternative treatment and a Department medical provide will not recommend a veteran for drug addiction treatment solely by reason of medicinal cannabis use,\u201d the bill text continues.<\/p>\n<p style=\"padding-left: 40px;\">\u201cDepartment medical providers will annotate a veteran\u2019s cannabis use in the medical record of he veteran in order to have the information available in treatment planning. As with all clinical information, this is part of the confidential medical record and protected under patient privacy and confidentiality laws and regulations. Department medical providers will not record that a patient has a marijuana addiction problem in their medical record if the patient is responsibly using medicinal cannabis.\u201d<\/p>\n<p>Beyond being able to discuss medical marijuana treatment options with patients, VA doctors would be able to \u201cadjust treatment plans as necessary.\u201d And those adjustments \u201cshould be relevant and a veteran should have the freedom to seek a second opinion if the veteran feels the change is not fair.\u201d<\/p>\n<p>Also, while VA providers must adhere to federal law, the bill stipulates that scientists \u201cmay conduct research on cannabis benefits and risks under regulatory approval.\u201d Again, this provision seems to codify existing VA policies, as the department has facilitated some research into cannabis for certain conditions that commonly afflict the veteran community\u2014thought advocates want many more studies to be conducted.<\/p>\n<p>Further, VA doctors \u201cmay not dissuade participation in non-Department medicinal cannabis research,\u201d the bill says.<\/p>\n<p>Moulton\u2019s legislation also lays out guidelines for veteran surveys that the VA secretary would need to administer concerning issues such as dosage, frequency of use and types of marijuana that are being utilized by veteran patients.<\/p>\n<p>It would additionally require VA to provide its doctors with \u201can initial training in the use of medical cannabis\u201d in partnership with \u201cmedical schools that have incorporated education on medical cannabis into their curricula.\u201d<\/p>\n<p>The congressman has played an active role in introducing veteran- and cannabis-specific legislation in past sessions. In 2019, for example, he filed three House bills <a target=\"_blank\" href=\"https:\/\/www.marijuanamoment.net\/presidential-candidate-files-three-bills-on-medical-marijuana-for-military-veterans\/\" rel=\"noopener\">concerning medical marijuana for military veterans<\/a>.<\/p>\n<p>Separately, House and Senate committees held joint hearings last week to <a target=\"_blank\" href=\"https:\/\/www.marijuanamoment.net\/veterans-groups-call-on-congress-to-allow-medical-marijuana-access-through-va\/\" rel=\"noopener\">hear from veterans service organizations (VSOs)<\/a> about how Congress and the federal government can better serve their constituents, and several of the groups brought up the need to ease restrictions on marijuana.<\/p>\n<p>In past hearings on veterans- and marijuana-related legislation, VA representatives have pushed back against VSOs by insisting that the department is already carrying out research into the therapeutic potential of cannabis. But advocates say the focus of that research is too often focused on the potential negative consequences of marijuana consumption.<\/p>\n<p>Some advocates had held out hope that the department would back modest reform proposals this session after the sponsor of one key VA research bill, Rep. Lou Correa (D-CA), said that\u00a0<a target=\"_blank\" href=\"https:\/\/www.marijuanamoment.net\/watch-live-key-house-committee-to-vote-on-federal-marijuana-legalization-bill\/\" rel=\"noopener\">he\u2019d had a conversation with VA Secretary Denis McDonough<\/a>\u00a0about the issue of marijuana and veterans.<\/p>\n<p>In December, a VA researcher acknowledged that people with post-traumatic stress disorder (PTSD) who use marijuana\u00a0<a target=\"_blank\" href=\"https:\/\/www.marijuanamoment.net\/marijuana-helps-treat-ptsd-symptoms-but-federal-policy-impedes-science-va-researcher-says\/\" rel=\"noopener\">experience fewer symptoms and recover more quickly<\/a>\u00a0compared to people who don\u2019t use cannabis.<\/p>\n<p>Another VA official said in September that the department is \u201cvery closely\u201d following research into\u00a0<a target=\"_blank\" href=\"https:\/\/www.marijuanamoment.net\/va-is-very-closely-following-psychedelics-research-for-veterans-with-ptsd-official-tells-lawmakers\/\" rel=\"noopener\">the potential therapeutic benefits of psychedelics like MDMA<\/a>\u00a0for military veterans with PTSD.<\/p>\n<p>A federal commission tasked with developing recommendations to improve mental health treatment for military veterans determined in a report in 2020 that Congress and the executive branch\u00a0<a target=\"_blank\" href=\"https:\/\/www.marijuanamoment.net\/federal-commission-pushes-expansion-of-marijuana-and-psychedelics-research-for-military-veterans\/\" rel=\"noopener\">should promote research into the therapeutic potential<\/a>\u00a0of marijuana and psychedelics such as psilocybin mushrooms and MDMA.<\/p>\n<p>Separately, a bipartisan coalition of congressional lawmakers said in a letter to McDonough that the department must urgently institute a policy change to\u00a0<a target=\"_blank\" href=\"https:\/\/www.marijuanamoment.net\/bipartisan-lawmakers-push-va-to-allow-medical-marijuana-access-for-veterans-as-soon-as-possible\/\" rel=\"noopener\">ensure that military veterans can access cannabis<\/a>\u00a0for therapeutic use.<\/p>\n<p>The letter came weeks after McDonough participated in a Veterans Day Q&amp;A where he said that VA officials are\u00a0<a target=\"_blank\" href=\"https:\/\/www.marijuanamoment.net\/va-secretary-looking-at-medical-marijuana-policy-change-following-profound-discussion-with-veteran\/\" rel=\"noopener\">\u201clooking at\u201d the possibility of an internal policy change<\/a>\u00a0and have discussed it with the White House and Department of Justice.
