Earlier this month, Senate Republicans <a target=\"_blank\" href=\"https:\/\/www.reuters.com\/legal\/litigation\/gop-criticizes-biden-judicial-nominees-defense-death-row-inmate-2022-03-02\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__medium__1kbOh text__large__nEccO link__underline_default__2prE_\" rel=\"noopener\">described<\/a> one such nominee as a &#8220;zealot&#8221; because she had argued against the death penalty in a murder trial.<\/p>\n<p data-testid=\"paragraph-2\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">The clash reached a crescendo this week, as conservatives <a target=\"_blank\" href=\"https:\/\/www.reuters.com\/world\/us\/senators-poised-grill-bidens-us-supreme-court-pick-jackson-2022-03-22\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__medium__1kbOh text__large__nEccO link__underline_default__2prE_\" rel=\"noopener\">continued to attack<\/a> U.S. Supreme Court nominee Ketanji Brown Jackson for her previous work representing defendants unable to afford an attorney. Republican criticisms have been <a target=\"_blank\" href=\"https:\/\/www.reuters.com\/world\/us\/senators-poised-grill-bidens-us-supreme-court-pick-jackson-2022-03-22\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__medium__1kbOh text__large__nEccO link__underline_default__2prE_\" rel=\"noopener\">reported<\/a> by Reuters and other major news media as mischaracterizations and an apparent political nod to QAnon conspiracy theorists.<\/p>\n<p data-testid=\"paragraph-4\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">A spokesperson for Senator Chuck Grassley, the ranking Republican on the Senate Judiciary Committee, didn&#8217;t immediately respond to my queries about conservatives&#8217; questions surrounding Jackson&#8217;s public defender record.<\/p>\n<p data-testid=\"paragraph-5\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">Jackson explained in the March 22 confirmation hearing that she cares &#8220;deeply about our Constitution and the rights that make us free.&#8221; She added, \u201cDefense lawyers perform a service, and our system is exemplary throughout the world precisely because we ensure that people who are accused of crimes are treated fairly.\u201d<\/p>\n<p data-testid=\"paragraph-6\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">April Frazier Camara, president and CEO of the National Legal Aid and Defender Association, told me the hearings \u201cunfortunately\u201d confirm a \u201clack of public understanding\u201d about public defenders\u2019 role in preserving fundamental rights to counsel and presumption of innocence.<\/p>\n<p data-testid=\"paragraph-7\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">Indeed, the disagreement over the meaning of those rights goes to how we define justice in this country. Do we actually ensure people accused of crimes are treated fairly? Are the values the Democratic nominee expressed about defendants&#8217; rights widely shared? Or do we lean more toward a belief that justice means certain offenders, such as pedophiles, should just die in jail, as some Republican leaders suggest?<\/p>\n<p data-testid=\"paragraph-8\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">The reality is that <a target=\"_blank\" href=\"https:\/\/tmsnrt.rs\/3iuyfy7\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__medium__1kbOh text__large__nEccO link__underline_default__2prE_\" rel=\"noopener\">there is<\/a> <a target=\"_blank\" href=\"http:\/\/www.constitutionproject.org\/pdf\/139.pdf\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__medium__1kbOh text__large__nEccO link__underline_default__2prE_\" rel=\"noopener\">broad<\/a> <a target=\"_blank\" href=\"https:\/\/www.brennancenter.org\/media\/323\/download\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__medium__1kbOh text__large__nEccO link__underline_default__2prE_\" rel=\"noopener\">consensus<\/a> in the legal community, including among public defenders, that our justice system has perpetually fallen short of its promise of adequate counsel to all defendants.<\/p>\n<p data-testid=\"paragraph-9\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">Although the rights of the accused are famously written into our founding documents, there&#8217;s a strong argument that many Americans and lawmakers don\u2019t actually view those rights as a legislative or policy priority &#8212; partly because of a punitive attitude toward defendants that is tied to racial stereotypes and resentment.<\/p>\n<p data-testid=\"paragraph-10\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">Those rights are included in the first 10 Amendments, adopted in 1791. The idea is that it is fundamentally unfair for individuals to face the power of the government \u2013 represented by publicly funded prosecutors \u2013 without certain guarantees, including their own well-trained counsel.<\/p>\n<p data-testid=\"paragraph-11\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">The first public defender office was established in 1914, in Los Angeles County, according to a 2019 <a target=\"_blank\" href=\"https:\/\/www.brennancenter.org\/media\/4438\/download\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__medium__1kbOh text__large__nEccO link__underline_default__2prE_\" rel=\"noopener\">report<\/a> by the Brennan Center for Justice.<\/p>\n<p data-testid=\"paragraph-12\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">By contrast, our public prosecution systems predate public defenders by more than two centuries: The first public prosecutor in America <a target=\"_blank\" href=\"https:\/\/portal.ct.gov\/DCJ\/About-Us\/About-Us\/About-Us#:~:text=The%20first%20public%20prosecutor%20in,Connecticut%20on%20April%203%2C%201705\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__medium__1kbOh text__large__nEccO link__underline_default__2prE_\" rel=\"noopener\">was appointed<\/a> in 1705, in Hartford, Conn. In fact, the right to counsel didn\u2019t apply in the overwhelming majority of criminal proceedings for roughly 170 years, until the Supreme Court decided in 1963 that the Sixth Amendment applies in state courts, in Gideon v. Wainwright.<\/p>\n<p data-testid=\"paragraph-13\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">From that time until 2000, &#8220;a major independent report has been issued at least every five years documenting the severe deficiencies in indigent defense services,\u201d according to a Harvard Law Review <a target=\"_blank\" href=\"https:\/\/tmsnrt.rs\/3iuyfy7\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__medium__1kbOh text__large__nEccO link__underline_default__2prE_\" rel=\"noopener\">note<\/a> published in 2000.<\/p>\n<p data-testid=\"paragraph-14\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">The premise underlying Republicans&#8217; criticism of Jackson&#8217;s public defender background is also nothing new: Politicians have continuously questioned the legitimacy of the defender\u2019s role, and spending tax money on indigent defense has long been unpopular, according to the Brennan Center report.<\/p>\n<p data-testid=\"paragraph-15\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">In 1976, Georgia prosecutors described a bill for statewide funding of indigent defense as \u201cthe greatest threat to the proper enforcement of the criminal laws of this state ever presented.\u201d In 1995, the South Carolina attorney general criticized public defenders as \u201clobbyists whose only goal is to stop executions at any cost.\u201d Supreme Court Justice Clarence Thomas argued in a 2018 <a target=\"_blank\" href=\"https:\/\/www.supremecourt.gov\/opinions\/18pdf\/17-1026_2c83.pdf\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__medium__1kbOh text__large__nEccO link__underline_default__2prE_\" rel=\"noopener\">ruling<\/a> that the &#8220;expansive rights&#8221; granted in Gideon don&#8217;t square with the original meaning of the Sixth Amendment.<\/p>\n<p data-testid=\"paragraph-16\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">Empirical research over the years has also shown substantial support among Americans for \u201ctough-on-crime\u201d policies &#8212; and a connection between those sentiments and racial bias, according to a 2020 law review <a target=\"_blank\" href=\"https:\/\/tmsnrt.rs\/3umvrcc\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__medium__1kbOh text__large__nEccO link__underline_default__2prE_\" rel=\"noopener\">article<\/a> by Michael O&#8217;Hear, a law professor at Marquette University Law School, and Darren Wheelock, a Marquette University criminology professor.<\/p>\n<p data-testid=\"paragraph-17\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">\u201cOne theory is people become punitive because they&#8217;re afraid of being victimized and believe harsh punishment equals protection, but the research \u2013 ours and others\u2019 \u2013 doesn\u2019t bear that out,\u201d O&#8217;Hear told me. \u201cPunitiveness is embraced more as an expressive value, tied to political ideology, which is in turn connected to racial resentment.\u201d<\/p>\n<p data-testid=\"paragraph-18\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">Surveys have also shown many Americans seem to believe that most defendants are likely guilty. The criticism against Jackson \u201cplays on a lot of deep-seated public skepticism of criminal defendants and the people who represent them,\u201d O&#8217;Hear said.<\/p>\n<p data-testid=\"paragraph-19\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">That skepticism may also be reflected in public spending.<\/p>\n<p data-testid=\"paragraph-20\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">Since 2018, public defenders in <a target=\"_blank\" href=\"https:\/\/www.wweek.com\/news\/courts\/2018\/10\/24\/public-defenders-make-far-less-than-prosecutors-an-oregon-lawmaker-wants-to-give-them-a-raise\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__medium__1kbOh text__large__nEccO link__underline_default__2prE_\" rel=\"noopener\">Oregon<\/a>; <a target=\"_blank\" href=\"https:\/\/www.virginiamercury.com\/2021\/04\/20\/virginia-public-defenders-face-local-resistance-in-push-for-pay-parity-with-prosecutors\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__medium__1kbOh text__large__nEccO link__underline_default__2prE_\" rel=\"noopener\">Virginia<\/a>; <a target=\"_blank\" href=\"https:\/\/www.jacksonville.com\/story\/news\/politics\/government\/2018\/02\/23\/paying-for-justice-public-defenders-and-prosecutors-flee-for-better-salaries\/14124984007\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__medium__1kbOh text__large__nEccO link__underline_default__2prE_\" rel=\"noopener\">Jacksonville, Florida<\/a>, and <a target=\"_blank\" href=\"https:\/\/www.law360.com\/articles\/1096330\/nyc-public-defenders-district-attorneys-demand-pay-parity\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__medium__1kbOh text__large__nEccO link__underline_default__2prE_\" rel=\"noopener\">New York City<\/a>, have raised outcry about disparities in pay and resources compared with prosecutors.<\/p>\n<p data-testid=\"paragraph-21\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">Last week, Minnesota officials averted a potential strike by public defenders when they reached a contract agreement including pay increases, the Associated Press reported March 19.<\/p>\n<p data-testid=\"paragraph-22\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">And, on March 18 &#8212; the 59th anniversary of the Gideon decision &#8212; the National Legal Aid and Defender Association <a target=\"_blank\" href=\"https:\/\/www.nlada.org\/node\/50151\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__medium__1kbOh text__large__nEccO link__underline_default__2prE_\" rel=\"noopener\">announced<\/a> a letter urging Congress to pass <a target=\"_blank\" href=\"https:\/\/teddeutch.house.gov\/news\/documentsingle.aspx?DocumentID=402569\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__medium__1kbOh text__large__nEccO link__underline_default__2prE_\" rel=\"noopener\">a bill<\/a> aimed at creating pay parity between state and local defenders and prosecutors.<\/p>\n<p data-testid=\"paragraph-23\" class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__base__22dCE body__large_body__FV5_X article-body__element__OOj6H\">The attacks against Jackson have struck many as distasteful political theater.
