{"id":30243,"date":"2022-03-30T21:52:49","date_gmt":"2022-03-30T21:52:49","guid":{"rendered":"https:\/\/cjstudents.com\/?p=30243"},"modified":"2022-03-30T21:52:49","modified_gmt":"2022-03-30T21:52:49","slug":"new-yorks-crunch-time-to-finally-fix-criminal-justice","status":"publish","type":"post","link":"https:\/\/cjstudents.com\/index.php\/2022\/03\/30\/new-yorks-crunch-time-to-finally-fix-criminal-justice\/","title":{"rendered":"New York&#8217;s crunch time to finally fix criminal justice"},"content":{"rendered":"<p> [ad_1]<\/p>\n<div>\n<aside class=\"single__inline-module alignleft\">\n\t\t<\/aside>\n<p>It\u2019s crunch time for state budget negotiations, with all manner of nonsense obscuring the No. 1 issue: the urgent need for major fixes to the no-bail law and other botched <a target=\"_blank\" href=\"https:\/\/nypost.com\/2022\/03\/28\/no-cash-bail-law-a-bust-ny-voters-demand-changes-poll\/\" rel=\"noopener\">criminal-justice \u201creforms.\u201d<\/a> As we\u2019ve said before, a late budget \u2014 even weeks late \u2014 is better than one that doesn\u2019t do the job.<\/p>\n<p>If they don\u2019t do the right fixes <em>now<\/em>, after two previous tries, it\u2019ll take a voter revolution to force their hand.<\/p>\n<p>Even Gov. Kathy Hochul\u2019s 10-point criminal-justice plan may not do enough. As former Queens prosecutor <a target=\"_blank\" href=\"https:\/\/nypost.com\/2022\/03\/21\/hochuls-solutions-wont-do-much-for-bail-reform-pit-falls\/\" rel=\"noopener\">Jim Quinn noted for The Post<\/a>, it overfocuses on gun-related crimes, ignoring violent perps who use knives or other weapons.<\/p>\n<p>New York judges must get the power the other 49 states allow: to order jail for perps they deem dangerous or at high risk of reoffending, all the way down <a target=\"_blank\" href=\"https:\/\/nypost.com\/2022\/03\/24\/serial-shoplifter-with-178-busts-i-steal-for-a-living\/\" rel=\"noopener\">to serial shoplifters.<\/a> Unless a gun is involved, Hochul\u2019s \u201cfix\u201d doesn\u2019t allow jail pending trial for those charged with attempted murder, rape, robbery, burglary, first-, second- and third-degree assault, <a target=\"_blank\" href=\"https:\/\/nypost.com\/2022\/02\/19\/manhattan-da-alvin-bragg-lowers-charges-in-grand-larceny-case\/\" rel=\"noopener\">grand larceny,<\/a> stalking or drug sales, among hundreds of other offenses.<\/p>\n<p>Part of the problem, clearly, is that the gov doesn\u2019t want to offend lawmakers by saying they botched it big-time. Thus, she \u201cdefended\u201d her plan with a <a target=\"_blank\" href=\"https:\/\/webcache.googleusercontent.com\/search?q=cache:fJWZVtJT8U8J:https:\/\/www.nydailynews.com\/opinion\/ny-oped-bail-reform-hochul-benjamin-bail-reform-20220323-do5im3lfzrd2lfhfmlsbc6mpte-story.html+&amp;cd=1&amp;hl=en&amp;ct=clnk&amp;gl=us\" rel=\"noreferrer noopener\">Daily News column<\/a> that pretends it was purely the pandemic that caused the <a target=\"_blank\" href=\"https:\/\/nypost.com\/2022\/01\/23\/nyc-crime-wave-could-doom-progressives-pundits\/\" rel=\"noopener\">two-year crime wave.<\/a><\/p>\n<p>Bull: While progressive \u201canti-law-enforcement\u201d has pushed up crime all across the country, New York needs to focus on the mistakes that did the damage <em>here<\/em>.<\/p>\n<figure class=\"wp-block-image size-large\"><a target=\"_blank\" href=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/Kathy-Hochul-8.jpg\" rel=\"noopener\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/Kathy-Hochul-8.jpg?w=1024\" alt=\"New York Governor Kathy Hochul \" class=\"wp-image-21721930\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/Kathy-Hochul-8.jpg?quality=75&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/Kathy-Hochul-8.jpg?quality=75&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/Kathy-Hochul-8.jpg?quality=75&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><\/a><figcaption>Gov. Kathy Hochul\u2019s crime plan doesn\u2019t even address career criminals, serial assaulters and stabbing suspects.<\/figcaption><figcaption><span class=\"credit\">REUTERS\/Carlo Allegri<\/span><\/figcaption><\/figure>\n<p>Even her analysis (which we don\u2019t agree with) shows a 2% rise in perps arraigned and released on gun charges, only to be rearrested for another crime, from 2019 to 2021, and a 4% rise when the perp already had open felony charges. That translates to thousands of <a target=\"_blank\" href=\"https:\/\/nypost.com\/2022\/03\/21\/nyc-shootings-leave-almost-two-dozen-people-injured\/\" rel=\"noopener\">added crime victims<\/a> who didn\u2019t have to be hurt, killed or otherwise victimized \u2014 but for the no-bail law.<\/p>\n<p>Ironically, Hochul cites <a target=\"_blank\" href=\"https:\/\/nypost.com\/2021\/08\/07\/nearly-a-third-of-nyc-shootings-blamed-on-street-gangs-nypd-says\/\" rel=\"noopener\">increased gang violence<\/a> as a driver of the crime surge \u2014 while denying New York\u2019s \u201creforms\u201d have anything to do with it. In fact, for just one example: Gang leaders have <a target=\"_blank\" href=\"https:\/\/nypost.com\/2022\/02\/09\/eric-adams-urges-new-york-to-toughen-bail-laws-raise-the-age\/\" rel=\"noopener\">exploited Raise the Age<\/a> reform to recruit baby <em>gangstas<\/em> to carry guns and carry out crimes, because youths can almost never be tried in Criminal Court.<\/p>\n<p>But the Legislature\u2019s leaders don\u2019t want to admit their guilt. Yet even Lander\u2019s study shows that the number of times where city judges set bail fell from 24,657 in 2019 to 14,545 cases in 2021.<\/p>\n<aside class=\"single__inline-module alignright\">\n\t<\/aside>\n<p>\u201cReformers\u201d pretend those 10,000 \u201cextra\u201d releases were all innocents.
