Photo by Glenn Russell\/VTDigger<\/figcaption><\/figure>\n<\/div>\n<p class=\"has-drop-cap\">The Vermont National Guard last year investigated five allegations of sexual assault, including two of rape, involving its members, <a target=\"_blank\" href=\"https:\/\/legislature.vermont.gov\/Documents\/2022\/WorkGroups\/House%20General\/Military%20Affairs\/W~Gregory%20Knight~Vermont%20National%20Guard~FY21%20Legislative%20Report-%20Sexual%20Assault%20and%20Sexual%20Harassment%20in%20the%20Vermont%20National%20Guard~4-5-2022.pdf\" rel=\"noopener\">according to an annual report<\/a> discussed Tuesday in the House Committee on General, Housing and Military Affairs. Three of those incidents allegedly took place that year, while two occurred in previous years.\u00a0<\/p>\n<p>Lawmakers addressed the annual report, which has been required by law for nearly a decade, as they considered <a target=\"_blank\" href=\"https:\/\/legislature.vermont.gov\/bill\/status\/2022\/H.666\" rel=\"noopener\">H.666<\/a>. The bill would create a consultant position to assist lawmakers in overseeing the Guard\u2019s efforts to reduce sexual misconduct among its ranks.<\/p>\n<p>\u201cCommanders and leaders have created a climate where survivors of sexual assault are coming forward with confidence that their reports will be taken seriously, and knowledge that they will receive the support and care necessary,\u201d Adjutant General Greg Knight said in a memo to the Legislature.<\/p>\n<p>The Vermont National Guard <a target=\"_blank\" href=\"https:\/\/www.sevendaysvt.com\/vermont\/on-guard-how-one-soldiers-letter-changed-the-vermont-national-guard\/Content?oid=2296395\" rel=\"noopener\">has been required to submit a sexual misconduct report<\/a> to the Legislature each year since 2014, after allegations of assault and harassment prompted a leading candidate for adjutant general <a target=\"_blank\" href=\"https:\/\/www.sevendaysvt.com\/vermont\/how-anonymous-claims-ended-a-generals-bid-to-lead-the-vermont-guard\/Content?oid=2242750\" rel=\"noopener\">to withdraw from the race<\/a> in January 2013.\u00a0<\/p>\n<p><a target=\"_blank\" href=\"https:\/\/vtdigger.org\/2019\/06\/09\/knight-sets-improve-national-guard-culture\/?is_wppwa=true&amp;wpappninja_cache=friendly\" rel=\"noopener\">In January 2019<\/a>, Gov. Phil Scott asked the adjutant general to <a target=\"_blank\" href=\"https:\/\/vtdigger.org\/2019\/02\/18\/scott-requests-full-review-guard-policies\/?is_wppwa=true&amp;wpappninja_cache=friendly\" rel=\"noopener\">conduct a top-to-bottom review of the Guard\u2019s sexual assault policies and procedures<\/a> after VTDigger published <a target=\"_blank\" href=\"https:\/\/vtdigger.org\/award-entry-flying-fraternity\/?is_wppwa=true&amp;wpappninja_cache=friendly\" rel=\"noopener\">a seven-part series<\/a> in 2018 on misconduct in the Guard, including allegations of sexual assault, harassment and retaliation against a whistleblower.\u00a0<\/p>\n<p>Nikki Sorrell, the Guard\u2019s sexual assault prevention and response coordinator and the first civilian to author the report, outlined highlights for committee members during Tuesday\u2019s hearing. In federal fiscal year 2021 \u2014 which ran from October 2020 through September 2021 \u2014 Sorrell\u2019s office tracked five sexual assault reports, she said, including three that allegedly took place during that time period, one in 2019 and one in 2005.<\/p>\n<p>All of the accused perpetrators were Vermont National Guard members, she said. The survivors included four Guard members and one civilian.\u00a0<\/p>\n<p>Sorrell\u2019s office also began to track an additional federal case moving through military court that was reported by an active-duty overseas Guard member at the end of the fiscal year, she said. The accused person is also a Guard member. The survivor is home and is receiving support from Sorrell\u2019s office, she said.<\/p>\n<p>There were no reports of sexual harassment or reports related to discrimination based on sexual orientation during the year in question.<\/p>\n<p>The Guard\u2019s last annual report, pertaining to fiscal year 2020, documented three cases of sexual assault and two instances of sexual harassment between October 2019 and September 2020.<\/p>\n<p><a target=\"_blank\" href=\"https:\/\/vtdigger.org\/2021\/08\/08\/investigation-into-vermont-national-guard-documents-good-old-boy-culture\/\" rel=\"noopener\">Prior reports<\/a> of favoritism and members not feeling comfortable speaking out against problems led the Guard to create an anti-harassment policy in February 2021 and an equal employment policy in September 2021. A draft military equal opportunity policy is also being reviewed. All three policies exceed federal requirements and National Guard Bureau standards, according to the 2021 report.\u00a0<\/p>\n<p>A new \u201cReach Up\u201d function in the Guard mobile app now provides members an easy way to file complaints, even anonymously, the report noted.\u00a0<\/p>\n<p>Prior climate surveys also revealed a perception of unfairness related to position assignments and hiring practices, especially for women. But in his testimony before the House committee on Wednesday, Knight highlighted gender statistics in the report as \u201ca critical piece\u201d\u00a0 that showed some improvement in leadership assignments. He said it \u201creflects the direction of the National Guard.\u201d<\/p>\n<p>Knight told lawmakers that the Vermont Army National Guard was the first to open recruitment to women throughout the organization.\u00a0<\/p>\n<p>According to the demographics Knight presented, women comprise 21.2% of assigned personnel and hold 23% of leadership positions. Additionally, two women are currently in training as F-35 fighter pilot candidates \u2014 a first, he said.<\/p>\n<p>\u201cWhen I was elected to this position, one of my primary focuses was on improving equitable opportunity in our organization,\u201d Knight said. \u201cWe are correcting literally centuries of combat arms being exclusively male occupations.\u201d<\/p>\n<p>Committee members said they thought the report made \u201cincredible strides\u201d and said they would welcome suggestions for specific legislative actions that could support the Guard.<\/p>\n<div class=\"hideinamp\">\n<p style=\"font-family: Open Sans,sans-serif; margin:0; font-weight:700; padding: 10px 0;\">Stay on top of all of Vermont&#8217;s criminal justice news.
