{"id":30686,"date":"2022-04-12T23:14:57","date_gmt":"2022-04-12T23:14:57","guid":{"rendered":"https:\/\/cjstudents.com\/?p=30686"},"modified":"2022-04-12T23:14:57","modified_gmt":"2022-04-12T23:14:57","slug":"maryland-democrats-pass-police-reform-gun-crime-bills","status":"publish","type":"post","link":"https:\/\/cjstudents.com\/index.php\/2022\/04\/12\/maryland-democrats-pass-police-reform-gun-crime-bills\/","title":{"rendered":"Maryland Democrats pass police reform, gun crime bills"},"content":{"rendered":"<p> [ad_1]<\/p>\n<div>\n<div class=\"teaser-content grid-center\">\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">On the last day of its 90-day legislative session, the Maryland General Assembly waited until literally the last minute to revise last year\u2019s police reform legislation \u2014 and pass another bill designed to address escalating crime that left Republicans fuming.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">With one minute before midnight Monday, the House of Delegates voted 106-9 to approve a bill that, among other provisions, creates a trial board for state police agencies and prohibits collective bargaining from affecting the disciplinary process.<\/p>\n<\/div>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">The House removed a provision included in the Senate bill that would have delayed the creation of police accountability boards from July to October. Those boards, a key part of the package House Speaker Adrienne A. Jones (D-Baltimore County) had <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/local\/md-politics\/black-women-maryland-police-reform-\/2021\/04\/23\/2f90e7dc-9eef-11eb-8005-bffc3a39f6d3_story.html?itid=lk_inline_manual_5\" rel=\"noopener\">sponsored last year<\/a>, are intended to give residents a role in the review and investigation of police-misconduct allegations.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">The proposed delay \u201cwas not going to work for the speaker,\u201d House Judiciary Chairman Luke H. Clippinger (D-Baltimore City) said. \u201cWe feel that is pretty important.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">The revisions to the <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/local\/md-politics\/hogan-vetoes-police-accountibility\/2021\/04\/09\/c0ac4096-9967-11eb-962b-78c1d8228819_story.html?itid=lk_inline_manual_9\" rel=\"noopener\">2021 police accountability<\/a> law come as residents and criminal justice activists <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/dc-md-va\/2022\/02\/19\/montgomery-county-police-accountability-board-leobr\/?itid=lk_inline_manual_9\" rel=\"noopener\">encounter numerous obstacles<\/a> from local governments implementing the sweeping reforms.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p><span class=\"font--article-body font-copy hide-for-print ma-0 pb-md db italic interstitial\"><a target=\"_blank\" data-qa=\"interstitial-link\" href=\"https:\/\/www.washingtonpost.com\/dc-md-va\/2022\/04\/09\/maryland-lawmakers-override-hogan\/?itid=lk_interstitial_manual_10\" rel=\"noopener\">Overriding Hogan, lawmakers expand abortion access, create paid leave<\/a><\/span><\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Senate Judiciary Chairman William C. Smith Jr. (D-Montgomery) said counties\u2019 leaders have urged lawmakers to push back the boards\u2019 implementation date, and Joanna Silver, co-chair of the Silver Spring Justice Coalition, said she worries that some counties are rushing ahead of the July 1 deadline.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">But police departments in some Maryland counties have collective bargaining agreements that expire in June, Silver noted, and an extension could allow them time to sign a new agreement and not be required to adhere to the new law.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">\u201cWe want the boards to be up and running as soon as they can, and we do not want to have any of the unions moving to collective bargaining before the implementation date and therefore delay implementation, but at the same time we see jurisdictions around the state are using the implementation date to rush and limit community involvement in the process,\u201d said Silver, a practicing attorney.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">In addition to the policing provisions, the last-gasp bill creates a task force to study how state prosecutors handle cases and requires the Maryland State Commission on Criminal Sentencing Policy to collect and publish data about the sentences handed down in circuit courts across the state.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Some criminal justice activists had questioned whether the 2021 package went far enough to provide transparency and oversight of policing. Silver said she was very pleased to see the state expand the scope of the complaints that the administrative charging committee can consider.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">\u201cWe wanted to ensure that any misconduct that involves a police officer would be heard by the administrative charging committee regardless of where the complaint originated,\u201d she said.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p><span class=\"font--article-body font-copy hide-for-print ma-0 pb-md db italic interstitial\"><a target=\"_blank\" data-qa=\"interstitial-link\" href=\"https:\/\/www.washingtonpost.com\/dc-md-va\/2022\/04\/11\/maryland-legislature-session-ends\/?itid=lk_interstitial_manual_21\" rel=\"noopener\">In Democratic-controlled Maryland, liberal victories abound<\/a><\/span><\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Smith said the proposed delay was in part because<b> <\/b>the Maryland Police Training and Standards Commission has not promulgated the regulations, which is creating problems for counties trying to adhere to the law.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">\u201cWe were trying to tidy up and clarify some of the police reforms,\u201d Smith said. \u201cThings that were oversights.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Also late Monday, the legislature passed a separate measure that creates a mechanism for tracking statewide gun crime data. The bill, originally passed in the Senate, includes a pair of Republican priorities, classifying theft of a firearm as a felony and increasing penalties for using a gun during a drug deal. The House stripped the bill of the tougher penalties and kept the provisions to track the gun crime data and to include what is known as an interlocutory appeal, a legal maneuver that helps in prosecuting gun cases.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Republicans objected to the removal of what they called the strongest provisions to address violent crime. Sen. Michael J. Hough (R-Frederick) called it \u201coutrageous.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">The Senate did not pass <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/dc-md-va\/2022\/03\/24\/hogan-crime-baltimore-funding\/?itid=lk_inline_manual_28\" rel=\"noopener\">Gov. Larry Hogan\u2019s (R) crime package<\/a>, which included increased penalties for repeat violent offenders. Hough called it ironic that the House had passed an earlier bill that imposes new security restrictions on gun dealers but \u201cdidn\u2019t find it important to punish the people who actually steal the firearms.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Smith said Hogan and the Democratic-controlled legislature had \u201cfundamental differences\u201d on how to address crime.
