Here's what we know.\"\/>\n<p class=\"gnt_ar_b_p\">Judge Ketanji Brown Jackson&#8217;s confirmation proceedings elevated a debate about <a target=\"_blank\" href=\"\/story\/opinion\/columnist\/2022\/04\/03\/ketanji-brown-jackson-child-porn-cases\/7168185001\/\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\" class=\"gnt_ar_b_a\">the nuances of federal sentencing policy<\/a> to a rare level of public visibility. But missing from that discussion is recognition of the overwhelming recognition among lawmakers that federal mandatory sentences are often too long, incarcerate people with no or little criminal history\u00a0and have a disproportionate impact on communities of color.\u00a0\u00a0\u00a0<\/p>\n<p class=\"gnt_ar_b_p\">There are multiple pieces of sentencing reform legislation with broad, bipartisan support pending in the Senate that would build on the legacies of both Presidents Donald Trump and Barack Obama \u2013 and would give thousands of incarcerated people a second chance at freedom. Majority Leader Chuck Schumer and Minority Leader Mitch McConnell should work together to pass the bills on the Senate floor.\u00a0<\/p>\n<p class=\"gnt_ar_b_p\">Legislators must not\u00a0squander this opportunity. Take it from us\u00a0\u2013\u00a0two people with vastly different experiences with our criminal justice system. One of us is a formerly incarcerated person who was sentenced to life without parole and served 33 years in federal prison. The other was a prison guard in college and became the general counsel of <a target=\"_blank\" href=\"https:\/\/www.kochind.com\/\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\" class=\"gnt_ar_b_a\">Koch Industries<\/a>.\u00a0<\/p>\n<p class=\"gnt_ar_b_p\"><strong class=\"gnt_ar_b_al\">My poor decisions landed me in prison.\u00a0<\/strong><a target=\"_blank\" href=\"\/story\/opinion\/policing\/2022\/04\/25\/my-second-chance-prison\/7232987001\/\" rel=\"noopener\" data-t-l=\":b|e|spike click:4|${u}\" class=\"gnt_ar_b_a\">Now I&#8217;m making the most of my second chance.<\/a><\/p>\n<figure class=\"gnt_em gnt_em_img\"><img class=\"gnt_em_img_i\" style=\"height:413px\" data-g-r=\"lazy\" src=\"https:\/\/www.gannett-cdn.com\/presto\/2022\/04\/28\/USAT\/99873eb8-d8b1-467f-b59a-c935f072e4b7-Mark_Holden_and_Bill_Underwood.jpg?width=660&amp;height=413&amp;fit=crop&amp;format=pjpg&amp;auto=webp\" srcset=\"https:\/\/www.gannett-cdn.com\/presto\/2022\/04\/28\/USAT\/99873eb8-d8b1-467f-b59a-c935f072e4b7-Mark_Holden_and_Bill_Underwood.jpg?width=1320&amp;height=826&amp;fit=crop&amp;format=pjpg&amp;auto=webp 2x\" decoding=\"async\" alt=\"Mark Holden, left, is chairman of the board of the Americans for Prosperity Foundation\u00a0and Americans for Prosperity. Bill Underwood, right, is a senior fellow at The Sentencing Project for the Campaign to End Life Imprisonment and previously served 33 years in federal prison.\"\/><\/figure>\n<p class=\"gnt_ar_b_p\">Despite our differences, we both wholeheartedly believe America&#8217;s sentencing policies are far too extreme, leave little hope for redemption\u00a0and exacerbate problems with crime in our neighborhoods. They must be changed. Let\u2019s build on the reforms that have shown to be effective in red states, blue states\u00a0and at the federal level.<\/p>\n<h2 class=\"gnt_ar_b_h2\">An over-incarceration problem\u00a0<\/h2>\n<p class=\"gnt_ar_b_p\">It\u2019s important to understand just how harsh the U.S. criminal legal system is. Our courts dole out some of the longest punishments in the entire world. More than\u00a0<a target=\"_blank\" href=\"https:\/\/www.sentencingproject.org\/publications\/no-end-in-sight-americas-enduring-reliance-on-life-imprisonment\/\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\" class=\"gnt_ar_b_a\">200,000 people<\/a> in the United States\u00a0are serving life sentences and have virtually no hope of getting out. And between <a target=\"_blank\" href=\"https:\/\/bjs.ojp.gov\/content\/pub\/pdf\/Fccp93.pdf\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\" class=\"gnt_ar_b_a\">1986<\/a> and <a target=\"_blank\" href=\"https:\/\/bjs.ojp.gov\/content\/pub\/pdf\/fjs16st.pdf\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\" class=\"gnt_ar_b_a\">2016<\/a>, the average time spent incarcerated for a federal drug offense more than tripled.<\/p>\n<aside aria-label=\"advertisement\" class=\"gnt_m gnt_x gnt_x__lbl gnt_x__al\"\/>\n<p class=\"gnt_ar_b_p\">Largely due to these extreme sentences, there are more than 156,000 people in federal prisons today \u2013 representing <a target=\"_blank\" href=\"https:\/\/www.bop.gov\/about\/statistics\/population_statistics.jsp\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\" class=\"gnt_ar_b_a\">a 535% increase<\/a>\u00a0since\u00a01980.<\/p>\n<p class=\"gnt_ar_b_p\"><strong class=\"gnt_ar_b_al\">Execution rightly halted:<\/strong><a target=\"_blank\" href=\"\/story\/opinion\/columnist\/2022\/04\/22\/melissa-lucio-execution-texas-innocence\/7381221001\/\" rel=\"noopener\" data-t-l=\":b|e|spike click:11|${u}\" class=\"gnt_ar_b_a\">The Texas courts have spared Melissa Lucio\u2019s life. Now she can prove her innocence.<\/a><\/p>\n<p class=\"gnt_ar_b_p\">Despite our propensity to use long prison sentences, <a target=\"_blank\" href=\"https:\/\/www.jstor.org\/stable\/10.1086\/670398?seq=1\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\" class=\"gnt_ar_b_a\">rigorous<\/a> <a target=\"_blank\" href=\"https:\/\/www.journals.uchicago.edu\/doi\/10.1086\/715100\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\" class=\"gnt_ar_b_a\">research<\/a> shows they have no significant effect on public safety. Long sentences also don\u2019t significantly deter people from committing crimes.<\/p>\n<aside aria-label=\"advertisement\" class=\"gnt_m gnt_x gnt_x__lbl gnt_x__al\"\/>\n<p class=\"gnt_ar_b_p\">It&#8217;s <a target=\"_blank\" href=\"https:\/\/www.pbs.org\/newshour\/economy\/the-u-s-spends-billions-to-lock-people-up-but-very-little-to-help-them-once-theyre-released\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\" class=\"gnt_ar_b_a\">incredibly costly<\/a> to keep people behind bars when they pose little to no threat to public safety. This diverts precious dollars from investments that could actually prevent crime or enable law enforcement to solve more cases.\u00a0<\/p>\n<h2 class=\"gnt_ar_b_h2\">Hope for bipartisan solutions\u00a0<\/h2>\n<p class=\"gnt_ar_b_p\">Fortunately, there are several pieces of legislation with diverse support moving through the Senate that would help curb extreme sentences. All of them build on <a target=\"_blank\" href=\"https:\/\/www.brennancenter.org\/our-work\/research-reports\/what-first-step-act-and-whats-happening-it\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\" class=\"gnt_ar_b_a\">the First Step Act<\/a>, <a target=\"_blank\" href=\"\/story\/news\/politics\/2018\/12\/21\/donald-trump-signs-rare-bipartisan-achievement-criminal-justice\/2388653002\/\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\" class=\"gnt_ar_b_a\">a historic law Trump signed<\/a>\u00a0in December 2018.<\/p>\n<aside class=\"gnt_em gnt_em_anc\" id=\"gnt_atomsnc\" data-g-r=\"lazy\" data-gl-method=\"loadAnc\" aria-label=\"Newsletter signup form\"\/>\n<p class=\"gnt_ar_b_p\">The law reduced sentences for certain drug crimes and expanded compassionate release for those who pose little to no risk to public safety. So far, this legislation has allowed <a target=\"_blank\" href=\"https:\/\/www.bop.gov\/inmates\/fsa\/\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\" class=\"gnt_ar_b_a\">more than 8,000 people in prison<\/a> to come home early.<\/p>\n<p class=\"gnt_ar_b_p\"><strong>Opinions in your inbox<\/strong>: <a target=\"_blank\" href=\"https:\/\/t.co\/b5Eu1GKNOY?amp=1\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\" class=\"gnt_ar_b_a\">Get a digest of our takes on current events every day<\/a><\/p>\n<p class=\"gnt_ar_b_p\">If not for this law, one of us would likely never have come home at all.\u00a0<\/p>\n<p class=\"gnt_ar_b_p\">A new bill,\u00a0the <a target=\"_blank\" href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/3510?s=1&amp;r=3#:~:text=Introduced%20in%20House%20(05%2F25%2F2021)&amp;text=This%20bill%20makes%20various%20changes,employment%2Drelated%20background%20check%20records.\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\" class=\"gnt_ar_b_a\">First Step Implementation Act<\/a><strong>,<\/strong>\u00a0would ensure fairness by applying the sentencing reductions enacted in 2018 to people incarcerated under the old sentencing regime.\u00a0People who would have received a shorter sentence if they were found guilty today would now be able to petition a federal judge for a sentence review that would incorporate input from prosecutors, federal public defenders\u00a0and victims. The legislation would also allow courts to consider sentence reductions for people who committed crimes under the age of 18 and have served at least 20 years behind bars.\u00a0<\/p>\n<p class=\"gnt_ar_b_p\"><strong class=\"gnt_ar_b_al\">So many questions:<\/strong><a target=\"_blank\" href=\"\/story\/opinion\/columnist\/2022\/04\/28\/what-if-elon-musk-had-spent-44-billion-charity-instead-twitter\/9539798002\/\" rel=\"noopener\" data-t-l=\":b|e|spike click:22|${u}\" class=\"gnt_ar_b_a\">Elon Musk could help change the fabric of American society. Instead he bought Twitter.<\/a><\/p>\n<p class=\"gnt_ar_b_p\">Another bill in the package,\u00a0the <a target=\"_blank\" href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/312\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\" class=\"gnt_ar_b_a\">COVID-19 Safer Detention Act<\/a>,\u00a0would ensure that elderly and vulnerable incarcerated people could be released from prison or placed in home confinement where they can be with their families and receive better health care treatment. That\u2019s crucial, especially as experts predict COVID <a target=\"_blank\" href=\"https:\/\/www.sciencedaily.com\/releases\/2022\/04\/220428085820.htm\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\" class=\"gnt_ar_b_a\">will not be the last pandemic we face<\/a> as a country. The bill is not an automatic release from prison either. Judges would have to consider many factors, including the seriousness of the offense before anyone could go back to their community.<\/p>\n<aside aria-label=\"advertisement\" class=\"gnt_m gnt_x gnt_x__lbl gnt_x__al\"\/>\n<p class=\"gnt_ar_b_p\">Finally, the <a target=\"_blank\" href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/1693\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\" class=\"gnt_ar_b_a\">EQUAL Act<\/a> would end the infamous disparity between sentences for crack and powder cocaine offenses and has already passed the House with <a target=\"_blank\" href=\"https:\/\/clerk.house.gov\/Votes\/2021297\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\" class=\"gnt_ar_b_a\">an overwhelming bipartisan vote<\/a>\u00a0\u00a0<\/p>\n<p class=\"gnt_ar_b_p\">These bills have broad support. There are many bipartisan ways to make our criminal justice system more humane, without risking public safety.
