Wade was leaked to the press.\u00a0<\/p>\n<p>A draft of the decision for Dobbs v. Jackson Women\u2019s Health Organization was leaked to Politico and published by the news outlet on Monday, prompting anger from the GOP at the shattering of longtime Supreme Court confidentiality norms. \u00a0<\/p>\n<p>\u201cYesterday\u2019s unprecedented leak is an attempt to severely damage the Supreme Court. This clearly coordinated campaign to intimidate and obstruct the Justices of the United States Supreme Court, and its independence in our political system, from upholding the Constitution must be immediately investigated by the court,\u201d House Minority Leader Kevin McCarthy (R-Calif.), House Minority Whip Steve Scalise (R-La.), and House Republican Conference Chair Elise Stefanik (R-N.Y.) said in a joint statement on Tuesday.\u00a0<\/p>\n<p>\u201cLast night\u2019s stunning breach was an attack on the independence of the Supreme Court. By every indication, this was yet another escalation in the radical left\u2019s ongoing campaign to bully and intimidate federal judges and substitute mob rule for the rule of law,\u201d Senate Minority Leader Mitch McConnell (R-Ky.) said in another statement.\u00a0<\/p>\n<p>\u201cThis lawless action should be investigated and punished as fully as possible. The Chief Justice must get to the bottom of it and the Department of Justice must pursue criminal charges if applicable,\u201d McConnell said.\u00a0<\/p>\n<p>The secretive Supreme Court was once described as the last \u201cleak-proof\u201d institution in Washington.\u00a0\u00a0<\/p>\n<p><a target=\"_blank\" href=\"https:\/\/www.cnn.com\/2020\/07\/27\/politics\/john-roberts-supreme-court-liberals-daca-second-amendment\/index.html\" rel=\"noreferrer noopener\">Details<\/a>\u00a0of internal deliberations had started to leak into the press in recent years, but until\u00a0<a target=\"_blank\" href=\"https:\/\/www.politico.com\/news\/2022\/05\/02\/supreme-court-abortion-draft-opinion-00029473\" rel=\"noreferrer noopener\">Politico published the draft Dobbs majority decision<\/a>\u00a0Monday night, no draft opinion in the court\u2019s modern history had been leaked to the public ahead of publication.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr1_ab\">\n<\/aside>\n<p>According to the report, five conservative justices are part of the majority opinion, with Chief Justice John Roberts\u2019 position to be determined. Justices may still switch positions, and the final decision could look different than the draft.\u00a0\u00a0<\/p>\n<p>If the decision holds, there would no longer be a constitutional protection to the right to abortion, leaving regulation to Congress and the states. More than a dozen states have \u201ctrigger\u201d laws that would automatically ban abortion if Roe is overturned.\u00a0<\/p>\n<p>Sen. Mitt Romney (R-Utah) also called for an investigation into the \u201cbreach of the Court\u2019s deliberative process,\u201d and for those responsible to be \u201cpunished.\u201d\u00a0<\/p>\n<p>\u201cThis unprecedented leak must be investigated. If this was an attempt to intimidate the justices, the individual responsible must be punished to the full extent,\u201d\u00a0<a target=\"_blank\" href=\"https:\/\/twitter.com\/RepJimBanks\/status\/1521293174869839872?s=20&amp;t=Rl48MvAfjG6hiBSYxuQ7WA\" rel=\"noreferrer noopener\">tweeted<\/a>\u00a0Rep. Jim Banks (R-Ind.), chairman of the conservative Republican Study Committee.\u00a0<\/p>\n<p>House GOP leadership left the burden of investigating the leak to the court and McConnell called for a Department of Justice investigation. It is unclear if some Republicans would support a Congressional probe into the leak.\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr2_ab\">\n<\/aside>\n<p>CBS\u00a0<a target=\"_blank\" href=\"https:\/\/www.cbsnews.com\/news\/roe-v-wade-supreme-court-overturn-politico-draft-opinion\/\" rel=\"noreferrer noopener\">reported<\/a>\u00a0Monday night that a full-scale investigation involving the FBI is expected to try to determine the source of the leak.\u00a0<\/p>\n<p>Arizona Republican Senate candidate Blake Masters went as far as to\u00a0<a target=\"_blank\" href=\"https:\/\/twitter.com\/bgmasters\/status\/1521314873296052224?s=20&amp;t=0A-4z0yUj0aed0TjcJ_6QA\" rel=\"noreferrer noopener\">assert<\/a>\u00a0that \u201cthe SCOTUS draft leaker probably committed a federal crime.\u201d Legal experts, though, say that there is not a clear basis for criminality.\u00a0<\/p>\n<p>Prominent Washington attorney Mark Zaid, who represented the whistleblower at the center of former President Donald Trump\u2019s first impeachment trial, told The Hill that it is \u201chighly doubtful\u201d that the leak of the draft opinion was criminal.\u00a0<\/p>\n<p>\u201cIt certainly is a fireable offense, but the only thing that even remotely would criminalize this leak is 18 U.S.C. 641,\u201d added attorney Bradley Moss, who works at Zaid\u2019s firm, referencing a statute about embezzlement and stealing. \u201cThat provision is unlikely to be applied in this context in my view.\u201d\u00a0<\/p>\n<aside class=\"ad-unit ad-unit--mr3_ab\">\n<\/aside>\n<p>Jonathan Turley, a contributor to The Hill and a law professor at George Washington University who testified against impeaching Trump in his first trial, said on Fox News Tuesday that while the leak was \u201cdeeply unethical,\u201d it is \u201cnot generally viewed as a crime.\u201d \u00a0<\/p>\n<p>But he warned that if the leaker lies to FBI agents, this would constitute as a criminal offense. \u00a0<\/p>\n<p>Andrew C. Wade\t<\/a><br \/>\n\t<\/aside>\n<p>More likely is that the leaker, if found, could face professional consequences. Sen. Josh Hawley (R-Mo.)\u00a0<a target=\"_blank\" href=\"https:\/\/twitter.com\/HawleyMO\/status\/1521469912069423106\" rel=\"noreferrer noopener\">called<\/a>\u00a0for the leaker to be disbarred.\u00a0\u00a0<\/p>\n<p>\u201cThe open thread here is, what does accountability look like for the leaker? This is likely a lawyer who took an oath. And that oath has been broken,\u201d said Jessica Anderson, executive director of Heritage Action.\u00a0<\/p>\n<p>Sen.
