Critics, however, say more police surveillance further erodes civil rights and is a step in the wrong direction for police-community relations.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"NWRTQ6YDBFDLZOGJGWHGLURGIY\">State and local governments throughout the United States received $350 billion through the American Rescue Plan Act, often abbreviated ARPA, to recover from the fiscal impacts of the COVID-19 pandemic. Much of that money has been used on relatively non-controversial projects, such as improving sewer systems or removing lead pipes, but other expenses have drawn controversy.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ZRY7XBQI25CEJC7TPJGELPLMKI\">In Northeast Ohio alone, Cleveland, Akron, North Olmsted and Canton have moved to increase police surveillance using ARPA money, reigniting the modern world\u2019s perennial debate over balancing civil rights and public safety &#8212; and whether the advanced technology that promises to protect us is as effective as advertised.<\/p>\n<h3 class=\"article-heading\">Who is doing it?<\/h3>\n<p class=\"article__paragraph article__paragraph--left\" id=\"XFTNNWTOGNDZLNXXSLOEL2DJZI\">The city of Cleveland approved spending roughly <a target=\"_blank\" href=\"https:\/\/www.news5cleveland.com\/news\/local-news\/cleveland-metro\/cameras-cars-and-riot-gear-a-look-at-the-proposed-arpa-allocations-for-clevelands-public-safety-forces\" rel=\"noopener\">$4.5 million upgrading its surveillance network<\/a> in late November 2021.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"QQ3RHARTBNGCVP3HG3FGEIYAYE\">The cameras, part of the city\u2019s Safe Smart CLE initiative, will be placed in \u201crecreation centers, parks, neighborhoods, business districts, waterways, bridges and major thoroughfares,\u201d <a target=\"_blank\" href=\"https:\/\/www.clevelandohio.gov\/sites\/default\/files\/rfp-rfq\/SafeSmartCLECitywideVideoSurveillanceRFP.pdf\" rel=\"noopener\">according to the project\u2019s request for proposals<\/a>.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"UMNSYYU7ZFHRJDYSGHRT4AR6MQ\">The document later asks potential vendors for their plans to place cameras in \u201chot spots.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"VAI7V3D6TBA4ROHYRA57U4H62A\">The proposal calls for surveillance cameras that can record in 1080p and that have an optical zoom of 32x. For comparison, <a target=\"_blank\" href=\"https:\/\/www.cnet.com\/tech\/mobile\/iphone-gets-3x-optical-zoom-for-the-first-time\/\" rel=\"noopener\">an iPhone 13 has an optical zoom of 3x<\/a>, according to cnet.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"WKRW7GJJHRGPDNBBSNL3UALFYU\">Cleveland City Council unanimously approved the ARPA allocations, which also included funding for affordable housing, police vehicles, upgrading fire stations and additional EMS equipment.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"R3YF5Q5QXRDHDBZ6FQL6HHGW24\">The City of Akron is considering a two-pronged surveillance plan that would add police cameras on streets and busy areas and provide personal doorbell cameras for people and businesses using ARPA money.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"X4D5RJNL5NDC3NWVIBH4CKHEVA\">While the cameras are ARPA-funded, city officials have been working for over a year on a way to pay for more surveillance cameras for law enforcement, Akron Mayor Daniel Horrigan told <a target=\"_blank\" href=\"http:\/\/cleveland.com\/\" rel=\"noopener\">cleveland.com<\/a>.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"EP5QGWJWU5DMXFFZKD65DIGJ6M\">An earlier version of the plan, which is being aided by consultant group Guidehouse, called for 50 police surveillance cameras and between 3,000 and 5,000 personal doorbell cameras, similar to the <a target=\"_blank\" href=\"https:\/\/ring.com\/about\" rel=\"noopener\">Ring doorbell,<\/a> to help police solve crimes in \u201chigh crime neighborhoods.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"Y6G4CTRPYVBJPCT2F26D6PXSDA\">But Horrigan said in an interview the cameras should be placed throughout Akron.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"Q6G5MZ2VAFENFEM4PBOTVUSBHE\">\u201cI\u2019m of the notion that we should deploy them all over the city. Crime doesn\u2019t know one area,\u201d Horrigan said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"4Q7S5O2KLVHY7OMYSW75UWJUEQ\">Initially, the city plans to install 310 doorbell-type cameras and 130 license plate readers, Akron spokeswoman Stephanie Marsh said in an email.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"LJC6VG7L4BBJVPCZPJTHLGDG7Q\">In an interview, Horrigan said the city is still figuring out the logistics of the doorbell cameras, including how many to buy and whether the city or the recipients will own the cameras.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"2OQ2FDAP3JAMNA5XREC6SK7DVE\">Doorbell cameras, such as Ring, allow the owner of the camera to view a live feed. While the decision is not final, Horrigan is leaning toward the city not owning the cameras it distributes to residents.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"BLKLD6FLINBF7DORY3ZLOCTKCI\">\u201cI don\u2019t think the city needs to own those. I think it\u2019s something we can provide to homeowners or businesses in and around the city, not necessarily just in high crime areas,\u201d Horrigan said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"2XC55CHTKFEI3LA65DUWMXATVA\">Asked if police could theoretically watch live feeds of city-owned cameras on private property, Horrigan said he didn\u2019t support that. Plus, the police department doesn\u2019t have enough people to spend watching hundreds or thousands of doorbell cameras, Horrigan said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"TRNDLZXCUJAQDC63CYMPUN62NY\">\u201cTo me I don\u2019t think that\u2019s our role. We\u2019re still working through it, but I don\u2019t think that\u2019s our role for us to give (cameras) to people and for us to watch them,\u201d Horrigan said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"6JNO6YOVU5FVNICZY7ZIW2ID3Q\">Horrigan said he thinks the city strikes \u201ca pretty good balance\u201d between protecting civil rights and ensuring public safety. He also said the data captured from the surveillance cameras will not be sold but used only for law enforcement purposes.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"MXE5CLJYWZANNDED2WUSJF2LQM\">The City of Canton approved in February spending $315,835 for company Wi-Fiber to install 26 cameras and four license plate readers in the northeast, northwest and southeast parts of town, according to city documents.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"S6TGBQCPONFL7DBXWIS6BH3VBA\">North Olmsted isn\u2019t planning to use ARPA money to add more cameras, but it is planning to spend $15,000 on an adjacent project. North Olmsted, like many cities, already has a program in place that lets home or business owners voluntarily tell police where their private surveillance cameras are located, so police can ask residents for access to the footage if they believe a crime has occurred, said Jennifer Scofield, North Olmsted\u2019s safety director.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"XF7GEYWF5VFGDGUKUOWXFDTFJM\">Scofield said the city allocated $15,000 in ARPA money to develop a mapping software for the registered cameras, so police can more quickly see which cameras are in the area of a suspected crime.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"GJZDDVFTVRB3JMQ64GDZDCW4AA\">There are limits to the program, Scofield said. Police cannot watch a live feed from private surveillance cameras without the owner\u2019s consent. If someone registered for the program wants to opt-out, they can do so at any time, Scofield said.<\/p>\n<h3 class=\"article-heading\">Do cameras make cities safer?<\/h3>\n<p class=\"article__paragraph article__paragraph--left\" id=\"4QTAOC2A6ZHI5GTPORBK6TGEAA\">Beyond the price of the cameras, themselves, and the risk to civil rights if the program is abused, the social benefits of surveillance cameras are harder to measure.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"MMBYSPZRXZCYHLCX635JLMEHSU\"><a target=\"_blank\" href=\"https:\/\/www.mtas.tennessee.edu\/knowledgebase\/there-empirical-evidence-surveillance-cameras-reduce-crime\" rel=\"noopener\">Whether or not cameras deter crime<\/a> is a tricky question with unclear answers, according to the University of Tennessee\u2019s Municipal Technical Advisory Service, which examined multiple studies on the topic in 2016.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"6QBS54Q5TNFVFFRYYR2IDUV3MM\">Some research has shown surveillance cameras, when combined with other crime deterrents such as lighting, can reduce property crime. On the other hand, a 2008 paper from the American Civil Liberties Union argued, \u201cvideo surveillance has no statistically significant effect on crime rates.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ZTBGR6LH2RBS5NVJ7JR3HJ7YSA\">Gary Daniels, ACLU Ohio\u2019s chief lobbyist, said it remains true that increased police surveillance does not have a statistically significant impact on violent crime rates, despite the ubiquity of surveillance systems and rapidly improving surveillance technology.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"73ROT6GQXJGAFGOV4XFKKGEX4Y\">If adding public surveillance cameras were a deterrent to violent crimes and most property crime, one would expect to see a massive drop in crime, Daniels said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"RE7HIYJ2MNHPNEZ5BW3G5AG6QA\">\u201cWe\u2019ve got a long enough history of surveillance in this country. We can say \u2018what has this helped?\u2019\u201d Daniels said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ICUBHWJR3FGUXMGTTHQRFPQJ7I\">The causes of crime rates are complicated, and proponents of police surveillance say the real question is whether these cameras help solve crimes. While it\u2019s common to see anecdotal evidence of a key photo or video cracking a case, researchers are divided on whether that\u2019s the norm.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"HE3MEJWG55ENRE75EQDH6552BA\">When it comes to doorbell cameras, <a target=\"_blank\" href=\"https:\/\/www.nbcnews.com\/news\/all\/cute-videos-little-evidence-police-say-amazon-ring-isn-t-n1136026\" rel=\"noopener\">an NBC News investigation<\/a> found that in many areas where police had widely deployed them, doorbell camera footage hadn\u2019t led to a single arrest \u2013 despite Ring\u2019s promises that its technology would make neighborhoods safer by deterring and helping to solve crime. Other police departments were unsure if doorbell cameras ever led to an arrest, according to the report.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"YK4M4RFCGVDMNEHKLK74WVN2NU\">As for city surveillance cameras, a <a target=\"_blank\" href=\"https:\/\/www.urban.org\/research\/publication\/public-surveillance-cameras-and-crime\" rel=\"noopener\">2020 Urban Institute study<\/a> found increased crime clearance rates in areas of Milwaukee with surveillance cameras.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"IYSXRJ4GVZCIFPQCKPQVJG4FHQ\">However, with thousands of cameras installed throughout any city, a percentage of them are bound to be broken or malfunctioning. For example, although the city of Cleveland has a $225,000 maintenance contract for the city\u2019s 1,500-plus cameras, about <a target=\"_blank\" href=\"https:\/\/www.youtube.com\/watch?v=cj_yryoz0jw\" rel=\"noopener\">3% of them \u201cdo not work,\u201d<\/a> Cleveland Director of Public Safety Karrie Howard said at a City Council Safety Committee hearing in April.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"QMSQUOZGKVFWNPA2FRGE2E43OM\">What\u2019s more, many areas in Cleveland, particularly where council members had formally requested surveillance cameras, lack the necessary infrastructure to install them, said City Councilman Michael Polensek, who chairs the committee.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"3O4RKCEG3FHFPE3GPTTBXUTWBQ\">Daniels said police surveillance cameras \u2013 at least historically &#8212; haven\u2019t statistically proven very effective in solving crimes, largely because the surveillance cameras on the street often don\u2019t take videos that are high enough quality to use as evidence.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"S2HPAICJD5BKLMFGSHXDBCRZQQ\">However, as technology continues its march forward, that may change.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"RX6EBTOETBB3NKX5XUO5AV43LU\">\u201cThe technology is always going to get better. The technology is always going to get more invasive,\u201d Daniels said.<\/p>\n<h3 class=\"article-heading\">Facial recognition<\/h3>\n<p class=\"article__paragraph article__paragraph--left\" id=\"KVCLTL4A4RB6ZHSA7YRK7CPGTE\">A comprehensive network of surveillance cameras also raises the possibility of widespread use of facial recognition software \u2013 which is capable of mapping, analyzing and then identifying a face in a photo or video. At the April meeting, Cleveland safety officials said the city\u2019s surveillance cameras could be programmed to use facial recognition software, but they refused to say whether the city is already using it.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"4E3Q3B3PTRADDA5D4H6P27OOJU\">Howard asked the city councilman to talk privately about the possibility of facial recognition software, to which Polensek agreed.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"JZYOLGEFSFFL5OPJ7EVXUQKJ4Y\"><a target=\"_blank\" href=\"http:\/\/cleveland.com\/\" rel=\"noopener\">Cleveland.com<\/a> has reached out to the Cleveland Division of Police on the topic.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"JSLHELGN2FEGPOM4FHD5EKFYXA\">But Daniels said that kind of closed-door discussion on such a controversial use of technology is typical.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"BZ2GRCBQ2JE55PCDC3QJLSAWVI\">\u201cSo much of it happens behind the scenes, and we\u2019re just asked to trust the police and government to do what they\u2019re telling us they\u2019re doing, when their track record isn\u2019t so good,\u201d Daniels said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"KR2RBCLPB5FQ3HZJHI2MSCZ4RA\">Facial recognition also has a history of triggering more false positives for people with dark skin, according to Daniels and research compiled by <a target=\"_blank\" href=\"https:\/\/sitn.hms.harvard.edu\/flash\/2020\/racial-discrimination-in-face-recognition-technology\/\" rel=\"noopener\">Harvard University<\/a>.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ME32RJTKANFZHFO6UBAYSN7PKM\">Considering the existing, racial disparities in the U.S. criminal justice system, \u201cfacial recognition doubles down on that,\u201d Daniels said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"QIJVID22J5DENESPUIHG5R24AY\">Critics of the technology warn that increasing surveillance could lead to a situation such as in China, where <a target=\"_blank\" href=\"https:\/\/www.reuters.com\/world\/china\/china-uses-ai-software-improve-its-surveillance-capabilities-2022-04-08\/\" rel=\"noopener\">government surveillance and facial recognition<\/a> is employed on a mass scale and <a target=\"_blank\" href=\"https:\/\/theintercept.com\/2021\/01\/29\/china-uyghur-muslim-surveillance-police\/\" rel=\"noopener\">used against minority groups<\/a>.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ZPALHCDAGJA65BEFVEHLKS3JAY\">However, America\u2019s own use of facial recognition raises concerns among civil liberties advocates and the appropriateness of using such powerful tools for solving routine crimes. In one case, police in Oregon used surveillance cameras to <a target=\"_blank\" href=\"https:\/\/www.cnet.com\/news\/privacy\/facial-recognition-overkill-how-deputies-solved-a-12-shoplifting-case\/\" rel=\"noopener\">prosecute a $12 shoplifing case<\/a>, according to cnet.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"2VR3BWLXRVGIHGRTEFXSCYHX6Q\">More locally, <a target=\"_blank\" href=\"https:\/\/www.cleveland.com\/open\/2020\/02\/ohios-controverisal-facial-recognition-database-to-get-214-million-update-ag-dave-yost-says.html\" rel=\"noopener\">Ohio has had its own facial recognition database for nearly a decade,<\/a> comprised largely of driver\u2019s license photos, that state and federal law enforcement have used to prosecute crimes, <a target=\"_blank\" href=\"http:\/\/cleveland.com\/\" rel=\"noopener\">cleveland.com<\/a> reported.<\/p>\n<h3 class=\"article-heading\">Civil rights concerns<\/h3>\n<p class=\"article__paragraph article__paragraph--left\" id=\"6EXWFKWKSBDLJAYHQGEXUSI7PQ\">While police and some city officials have cheered the addition of more surveillance cameras, the issue is far from clear-cut.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"NUEWJYEH7REJFLTQT2XZGIQ2TU\">Gordon Friedman, <a target=\"_blank\" href=\"https:\/\/www.fggfirm.com\/gordon-friedman\" rel=\"noopener\">a Cleveland defense attorney<\/a> who serves on <a target=\"_blank\" href=\"https:\/\/www.cleveland.com\/court-justice\/2016\/11\/lawyer_social_worker_police_se.html\" rel=\"noopener\">Cleveland\u2019s Community Police Commission<\/a>, questioned why ARPA funds were being used at all on police surveillance and said there needs to be strict rules governing how law enforcement uses surveillance.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"DBITV37CAFE6FEOYIWUCBWWIRY\">\u201cIt\u2019s a very useful crime detection tool, but to what extent do we give up our civil rights?\u201d Friedman said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"22X3Y37HHVE6RFJ3BQKMXCJEJA\">The use of surveillance cameras, particularly in areas police deem to be \u201chigh crime,\u201d also raises the question of whether predominantly minority neighborhoods will be more heavily surveilled.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"I2XEAL3KMNBPTK7K6DACEOG4II\">On one hand, <a target=\"_blank\" href=\"https:\/\/bjs.ojp.gov\/library\/publications\/black-victims-violent-crime\" rel=\"noopener\">minority communities &#8212; particularly Black males &#8212; are more likely to be the victims of crime,<\/a> according to studies from the Bureau of Justice Statistics and the Prison Policy Initiative.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"4Z4RYCC7PFCEZLF3IBJODJ4DRA\">However, these same communities are less likely to trust police.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"5L6LDQSQVRHY5MU5Q6GXCEULSE\">The fear that an American law enforcement agency would use a surveillance network to disproportionately monitor a racial, religious or ethnic minority group is informed by precedent.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"MZFAFX7RFRARHLVSNYHVGQC42Q\">In 2018, New York Police Department settled a lawsuit after <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/world\/2018\/apr\/05\/nypd-muslim-surveillance-settlement\" rel=\"noopener\">illegally spying on mosques and Muslim groups<\/a>. In 2020, the <a target=\"_blank\" href=\"https:\/\/theintercept.com\/2021\/04\/22\/drones-black-lives-matter-protests-marshals\/\" rel=\"noopener\">U.S. Marshals Service used drones<\/a> to spy on Black Lives Matter protesters in Washington D.C., according to The Intercept. In 2020, San Francisco police were sued and accused of \u201c<a target=\"_blank\" href=\"https:\/\/www.kqed.org\/news\/11841385\/sf-police-used-camera-network-to-illegally-spy-on-protestors-new-lawsuit-alleges\" rel=\"noopener\">commandeering\u201d private security cameras<\/a> to monitor Black Lives Matter protests, according to KQED.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"PCS2XPUVUJCNPF5U7BTYS5VVZE\">One argument in favor of increasing surveillance is that a person who has nothing to hide should not be worried about others watching. Daniels rejects that.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"IRXISDYQKRGNBFMD4KRXKTMPQA\">\u201cWe should never get to the point where the burden is on Ohioans or Americans to say why they don\u2019t feel they should be surveilled,\u201d Daniels said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"XFJBFJQYVRDBNG25L5NYKD7QR4\">The solution, Friedman says, is to create reasonable surveillance policies and a commission of cybersecurity experts, police, members of the community, civil liberties experts and others to review and approve them.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"EVSBIYBOXVDVLPKQ4G5DJFPY3Y\">Daniels favors something similar, pointing to cities like Dayton and Yellow Springs that have codified a process for <a target=\"_blank\" href=\"https:\/\/www.aclu.org\/legal-document\/community-control-over-police-surveillance-ccops-model-bill\" rel=\"noopener\">reviewing potential changes to police surveillance.<\/a> But Daniels said that, in the past, financial constraints slowed the process of installing surveillance equipment long enough for meaningful conversations to take place about civil rights and the usefulness of surveillance. He worries that the influx of ARPA money will \u201cshort-circuit\u201d that layer of scrutiny.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"TEQUMKCQFNEMNNUKPYLYZUO7QU\">Friedman agrees.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"QX3G7DGYKFBWFKKSQLKINZVNIE\">\u201cIt\u2019s a give and take situation.
