{"id":31719,"date":"2022-05-14T00:36:09","date_gmt":"2022-05-14T00:36:09","guid":{"rendered":"https:\/\/cjstudents.com\/?p=31719"},"modified":"2022-05-14T00:36:09","modified_gmt":"2022-05-14T00:36:09","slug":"how-much-proof-do-we-need-that-nys-justice-system-is-a-sham","status":"publish","type":"post","link":"https:\/\/cjstudents.com\/index.php\/2022\/05\/14\/how-much-proof-do-we-need-that-nys-justice-system-is-a-sham\/","title":{"rendered":"How much proof do we need that NY&#8217;s justice system is a sham?"},"content":{"rendered":"<p> [ad_1]<\/p>\n<div>\n<aside class=\"single__inline-module alignleft\">\n<\/aside>\n<p>New York can breathe a sigh of relief as <a target=\"_blank\" href=\"https:\/\/nypost.com\/2022\/05\/11\/cops-getting-shot-because-of-ny-pols-lax-handling-of-crime\/\" rel=\"noopener\">Officer Dennis Vargas,<\/a> our eighth police officer shot on duty in just five months, recovers at home with the family he nearly left behind.<\/p>\n<p>Vargas and his partner\u2019s actions exemplify the type of dangerous work we ask our officers to perform every day to curb the scourge of gun violence that plagues our city. Sadly, the <a target=\"_blank\" href=\"https:\/\/nypost.com\/2022\/05\/11\/nypd-cop-shot-in-the-bronx-at-traffic-stop\/\" rel=\"noopener\">suspect\u2019s criminal history<\/a> and his avoidance of any real consequences for his actions exemplify the sham known as our criminal-justice system.<\/p>\n<p>The two officers spotted the suspect, Rameek Smith, allegedly carrying a gun along 3rd Avenue in The Bronx, in one of the precincts <a target=\"_blank\" href=\"https:\/\/nypost.com\/2022\/05\/11\/adams-must-do-more-than-complain-about-criminal-coddling\/\" rel=\"noopener\">Mayor Eric Adams correctly<\/a> identified as responsible for 80% of the city\u2019s violent crimes. The officers gave chase, and the suspect turned and fired, hitting Vargas in the arm. Police returned fire, killing Smith.<\/p>\n<p>The searing question is why Smith, arrested nearly 2\u00bd years ago with <em>another<\/em> illegal gun, was allowed out on the streets in the first place, ready and willing to commit <a target=\"_blank\" href=\"https:\/\/nypost.com\/2022\/05\/12\/eric-adams-very-concerned-about-scotus-ruling-that-could-lift-ny-open-carry-ban\/\" rel=\"noopener\">another grave offense.<\/a><\/p>\n<p>And Rameek Smith is no outlier. Rice<\/span><\/figcaption><\/figure>\n<p>In 2021, officers made 4,499 arrests of individuals carrying or <a target=\"_blank\" href=\"https:\/\/nypost.com\/2022\/04\/09\/nypd-recovering-staggering-number-of-number-of-ghost-guns-in-2022\/\" rel=\"noopener\">using an illegal firearm.<\/a> Of those, 46 are thankfully being prosecuted under federal law. Of the remaining 3,983, prosecutors declined to prosecute 260, while 983 were already dismissed outright or given an Adjournment in Contemplation of Dismissal (virtually a summons).<\/p>\n<p>That means nearly a third of gun collars face absolutely no consequence beyond the minor speed bump of their arrest. Incredibly, 174 cases are recorded as lost in the Office of Court Administration system; a handful were covered by prosecutions of higher-level offenses; and 10 defendants died.<\/p>\n<p>The real shocker: Only 710, or 17.9%, of the defendants were adjudicated guilty or ruled a youthful offender, with 698 given plea bargains. Smith fit into this category. In 2020, he was charged with criminal possession of a weapon, a felony. At the time, he was already on probation for a 2016 robbery. He pled guilty to the gun charge in December, but a judge allowed him to remain free until sentencing. Two years, at most?<\/p>\n<p>Recall former Mayor Bill de Blasio boasted that <a target=\"_blank\" href=\"https:\/\/nypost.com\/2019\/12\/06\/nyc-spends-record-337524-per-inmate-in-jail-annually-report\/\" rel=\"noopener\">our prison population<\/a> has not been lower since World War II. Unfortunately, that means people like Smith out on the streets as a beneficiary of some backward woke policy goal.<\/p>\n<p>In fact, many New Yorkers have started noticing that nearly all of the criminal-justice policy goals of progressive Democrats involve some combination of lowering the number of inmates; easing conditions in jails; hamstringing the police; <a target=\"_blank\" href=\"https:\/\/nypost.com\/2022\/04\/07\/nyc-jail-guard-lands-behind-bars-after-sneaking-blades-drugs-to-inmates\/\" rel=\"noopener\">vilifying correction officers;<\/a> bankrolling non-profit criminal advocacy groups; ending bail for violent suspects; or decriminalizing <a target=\"_blank\" href=\"https:\/\/nypost.com\/2022\/04\/05\/scourge-of-gramercy-park-homeless-man-terrorizes-nyc-neighborhood\/\" rel=\"noopener\">anti-social behavior.<\/a><\/p>\n<p>Have I missed anything?\u00a0<\/p>\n<p>After a quick skim of the Twitter feeds and e-mail blasts of many Democrats, I\u2019m beginning to wonder what percentage of them <a target=\"_blank\" href=\"https:\/\/nypost.com\/2022\/04\/24\/suspects-walk-free-after-arrests-by-nypds-new-anti-gun-teams\/\" rel=\"noopener\">prioritizes criminal defendants<\/a> over crime victims.
