{"id":32252,"date":"2022-05-29T23:44:00","date_gmt":"2022-05-29T23:44:00","guid":{"rendered":"https:\/\/cjstudents.com\/index.php\/2022\/05\/29\/va-budget-leaders-include-new-marijuana-crime-in-spending-plan-govt-and-politics\/"},"modified":"2022-05-29T23:44:00","modified_gmt":"2022-05-29T23:44:00","slug":"va-budget-leaders-include-new-marijuana-crime-in-spending-plan-govt-and-politics","status":"publish","type":"post","link":"https:\/\/cjstudents.com\/index.php\/2022\/05\/29\/va-budget-leaders-include-new-marijuana-crime-in-spending-plan-govt-and-politics\/","title":{"rendered":"Va. budget leaders include new marijuana crime in spending plan | Govt-and-politics"},"content":{"rendered":"<p> [ad_1]<\/p>\n<div itemprop=\"articleBody\" id=\"article-body\">\n<div class=\"lee-article-text first-p\">\n<p>Virginia legislative leaders on Sunday evening <a target=\"_blank\" href=\"https:\/\/budget.lis.virginia.gov\/amendment\/2022\/2\/HB30\/Introduced\/CR\/4-14\/5c\/\" rel=\"noopener\">revealed budget language<\/a> that would create a new criminal misdemeanor in state law for possession of more than four ounces of marijuana in public.<\/p>\n<\/div>\n<div class=\"lee-article-text\">\n<p>Marijuana reform groups immediately called for lawmakers to stand down and stop finding new ways to criminalize Virginians who use marijuana.<\/p>\n<\/div>\n<div class=\"lee-article-text\">\n<p>The provision will be the third time this year that state lawmakers have considered creating new crimes for marijuana possession.<\/p>\n<\/div>\n<div class=\"lee-article-text\">\n<p>The proposal comes within the proposal for a new two-year state budget &#8211; which became publicly available online Sunday evening. The General Assembly will convene Wednesday in special session to consider the budget. The language on marijuana &#8211; like much of the budget agreement on the table &#8211; followed discussions that were not held in public.<\/p>\n<\/div>\n<div class=\"lee-article-text\">\n<p>The budget compromise backed by House Appropriations Chairman Barry Knight, R-Virginia Beach, and Senate Finance and Appropriations Chair Janet Howell, D-Fairfax, would write into law that anyone caught in public with more than four ounces of marijuana would be guilty of a class three criminal misdemeanor. That means a fine of up to $500 plus a criminal record.<\/p>\n<\/div>\n<div id=\"inline-article-recommend\" class=\"lee-article-text\">\n<div class=\"ir-wrapper\">\n<div class=\"style-title\">\n<div class=\"block-title emphasis-h3\">\n<p><h3>People are also reading\u2026<\/h3>\n<\/p><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<div class=\"lee-article-text\">\n<p>A second or subsequent offense would be a class two misdemeanor, punishable by up to six months in jail and a fine of up to $1,000.<\/p>\n<\/div>\n<div class=\"lee-article-text\">\n<p>Virginia lawmakers in 2021, when Democrats controlled both chambers of the legislature, legalized adult possession of up to an ounce of marijuana for personal use; adults can now grow up to four plants in their homes. Possession of anything above an ounce and up to a pound is punishable only by a $25 civil infraction, while possession of more than a pound is a felony.<\/p>\n<\/div>\n<div class=\"lee-article-text\">\n<p>But the state&#8217;s Joint Legislative Audit and Review Commission <a target=\"_blank\" href=\"https:\/\/richmond.com\/news\/state-and-regional\/govt-and-politics\/watchdog-urges-changes-to-virginias-new-marijuana-law-defining-limits-on-products-establishing-misdemeanor\/article_34235f58-3b26-52fa-b6ec-c42786908f1e.html\" rel=\"noopener\">recommended a year ago<\/a> that Virginia follow the lead of other states and create a criminal misdemeanor for people in possession of what the state government deems to be too much marijuana.<\/p>\n<\/div>\n<div class=\"lee-article-text\">\n<p>Chelsea Higgs Wise, executive director of the group Marijuana Justice Virginia, along with heads of other organizations, sent Howell an email on Sunday evening.<\/p>\n<\/div>\n<div class=\"lee-article-text\">\n<p>&#8220;Please stop finding more ways to criminalize Virginians,&#8221; she wrote, adding, &#8220;let&#8217;s work on righting the wrongs from the failed and destructive prohibition.&#8221;<\/p>\n<\/div>\n<div class=\"lee-article-text\">\n<p>Higgs Wise added: &#8220;Virginia officials must not allow the budget document to become a legislative workaround to enforce the will of the administration at the exclusion of the voice and will of the people.&#8221;<\/p>\n<\/div>\n<div class=\"lee-article-text\">\n<p>Efforts to add new criminal penalties for marijuana to state law already failed twice this year.<\/p>\n<\/div>\n<div class=\"lee-article-text\">\n<p>During the regular session of the General Assembly, a bill from Sen. Adam Ebbin, D-Alexandria, broadly would have governed new retail sales of marijuana in Virginia and also would have created a new criminal misdemeanor. The bill failed in the GOP-controlled House.<\/p>\n<\/div>\n<div class=\"lee-article-text\">\n<p>And then in April, GOP Gov. Glenn Youngkin <a target=\"_blank\" href=\"https:\/\/richmond.com\/news\/state-and-regional\/youngkin-wants-penalties-for-people-with-more-than-2-ounces-of-marijuana\/article_bd5cfde3-755a-59b6-9a46-894a68fc4d4f.html\" rel=\"noopener\">proposed amendments to a hemp industry bill<\/a> that would have established new criminal misdemeanor penalties for people in possession of more than two ounces of marijuana. Opponents said the proposal <a target=\"_blank\" href=\"https:\/\/richmond.com\/news\/state-and-regional\/govt-and-politics\/coalition-of-marijuana-advocates-presents-petition-to-legislature\/article_b10de628-27dd-513c-9086-9d2c9233d05e.html\" rel=\"noopener\">moved the state backward<\/a> toward racially biased policing. The General Assembly didn&#8217;t adopt the governor&#8217;s proposal.<\/p>\n<\/div>\n<div class=\"lee-article-text\">\n<p>Because the General Assembly failed to complete work on a new budget and on certain bills during this year&#8217;s regular session, the assembly remains in a special session.<\/p>\n<\/div>\n<div class=\"lee-article-text\">\n<p>While the budget generally lays out state spending, the legislature has the power to propose policy in the budget, and that&#8217;s what Knight and Howell are proposing with the marijuana penalty.
