{"id":32282,"date":"2022-05-30T22:03:59","date_gmt":"2022-05-30T22:03:59","guid":{"rendered":"https:\/\/cjstudents.com\/?p=32282"},"modified":"2022-05-30T22:03:59","modified_gmt":"2022-05-30T22:03:59","slug":"this-is-a-big-job-leonard-takes-on-shellenberger-in-baltimore-county-states-attorney-primary","status":"publish","type":"post","link":"https:\/\/cjstudents.com\/index.php\/2022\/05\/30\/this-is-a-big-job-leonard-takes-on-shellenberger-in-baltimore-county-states-attorney-primary\/","title":{"rendered":"&#8216;This is a big job&#8217;: Leonard Takes on Shellenberger in Baltimore County State&#8217;s Attorney Primary"},"content":{"rendered":"<p> [ad_1]<\/p>\n<div>\n<figure class=\"wp-caption\">\n\t\t\t\t\t\t\t<img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.marylandmatters.org\/wp-content\/uploads\/2022\/03\/Scales-of-justice-1024x683-1.jpeg\" height=\"683\" width=\"1024\" alt=\"\" class=\"img-fluid\"\/><figcaption class=\"wp-caption-text\">Getty Images.<\/figcaption><\/figure>\n<p>For the first time in a decade, Baltimore County State\u2019s Attorney Scott Shellenberger (D) will have a Republican opponent to campaign against \u2014 if he can beat Robbie Leonard (D) in the 2022 primary election.<\/p>\n<p>\u201cMy priority in running for state\u2019s attorney is having a fair, transparent and accountable criminal justice system in the State\u2019s Attorney\u2019s Office \u2014 things that we don\u2019t have here,\u201d Leonard said.<\/p>\n<p>A tough-on-crime Democrat, Shellenberger will square up against the young, self-described \u201cprogressive\u201d attorney and secretary of the Maryland\u00a0 Democratic Party at the polls in July.<\/p>\n<p>\u201cThis is a big job and I certainly think that I\u2019ve proven over the years that I\u2019m up to continuing to do it,\u201d said Shellenberger.<\/p>\n<p>The Republican candidates are James Haynes, a retired attorney who previously worked as an administrative judge for the U.S. Department of Labor and at the state attorney general and public defender offices, and Deborah Hill, who has <a target=\"_blank\" href=\"https:\/\/www.marylandmatters.org\/2019\/06\/06\/retirees-seek-class-action-status-in-prescription-benefits-case\/\" rel=\"noopener\">represented state employee retirees in a lawsuit<\/a> challenging a reduction in their prescription drug benefits.<\/p>\n<p>In the Democratic primary, Leonard has garnered an impressive list of endorsements so far, including from the Teacher\u2019s Association of Baltimore County, Our Revolution, The Working Families Party, Progressive Maryland, CASA Maryland and several labor unions. He was also given the Gun Sense Candidate distinction from Moms Demand Action to End Gun Violence.<\/p>\n<p>Leonard has been a practicing attorney for 15 years and served as a public defender in Baltimore City. Last summer, he <a target=\"_blank\" href=\"https:\/\/www.publicjustice.org\/en\/news\/maryland-must-continue-federal-unemployment-benefits-judge-rules\/\" rel=\"noopener\">represented unemployed Marylanders<\/a> who successfully challenged Republican Gov. Lawrence J. Hogan Jr.\u2019s attempt to end an enhanced federal benefit program early.<\/p>\n<p>Throughout his career, Leonard said he\u2019s represented minors and adults and served on the public defender\u2019s government relations team, where he testified on bills in the legislature.<\/p>\n<p>\u201cI was always on the opposite side of every issue from the current Baltimore County State\u2019s Attorney Scott Shellenberger,\u201d he said. \u201cI always wondered, like, how is this state\u2019s attorney a Democrat? \u2026 He\u2019s always opposing legislation being put in by Democrats.\u201d<\/p>\n<p>Shellenberger has frequently opposed progressive criminal justice legislation in Annapolis.<\/p>\n<p>Shellenberger said while he often testifies in opposition to the bills as drafted, he supports \u201creasonable reforms.\u201d He harkened back to the 2015 Maryland Second Chance Act and the 2016 Justice Reinvestment Act, both of which he supported.<\/p>\n<p>\u201cThis concept that I\u2019m against everything and we have to throw everybody in jail \u2014 I just think if people really dig into my record they would find that there\u2019s a lot there,\u201d he said.<\/p>\n<p>Leonard said the incumbent\u2019s opposition to local police reform policies mobilized him to challenge Shellenberger. He said that 52 Baltimore County residents testified in favor of the legislation at a public hearing. Only Shellenberger and the Fraternal Order of Police appeared in opposition, according to Leonard.<\/p>\n<p>\u201cI had known for over a decade who Scott was and what he stood for, \u2026 but it was at that moment that I realized how out of touch he is with the people that he\u2019s supposed to be representing and how out of touch he is in the pursuit of justice and fairness,\u201d he said.<\/p>\n<p>Shellenberger has a close relationship with the Baltimore County Police Department, which has been questioned in the past.<\/p>\n<p>In mid-May, <a target=\"_blank\" href=\"https:\/\/nymag.com\/intelligencer\/2022\/05\/anna-borkowski-accused-three-men-of-rape-police-stopped-her.html?fbclid=IwAR0lr6SnKO8oZYfMfVU7uHC9gpQsAtvF2iv2wxB-OnfM_8-3olCA1Qri4mo\" rel=\"noopener\">New York Magazine<\/a> published a piece detailing an ongoing federal lawsuit against Shellenberger and other officials in which sexual assault survivors have alleged that their rights were violated and the investigation of their cases mishandled.<\/p>\n<p>One plaintiff, Anna Borkowski, told the magazine that Shellenberger sent three members of the Baltimore County Police Department to her grandmother\u2019s house in Baltimore City, which is out of their jurisdiction, to tell her to stop attempting to file charges against her assailants.<\/p>\n<p>The article\u2019s title is a quote from Leonard about mishandled sexual assault cases in the county: \u201cWe don\u2019t know how many women are out there like that.\u201d<\/p>\n<p>According to a 2019 <a target=\"_blank\" href=\"https:\/\/www.baltimoresun.com\/news\/investigations\/bs-md-rape-investigations-20161203-story.html\" rel=\"noopener\">Baltimore Sun report<\/a>, the Baltimore County Sexual Assault Investigations Task Force found that county police seldom tested evidence from sexual assault cases.<\/p>\n<p>Leonard said he wants to \u201ctake most of the blame away from the police department\u201d in regard to how it handles rape allegations \u201cbecause they\u2019re really just following the directions of Mr. Shellenberger.\u201d<\/p>\n<p>\u201cThe police department shrugs off and blows off so many claims of rape and sexual assault because they know that there\u2019s no point in arresting someone because Mr. Shellenberger is just going to dismiss the case,\u201d he alleged.<\/p>\n<p>Shellenberger said that when the county began collecting test kit evidence, they \u201chad to make priorities as to which kits would be tested.\u201d For example, kits went untested in cases where both parties knew each other \u201cbecause identification wasn\u2019t an issue,\u201d he explained.<\/p>\n<p>In 2019, state and local lawmakers passed bills to fund testing of previously untested kits and set standards for testing kits in the future.<\/p>\n<p>Shellenberger said that older kits are currently being tested \u2014 \u201ceven in cases where it wasn\u2019t stranger-on-stranger.\u201d Thus far, 400 older kits have been tested and 300 more are on deck.<\/p>\n<p>\u201cWe have a very robust program that\u2019s been going on for a couple years now to get caught up on this, so I think I think we\u2019re doing a better job there,\u201d he said.<\/p>\n<p>Shellenberger also refuted the notion that he is too close with the county\u2019s Fraternal Order of Police, saying he has a list of 18 police officers \u2014 including the organization\u2019s past president \u2014 that his office has prosecuted in the past few years.<\/p>\n<p><strong>Prioritizing violent crime<\/strong><\/p>\n<p>If re-elected, Shellenberger plans to prioritize prosecuting violent crime, which has been on the rise in Baltimore County.<\/p>\n<p>Leonard agreed that crime needs to be addressed and that residents feel unsafe. \u201c\u2026 At the same time, they see that there\u2019s no accountability in the police department, and there\u2019s no accountability in the State\u2019s Attorney\u2019s Office,\u201d he said.<\/p>\n<p>Leonard said that transparency and accountability mean prosecuting violent crimes \u201cwhere there\u2019s actual victims\u201d \u2014 not \u201cquality of life offenses,\u201d like charges that stem from poverty or drug use.<\/p>\n<p>Shellenberger is of the mindset that all laws should be enforced.<\/p>\n<p>\u201cThat doesn\u2019t mean that \u2026 everybody goes to jail,\u201d he said. \u201c\u2026 It\u2019s important for the courts to get involved so that they can assist defendants in getting the help that they need, sometimes by making it a condition of probation.\u201d<\/p>\n<p>Leonard said that incarceration for drug offenses and prostitution doesn\u2019t work. If elected, he plans to partner with state and local agencies and nonprofits to get people help rather than introducing them to the criminal justice system.<\/p>\n<p>Shellenberger\u2019s tactic is to lean on the justice system.<\/p>\n<p>\u201cThe way we catch defendants who are guilty of human trafficking is to make an arrest in a prostitution case,\u201d said Shellenberger, who clarified that that \u201cdoesn\u2019t mean that that person needs to be prosecuted for prostitution.\u201d<\/p>\n<p>Leonard said arresting possible human trafficking victims preposterous.<\/p>\n<p>\u201cHow crazy is that?\u201d he said. \u201cImagine any other victim of a crime where we would say, \u2018in order to capture the real bad guy, we need to lock you up, put handcuffs on you and make you stand in front of a judge.\u2019\u201d<\/p>\n<p>\u201cThat\u2019s insane,\u201d he continued.<\/p>\n<p><em>Danielle E.
