But one provision heralds a potentially significant win for domestic violence victim advocates after years of bitter stalemate \u2014 the closure of the so-called \u201c<a target=\"_blank\" href=\"https:\/\/www.thelily.com\/the-link-between-intimate-partner-violence-and-mass-shootings\/\" rel=\"noopener\">boyfriend loophole<\/a>.\u201d<\/p>\n<\/div>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">\u201cClosing this loophole is very important for the safety of domestic violence victims,\u201d said Emily Rothman, a professor at Boston University who studies gun violence and intimate partner abuse. \u201cI think it\u2019s excellent news that people are getting on to the same page about that and there is bipartisan agreement that people who are abusive to their partners should not have access to firearms.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p><span class=\"font--article-body font-copy hide-for-print ma-0 pb-md db italic interstitial\"><a target=\"_blank\" data-qa=\"interstitial-link\" href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/06\/12\/senate-gun-deal-framework\/?itid=lk_interstitial_manual_6\" rel=\"noopener\">Senators strike bipartisan gun deal, heralding potential breakthrough<\/a><\/span><\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">The loophole refers to the fact that while <a target=\"_blank\" href=\"https:\/\/www.justice.gov\/archives\/jm\/criminal-resource-manual-1117-restrictions-possession-firearms-individuals-convicted\" rel=\"noopener\">federal law<\/a> bars firearm purchases for those convicted of domestic violence against someone they have been married to, lived with, or with whom they have a child, it omits other dating partners. It is a significant oversight, advocates say, given that the proportion of murders committed by dating partners versus spouses is about equal, <a target=\"_blank\" href=\"https:\/\/bjs.ojp.gov\/content\/pub\/pdf\/htus8008.pdf\" rel=\"noopener\">according to a Department of Justice analysis<\/a>.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">\u201cA marriage license, advocates argue, shouldn\u2019t be the line where authorities can weigh in,\u201d said Robert J. Spitzer, a professor at SUNY Cortland and the author of several books on gun policy.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">The legislation itself has not yet been drafted, leaving substantial uncertainty about what the final bill will contain. The statement announcing the deal, signed by 10 Democrats and 10 Republicans in the Senate, highlights that it includes provisions to encourage more states to enact red-flag laws to prevent gun purchases by people a judge deems at risk of violence, and an expansion of the number of sellers required to run background checks on potential buyers. It would also earmark billions of dollars for mental health care and enhanced security in schools.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">For victim advocates, the stakes of closing the boyfriend loophole, in particular, are high: \u201cI believe that closing this particular loophole may be the single most important and beneficial part of the overall package,\u201d said Spitzer, while cautioning that a lot depends on what language ends up in the final bill.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">\u201cIt all really hinges on the wordsmiths that craft this provision,\u201d he said.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p><span class=\"font--article-body font-copy hide-for-print ma-0 pb-md db italic interstitial\"><a target=\"_blank\" data-qa=\"interstitial-link\" href=\"https:\/\/www.washingtonpost.com\/national\/2017\/09\/21\/states-move-to-restrict-domestic-abusers-from-carrying-guns\/?itid=lk_interstitial_manual_16\" rel=\"noopener\">States move to restrict domestic abusers from carrying guns<\/a><\/span><\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Research shows that the presence of guns can have devastating consequences in domestic violence situations: A woman <a target=\"_blank\" href=\"https:\/\/efsgv.org\/learn\/type-of-gun-violence\/domestic-violence-and-firearms\/\" rel=\"noopener\">is five times more likely<\/a> to be murdered when her abuser has access to a gun, according to the Johns Hopkins Center for Gun Violence Solutions.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">There is also a <a target=\"_blank\" href=\"https:\/\/www.preventdvgunviolence.org\/multiple-killings-zeoli.pdf\" rel=\"noopener\">strong link<\/a> between domestic violence and mass shootings. <a target=\"_blank\" href=\"https:\/\/injepijournal.biomedcentral.com\/articles\/10.1186\/s40621-021-00330-0#ref-CR24\" rel=\"noopener\">One study found<\/a> that in 68 percent of mass shootings between 2014 and 2019, the shooter either murdered a family member or a dating partner, or had a history of domestic violence.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Even when guns are not lethal, research <a target=\"_blank\" href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/16845765\/\" rel=\"noopener\">shows <\/a>they can be used by abusers to threaten victims, including by cleaning a gun during a dispute, threatening to shoot a victim\u2019s pet or firing the weapon during an argument.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">\u201cIf a person is abusive and violent towards their partner, it\u2019s better to keep firearms away from them. I haven\u2019t met many people who disagree with that,\u201d Rothman said.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">But <a target=\"_blank\" href=\"https:\/\/www.pewresearch.org\/fact-tank\/2021\/09\/13\/key-facts-about-americans-and-guns\/\" rel=\"noopener\">like most debates about guns in the United States<\/a>, what many Democrats and some Republicans consider common sense has not translated into a political consensus with enough teeth to enact legislation.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">The \u201cboyfriend loophole\u201d crops up in both state and federal law, and some of the types of red-flag laws this bipartisan framework hopes to push exclude dating partners from increased gun control. In some states, restraining orders are similarly only applicable to a spouse or a domestic partner.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Disagreement over the boyfriend loophole has been at the center of a debate around <a target=\"_blank\" href=\"https:\/\/www.thelily.com\/senators-are-pushing-to-reauthorize-the-violence-against-women-act-will-it-help-indigenous-communities\/\" rel=\"noopener\">the 1994 Violence Against Women Act<\/a>, which also had carve-outs for dating partners for years. The National Rifle Association <a target=\"_blank\" href=\"https:\/\/www.wbur.org\/onpoint\/2022\/04\/08\/congress-guns-behind-the-fight-to-close-the-boyfriend-loophole\" rel=\"noopener\">lobbied aggressively against<\/a> attempts to close the loophole during reauthorization debates in 1996 and 2018.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">The House successfully voted to <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/politics\/house-women-violence-legislation\/2021\/03\/17\/afd2ff38-8753-11eb-bfdf-4d36dab83a6d_story.html?itid=lk_inline_manual_28\" rel=\"noopener\">reauthorize VAWA last year<\/a> with language that added dating partners convicted of domestic violence and stalkers to the list of people who should not be able to own firearms.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">This added language, however, drew <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/politics\/house-women-violence-legislation\/2021\/03\/17\/afd2ff38-8753-11eb-bfdf-4d36dab83a6d_story.html?itid=lk_inline_manual_29\" rel=\"noopener\">opposition from the <\/a>NRA and Republican legislators, and risked dooming the bill in the Senate. <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/03\/09\/violence-against-women-act-reauthorization-omnibus-bill-vawa\/?itid=lk_inline_manual_29\" rel=\"noopener\">Ultimately, Senators opted to retain the loophole, <\/a>rather than risk the VAWA floundering indefinitely.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">\u201cIn order to get anywhere near 60 votes, that provision became controversial, and we had to measure the remainder of the bill against that provision. It\u2019s a tough choice, and we made the choice we thought was right,\u201d Sen. Richard J. Durbin (D-Ill.) <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/03\/09\/violence-against-women-act-reauthorization-omnibus-bill-vawa\/?itid=lk_inline_manual_31\" rel=\"noopener\">said<\/a> in March.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">In a statement shared with The Washington Post, the NRA said it does not take positions on \u201cframeworks,\u201d but it \u201cis committed to real solutions to help stop violence in our communities.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">The statement continued: \u201cThe NRA will continue to oppose any effort to insert gun-control policies, initiatives that override constitutional due process protections, and efforts to deprive law-abiding citizens of their fundamental right to protect themselves and their loved ones into this or any other legislation.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Laws restricting abusers from accessing guns can be lifesaving, research shows: One <a target=\"_blank\" href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/30383263\/\" rel=\"noopener\">2018 study<\/a> found that states with laws banning those convicted of violent misdemeanors from owning guns saw a 23 percent reduction in intimate partner homicide.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Not all domestic violence experts, however, see this kind of legislation as an unmitigated good.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">\u201cGetting guns out of the hands of people who abuse their partners is essential, but doing that using the criminal law is problematic,\u201d said Leigh Goodmark, a professor at the University of Maryland Carey School of Law and the author of <a target=\"_blank\" href=\"https:\/\/www.ucpress.edu\/book\/9780520391123\/imperfect-victims\" rel=\"noopener\">the forthcoming book \u201cImperfect Victims.\u201d<\/a><\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">\u201cThe law will be disparately enforced against people of color, especially Black people, as all criminal laws are,\u201d Goodmark said. \u201cAnd it will require that people seek out law enforcement intervention, which many people are, for good reason, reluctant to do.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Research shows that Black women, who are <a target=\"_blank\" href=\"https:\/\/www.semanticscholar.org\/paper\/Racial-and-Ethnic-Differences-in-Homicides-of-Adult-Petrosky-Blair\/56732eb32b4c43dbc25ea36dd9597e6dd53cacd5\" rel=\"noopener\">twice as likely<\/a> as White women to be shot and killed by an intimate partner, <a target=\"_blank\" href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC4817725\/#R7\" rel=\"noopener\">face a slew of barriers<\/a> getting help in abusive situations. <a target=\"_blank\" href=\"https:\/\/www.ncjrs.gov\/pdffiles1\/nij\/188199.pdf\" rel=\"noopener\">Research also shows<\/a> that relying on arrests and criminal convictions to prevent domestic violence <a target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2019\/07\/23\/opinion\/domestic-violence-criminal-justice-reform-too.html\" rel=\"noopener\">can actually make <\/a>victims less safe, particularly Black women, by exacerbating conditions like poverty and unemployment that make abuse more likely and harder to escape.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">The boyfriend loophole is also not the only gap through which abusers can arm themselves. A provision known as <a target=\"_blank\" href=\"https:\/\/www.americanprogress.org\/article\/frequently-asked-questions-charleston-loophole\/\" rel=\"noopener\">the Charleston loophole<\/a> means that if a federal background check has not been completed in three days, the applicant can move forward with a firearm purchase. And background checks are not required at all for private gun sellers in many states \u2014 which results in <a target=\"_blank\" href=\"https:\/\/www.acpjournals.org\/doi\/10.7326\/M16-1590\" rel=\"noopener\">an estimated 22 percent<\/a> of gun owners never having to get one, according to one study.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">For Goodmark, the latest legislation is uninspiring, given the scale of \u201can overwhelming epidemic of gun violence.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">\u201cIt won\u2019t do nothing, but it won\u2019t do much, and it comes with real costs,\u201d she said.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Still, this legislation is set to be the biggest leap forward in decades.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">\u201cI have talked to multiple responsible gun owners, and people who provide gun safety training, who are all in agreement that if a person has demonstrated that they are violent, or engage in stalking behavior, or make criminal threats, that person should not have access to a firearm,\u201d Rothman said. \u201cThis legislation is a step in the right direction.\u201d<\/p>\n<\/div>\n<section class=\"b bt bc-offblack dn-ns hide-for-print\" data-testid=\"mostRead\" subscriptions-section=\"content\"\/><\/div>\n<p>[ad_2]<br \/>\n<br \/><a href=\"https:\/\/www.washingtonpost.com\/nation\/2022\/06\/14\/boyfriend-loophole-bipartisan-gun-deal\/\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>[ad_1] Placeholder while article actions load This story has been updated.
