{"id":33051,"date":"2022-06-22T19:10:46","date_gmt":"2022-06-22T19:10:46","guid":{"rendered":"https:\/\/cjstudents.com\/?p=33051"},"modified":"2022-06-22T19:10:46","modified_gmt":"2022-06-22T19:10:46","slug":"maine-over-institutionalized-children-with-disabilities-justice-department-says","status":"publish","type":"post","link":"https:\/\/cjstudents.com\/index.php\/2022\/06\/22\/maine-over-institutionalized-children-with-disabilities-justice-department-says\/","title":{"rendered":"Maine over-institutionalized children with disabilities, Justice Department says"},"content":{"rendered":"<p> [ad_1]<\/p>\n<div>\n<p><em>This story will be updated. <\/em><\/p>\n<p>Maine was found to have violated the Americans with Disabilities Act for not making community-based services accessible enough to children with mental health and developmental disabilities, the U.S. Justice Department announced Wednesday. <\/p>\n<p>Following a complaint filed by Disability Rights Maine, an investigation determined that the state violated the ADA as well as the Supreme Court\u2019s 1999 decision, Olmstead v L.C., which holds that people with disabilities have a right to receive services in a setting appropriate to their needs \u2014 such as their homes and communities. <\/p>\n<p>\u201cAbsent these services, Maine children with disabilities enter emergency rooms, come into contact with law enforcement, and remain in institutions when many of them could be at home if Maine put in place sufficient community-based services,\u201d the department said. <\/p>\n<p>An investigation found that there were a number of barriers in Maine that prevented such services such as lengthy waitlists, an insufficient provider network, inadequate crisis services and a lack of support for foster care parents which lead to children entering in- and out-of state facilities or Long Creek Youth Development Center to receive behavioral health services, according to the department. <\/p>\n<p>Due to the pandemic, hospitals across Maine reached capacity and caused staff shortages, which resulted in people with mental and behavioral crises being put on waiting lists and kept <a target=\"_blank\" href=\"https:\/\/bangordailynews.com\/2021\/11\/22\/news\/patients-who-need-psychiatric-care-wait-days-in-maine-emergency-rooms-joam40zk0w\/\" rel=\"noopener\">in emergency rooms<\/a>\u00a0because there was no room for them elsewhere. <\/p>\n<p>A Presque Isle mother told <a target=\"_blank\" href=\"https:\/\/www.bangordailynews.com\/2022\/06\/10\/news\/aroostook\/mental-health-system-pi-death-joam40zk0w\/\" rel=\"noopener\">the Bangor Daily News earlier this month<\/a>\u00a0that the health care system couldn\u2019t offer her son the long-term help he needed. He was later fatally shot by police. <\/p>\n<p>Another Bangor mother told the BDN in November how her 8-year-old son with severe ADHD, impulse control issues and intermittent explosive disorder had been <a target=\"_blank\" href=\"https:\/\/www.bangordailynews.com\/2021\/12\/27\/politics\/maines-behavioral-health-crisis-has-left-a-bangor-8-year-old-institutionalized-for-6-months-joam40zk0w\/\" rel=\"noopener\">institutionalized for six months<\/a>\u00a0already because he was at risk of losing a residential bed if he left the hospital. <\/p>\n<p>\u201cAccess to local community-based services for children with mental health and\/or developmental disabilities is a critical need for families across Maine,\u201d said U.S. Attorney Darcie N.
