Their stance conflicts with the long-standing position of civil rights advocates, who have generally opposed the death penalty out of concerns it is unjust and disproportionately used against racial minorities.<\/p>\n<\/div>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">\u201cThere\u2019s a mixed feeling about it. Some say, \u2018Yeah, that should be in play,\u2019 \u201d said Kristen Elmore-Garcia, a Buffalo-based lawyer who represents one of the families.<\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">But Garland, under pressure from civil rights groups, issued <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/national-security\/federal-executions-halted-merrick-garland\/2021\/07\/01\/74dfb660-dac7-11eb-bb9e-70fda8c37057_story.html?itid=lk_inline_manual_5\" rel=\"noopener\">a moratorium<\/a> last summer on federal executions, after the administration of President Donald Trump <a target=\"_blank\" href=\"https:\/\/apnews.com\/article\/donald-trump-wildlife-coronavirus-pandemic-crime-terre-haute-28e44cc5c026dc16472751bbde0ead50\" rel=\"noopener\">carried out 13<\/a>  in the final six months of his presidency. As heinous as the Buffalo killings were, Black civil rights leaders say, seeking to execute the gunman would represent a setback in their efforts to abolish capital punishment.<\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">\u201cThe reality for us is that the system is too often infused with racial bias. That doesn\u2019t change because someone who is White, and who perpetrated violence against Black people, is put to death,\u201d said Maya Wiley, president of the Leadership Conference on Civil and Human Rights.<\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p><span class=\"font--article-body font-copy hide-for-print ma-0 pb-md db italic interstitial\"><a target=\"_blank\" data-qa=\"interstitial-link\" href=\"https:\/\/www.washingtonpost.com\/nation\/2022\/07\/02\/oklahoma-25-executions\/?itid=lk_interstitial_manual_7\" rel=\"noopener\">Oklahoma plans to execute an inmate nearly every month until 2025<\/a><\/span><\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">President Biden opposed the death penalty during his 2020 campaign, but he has not pushed forcefully for a blanket federal ban on executions since taking office. His administration is under pressure to do more to confront rising white supremacy, a spike in hate crimes and a wave of gun violence.<\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">While Garland\u2019s moratorium does not ban prosecutors from seeking the death penalty, the Justice Department has not filed a notice to seek capital punishment under his leadership, officials said.<\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Experts said Garland\u2019s decision in Buffalo could send a strong signal to state legislatures. Twenty-three states have <a target=\"_blank\" href=\"https:\/\/deathpenaltyinfo.org\/facts-and-research\/dpic-reports\/dpic-year-end-reports\/the-death-penalty-in-2021-year-end-report\" rel=\"noopener\">abolished the death penalty<\/a>, while three \u2014 Oregon, Pennsylvania and California \u2014 have a moratorium against it, according to the nonprofit Death Penalty Information Center. Robert Dunham, executive director of that center, said data suggests the death penalty is not a deterrent to homicides or mass shootings, given higher murder rates in many states that allow executions.<\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">\u201cThe White House has expressed a preference to do away with the federal death penalty, but it hasn\u2019t set a policy,\u201d Dunham said. \u201cIn the absence of a policy, [Garland] has to decide, and there are countervailing interests.\u201d<\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p><span class=\"font--article-body font-copy hide-for-print ma-0 pb-md db italic interstitial\"><a target=\"_blank\" data-qa=\"interstitial-link\" href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/07\/04\/fatal-shooting-independence-day-parade\/?itid=lk_interstitial_manual_13\" rel=\"noopener\">Shooting at July 4 parade in suburban Chicago kills at least six, wounds dozens<\/a><\/span><\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Federal prosecutors have charged Gendron with 26 hate crime counts. But it is an additional gun-related charge that carries the potential penalty of death. He also faces state-level first-degree murder and hate crimes charges in New York, which does not allow state-sponsored executions.<\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">In a statement, White House spokesman Abdullah Hasan said Biden supports Garland\u2019s moratorium and has been clear about his concerns over whether the death penalty is \u201cconsistent with the values fundamental to our sense of justice and fairness.\u201d But Biden also believes the Buffalo shooter must be held accountable for \u201cthe racially-motivated act of domestic terrorism.\u201d<\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p><span class=\"font--article-body font-copy hide-for-print ma-0 pb-md db italic interstitial\"><a target=\"_blank\" data-qa=\"interstitial-link\" href=\"https:\/\/www.washingtonpost.com\/nation\/2022\/07\/03\/akron-police-jayland-walker-video\/?itid=lk_interstitial_manual_17\" rel=\"noopener\">Videos show Akron police shot Black man dozens of times<\/a><\/span><\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">At Gendron\u2019s initial court appearance, U.S. Magistrate Judge H. Kenneth Schroeder assigned him a federal public defender and highlighted the higher taxpayer costs associated with capital cases, which require more legal expertise.<b> <\/b>He urged the Justice Department to make a relatively quick decision on whether to pursue the death penalty. U.S. officials say the decision process could take a year or more.<\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">During a<a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/national-security\/2022\/06\/15\/buffalo-gendron-federal-hate-crimes\/?itid=lk_inline_manual_20\" rel=\"noopener\"> June trip to Buffalo<\/a>, Garland said prosecutors will follow long-standing protocols to make their recommendation, which requires his approval, and that they will seek input from the survivors and victims\u2019 families. \u201cWe view confronting hate crimes as both a legal and moral obligation,\u201d Garland said.<\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Making matters more complex, some of the attorneys representing the families are advocates who vocally oppose the death penalty, including Ben Crump, a prominent civil rights attorney, and Terrence M. Connors, a Buffalo trial lawyer. So do some of Garland\u2019s top deputies, including <a target=\"_blank\" href=\"https:\/\/civilrights.org\/2019\/07\/25\/the-death-penalty-has-no-place-in-the-united-states\/\" rel=\"noopener\">Associate Attorney General Vanita Gupta<\/a>, who joined him in Buffalo.<\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">In 2020, Gupta, then serving as the head of the Leadership Conference, tweeted, <a target=\"_blank\" href=\"https:\/\/twitter.com\/vanitaguptacr\/status\/1337235793891516418\" rel=\"noopener\">\u201cAbolish the death penalty,\u201d<\/a> in reference to the case of Brandon Bernard, a Black man executed that year for his role in the 1999 abduction and murder of two White youth ministers in Fort Hood, Tex.<\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">\u201cThat was not my mother or father or son or daughter who was killed, so I would have to respect their wishes,\u201d Crump said of the Buffalo victims\u2019 families. \u201cBut I will be honest with them in terms of my opposition to the death penalty.\u201d<\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p><span class=\"font--article-body font-copy hide-for-print ma-0 pb-md db italic interstitial\"><a target=\"_blank\" data-qa=\"interstitial-link\" href=\"https:\/\/www.washingtonpost.com\/national-security\/2022\/02\/03\/arbery-plea-deal-racial-justice\/?itid=lk_interstitial_manual_24\" rel=\"noopener\">Federal prosecutors saw plea deal in Arbery killing as racial justice. His family disagreed.<\/a><\/span><\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Given Garland\u2019s moratorium on executions, Crump said, federal prosecutors \u201cwould have to explain their position as to why they are changing their stance\u201d if they seek death for the alleged Buffalo gunman.<\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">In 2020, after the Trump administration ended a 17-year hiatus for federal executions, the Death Penalty Information Center <a target=\"_blank\" href=\"https:\/\/deathpenaltyinfo.org\/facts-and-research\/dpic-reports\/in-depth\/enduring-injustice-the-persistence-of-racial-discrimination-in-the-u-s-death-penalty\" rel=\"noopener\">reported<\/a> that racial minorities have been overrepresented on death row and that the killers of White people were more likely than the killers of Black people to face the death penalty.<\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">In his memo last summer, Garland ordered a review of Trump administration changes to policies and procedures on lethal injection. That review is ongoing.<\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Garland gained national acclaim in the 1990s for <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/national-security\/merrick-garland-oklahoma-city-bombing\/2021\/02\/19\/a9e6adde-67f2-11eb-8468-21bc48f07fe5_story.html?itid=lk_inline_manual_29\" rel=\"noopener\">helping lead<\/a> the Justice Department\u2019s successful capital conviction of Oklahoma City bomber Timothy McVeigh, who was put to death in 2001. During his confirmation hearing last year, Garland said he stands by the outcome of that case but has since developed reservations over the death penalty.<\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p><span class=\"font--article-body font-copy hide-for-print ma-0 pb-md db italic interstitial\"><a target=\"_blank\" data-qa=\"interstitial-link\" href=\"https:\/\/www.washingtonpost.com\/lifestyle\/2022\/07\/03\/port-jefferson-firefighter-patterson-kasumi\/?itid=lk_interstitial_manual_30\" rel=\"noopener\">These high school seniors raced away from graduation to fight a fire<\/a><\/span><\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">At the hearing, Sen. Tom Cotton (R-Ark.) cited the case of Dylann Roof \u2014 a White man sentenced to death for fatally shooting nine Black parishioners at a church in Charleston, S.C., in 2015 \u2014 and asked whether Garland would pursue capital punishment in a similar case. Garland responded that it would depend on the Biden administration\u2019s policy.<\/p>\n<\/div>\n<div class=\"article-body grid-center grid-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">The Justice Department has continued to back Roof\u2019s death sentence, which was <a target=\"_blank\" href=\"https:\/\/www.politico.com\/news\/2021\/08\/25\/dylann-roof-death-penalty-charleston-506900\" rel=\"noopener\">upheld by a federal appellate court<\/a> last summer.
