(Martin Kidston\/Missoula Current file)<\/figcaption><\/figure>\n<p><span style=\"font-size: 14pt;\">An election-conspiracy group backed by a Trump-related think-tank is suing the Missoula County elections office over the 2020 election, even after local Republicans found no evidence of fraud.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">A week ago, John R. Lott and the Missoula County Election Integrity Project filed a\u00a0<a target=\"_blank\" href=\"https:\/\/www.documentcloud.org\/documents\/22079956-missoulaco-elections\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.documentcloud.org\/documents\/22079956-missoulaco-elections&amp;source=gmail&amp;ust=1657153491579000&amp;usg=AOvVaw30FsokoBRkzGnTqjnok016\">complaint<\/a> in Missoula County District Court against the Missoula County Elections Office for disposing video recordings and certain documents related to the November 2020 vote count. However, in previous challenges, the Elections Office has stated it followed Montana law and the group failed to make its request before the state deadline.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Missoula County communications manager Allison Franz said the county couldn\u2019t comment yet because the county elections office hadn\u2019t been served the complaint, so no one has seen it.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">In its complaint, the self-professed Election Integrity Project said it notified the elections office in October 2020 that it would use the vote-count video in its investigation of the Nov. 3 all-mail-in election. The state requires elections offices to keep video for 30 days. Missoula county\u2019s policy is to retain video for no more than 60 days to conserve server bandwidth, particularly after all meetings went online due to COVID.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">\u201cThe video was automatically destroyed after being retained for 30 days, meeting both the county and state retention policies. The request for video occurred after this 30-day time frame.\u201d<\/span><\/p>\n<p><strong><span style=\"font-size: 14pt;\">For past reading:<\/span><\/strong><\/p>\n<p><strong><span style=\"font-size: 14pt;\"><a target=\"_blank\" href=\"https:\/\/missoulacurrent.com\/government\/2022\/03\/missoula-voter-discrepencies\/\" rel=\"noopener\">Missoula County beams after GOP recount sinks allegations of ballot discrepancies \u2013 Missoula Current<\/a><\/span><\/strong><\/p>\n<p><strong><span style=\"font-size: 14pt;\"> <a target=\"_blank\" href=\"https:\/\/missoulacurrent.com\/government\/2022\/04\/missoula-elections-recount\/\" rel=\"noopener\">Missoula\u2019s elections supervisor vindicated by recount, frustrated by claims of fraud \u2013 Missoula Current<\/a><\/span><\/strong><\/p>\n<p><span style=\"font-size: 14pt;\">According to the complaint, the Project insists that vote-count video and other documents be preserved for 22 months, citing a federal law that requires elections officers to keep voter registrations and applications to vote for 22 months.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">The Project said it wanted to review the video because it claimed to have found a vote discrepancy that supported their claim of ballot stuffing. When it allowed access to the election ballots in January 2021, the Project claimed to have counted 4,592 more ballots than there were privacy envelopes, resulting in a 6% error.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">That\u2019s not what the Missoula County Republican Central Committee found when it <a target=\"_blank\" href=\"https:\/\/missoulacurrent.com\/government\/2022\/04\/missoula-elections-recount\/\" rel=\"noopener\">conducted its own\u00a0ballot coun<\/a>t\u00a0this March. The Central Committee found a discrepancy of 71 ballots, a margin of error of 0.09%.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">State Rep. Brad Tschida, a Project member, scoffed at the Central Committee\u2019s results in March, telling the Associated Press that \u201cany outcome other than the outcome of the first count would be highly suspicious.\u201d<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">The Project is still touting a 6% to 7% discrepancy in its court documents.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Missoula County elections administrator Bradley Seaman in March said that the election canvas board, the Secretary of State\u2019s Office and a post-election equipment audit would have found an error as large as 4,600 votes. If the results were really off so badly, the Project should have challenged them in court, Seaman said.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Now, the Project is taking the elections office to court, but it isn\u2019t challenging the results. In addition to video retention, the Project protested that the elections office said in May it wasn\u2019t keeping voter registration information from November 2020 if it had new data to update the information.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">The Project\u2019s claims are an example of the continuing fallout from former President Donald Trump\u2019s unfounded allegations of voter fraud after he lost the 2020 election. The allegations, dubbed \u201cThe Big Lie,\u201d sparked the insurrection at the U.S. Capitol on Jan. 6, 2021, and pro-Trump groups around the country have attacked U.S. elections by challenging various processes just enough to raise doubt and spend taxpayer dollars.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Montana\u2019s electoral-college delegation voted for Trump, so another 4,600 votes \u2013 had they existed \u2013 wouldn\u2019t have changed anything.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">The Missoula County Election Integrity Project lawsuit is being supported by the Washington, D.C.-based think-tank, America First Policy Institute. The America First Policy Institute was started by group of 40 former Trump administration officials three months after Trump left office,\u00a0<a target=\"_blank\" href=\"https:\/\/thehill.com\/blogs\/blog-briefing-room\/news\/547996-trump-alumni-launch-america-first-policy-institute\/\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/thehill.com\/blogs\/blog-briefing-room\/news\/547996-trump-alumni-launch-america-first-policy-institute\/&amp;source=gmail&amp;ust=1657153491579000&amp;usg=AOvVaw0-ocd3MMMVSEzMFKq9xdzh\" rel=\"noopener\">according to TheHill.com<\/a>. Institute attorney Joshua J. Campbell is listed on the court documents and was the Trump campaign\u2019s legal advisor during the 2016 campaign.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">As a 501(c)(3) nonprofit, the Institute is supposed to be nonpartisan, but Trump\u2019s daughter\u00a0Ivanka Trump\u00a0and her husband and former White House adviser\u00a0Jared Kushner\u00a0are informal advisers, according to Axios.\u00a0The Institute recently started working with \u201cAmerica First Works,\u201d which formed \u201cas a new organization to work closely with AFPI\u201d and as \u201can extension of\u00a0AFPI, it is entirely focused on\u00a0advancing\u00a0policy at all levels of government,\u00a0including\u00a0to promote\u00a0economic opportunity, school choice,\u00a0affordable\u00a0healthcare, foster care reform, election integrity, and criminal justice reform,\u201d\u00a0<a target=\"_blank\" href=\"https:\/\/www.cnbc.com\/2021\/11\/22\/trump-alumni-think-tank-joins-forces-with-america-first-works-dark-money-group.html\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.cnbc.com\/2021\/11\/22\/trump-alumni-think-tank-joins-forces-with-america-first-works-dark-money-group.html&amp;source=gmail&amp;ust=1657153491579000&amp;usg=AOvVaw0grkOywczm2B74t7AwIVbN\">according to<\/a>\u00a0Ashley Hayek, a Trump campaign veteran who has a leadership role at America First Works and is also chief engagement officer for the think tank.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">The Institute\u2019s priorities include criminal justice reforms, fighting back against Big Tech companies and lowering taxes. The group also lists \u201celection integrity\u201d as a priority, and it\u00a0<a target=\"_blank\" href=\"https:\/\/americafirstpolicy.com\/latest\/afpis-center-for-election-integrity-commends-texas-state-legislature-for-passing-common-sense-election-reforms\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/americafirstpolicy.com\/latest\/afpis-center-for-election-integrity-commends-texas-state-legislature-for-passing-common-sense-election-reforms&amp;source=gmail&amp;ust=1657153491579000&amp;usg=AOvVaw2Hd21H9o5TtOszymXlqPVc\">has supported<\/a>\u00a0voting laws recently passed in Texas that critics say restrict access to the ballot box.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Lott, 63, is apparently another of Montana\u2019s recent immigrants. Court documents say Lott voted in Missoula in the November 2020 election and has worked with the Project since then. But right after the election, he was reported as working as a grant programs researcher in the U.S. Department of Justice,\u00a0<a target=\"_blank\" href=\"https:\/\/www.politico.com\/news\/2020\/11\/24\/controversial-gun-advocate-justice-department-440251\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.politico.com\/news\/2020\/11\/24\/controversial-gun-advocate-justice-department-440251&amp;source=gmail&amp;ust=1657153491579000&amp;usg=AOvVaw3ti11YvlPv10TntaA5Omcg\">according to<\/a>\u00a0Politico.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Lott is best known as a pro-gun pundit, having written the 1998 book, \u201cMore Guns, Less Crime,\u201d and a slew of reports, articles and op-eds advocating for lifting gun control laws. Prior to that, he ran the nonprofit Crime Prevention Research Center, which regularly publishes pro-gun blog posts and has a board that features avid National Rifle Association supporters, former rocker Ted Nugent and David Clarke, former sheriff of Milwaukee County, Wis. He also bounced around several universities, teaching law and economics after earning his degrees from UCLA.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">But Lott occasionally veered into election-security issues before he landed in Missoula. After Trump\u00a0<a target=\"_blank\" href=\"https:\/\/www.politifact.com\/florida\/statements\/2017\/jun\/22\/ainsley-earhardt\/following-trump-voter-fraud-allegations-claim-57-m\/\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.politifact.com\/florida\/statements\/2017\/jun\/22\/ainsley-earhardt\/following-trump-voter-fraud-allegations-claim-57-m\/&amp;source=gmail&amp;ust=1657153491579000&amp;usg=AOvVaw2aG2biGPbxijNFfmbiljJB\">falsely<\/a>\u00a0claimed millions of Americans voted illegally in the 2016 presidential election, Lott\u00a0<a target=\"_blank\" href=\"https:\/\/www.thetrace.org\/newsletter\/trump-voter-fraud-panel-john-lott-nra\/\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.thetrace.org\/newsletter\/trump-voter-fraud-panel-john-lott-nra\/&amp;source=gmail&amp;ust=1657153491579000&amp;usg=AOvVaw1VcHKkBOiJX_bGkY8PxDxm\">appeared<\/a>\u00a0as a witness before Trump\u2019s \u201celection integrity\u201d commission in 2017 urging use of the national gun background check database to verify voter rolls. Lott also\u00a0<a target=\"_blank\" href=\"https:\/\/johnrlott.blogspot.com\/2016\/11\/looks-like-massive-vote-fraud-with.html\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/johnrlott.blogspot.com\/2016\/11\/looks-like-massive-vote-fraud-with.html&amp;source=gmail&amp;ust=1657153491579000&amp;usg=AOvVaw0H-8bOvEQPomz0xYuzfKBT\">alleged that<\/a>\u00a0absentee ballots in the 2016 North Carolina gubernatorial election were fraudulently handled. In a 2015 Fox News op-ed, he\u00a0<a target=\"_blank\" href=\"https:\/\/www.foxnews.com\/opinion\/what-al-frankens-election-tells-us\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.foxnews.com\/opinion\/what-al-frankens-election-tells-us&amp;source=gmail&amp;ust=1657153491579000&amp;usg=AOvVaw1Tw0BTAJXrSRpOKvw7UXu9\">claimed<\/a>\u00a0Sen. Al Franken won the 2008 Minnesota election only because felons were allowed to vote for him.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">None of the claims were substantiated.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Lott has been called out for playing loose with the truth when he was caught impersonating people on the Internet to support his claims. Much as Trump\u00a0<a target=\"_blank\" href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/onpolitics\/2016\/05\/13\/donald-trump-people-magazine-washington\/84333614\/\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.usatoday.com\/story\/news\/politics\/onpolitics\/2016\/05\/13\/donald-trump-people-magazine-washington\/84333614\/&amp;source=gmail&amp;ust=1657153491579000&amp;usg=AOvVaw1qAkZw7FujIaC6j--bJtlW\" rel=\"noopener\">posed as<\/a>\u00a0his own public relations employee John Miller, Lott used the pseudonym \u201cMary Rosh\u201d for three years to praise himself in the early 2000s,\u00a0<a target=\"_blank\" href=\"http:\/\/www.washingtonpost.com\/ac2\/wp-dyn\/A8884-2003Jan31\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=http:\/\/www.washingtonpost.com\/ac2\/wp-dyn\/A8884-2003Jan31&amp;source=gmail&amp;ust=1657153491579000&amp;usg=AOvVaw2lpSxR1zHQLxCerpAubayU\" rel=\"noopener\">according to<\/a>\u00a0the Washington Post. He also authored a pro-gun Fox News op-ed\u00a0<a target=\"_blank\" href=\"https:\/\/www.csgv.org\/whos-backing-last-pro-gun-academic\/\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.csgv.org\/whos-backing-last-pro-gun-academic\/&amp;source=gmail&amp;ust=1657153491579000&amp;usg=AOvVaw3wja9ye510kPUsQoul2D4K\" rel=\"noopener\">using the identity<\/a>\u00a0of stalking victim Taylor Woolrich.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">However, Lott is still publishing op-eds about Missoula in national publications like\u00a0<a target=\"_blank\" href=\"https:\/\/www.newsweek.com\/montana-ballot-audit-shows-risks-mail-vote-fraud-opinion-1580705\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.newsweek.com\/montana-ballot-audit-shows-risks-mail-vote-fraud-opinion-1580705&amp;source=gmail&amp;ust=1657153491579000&amp;usg=AOvVaw3kblfG_sblPRbNk33L_DQa\">Newsweek<\/a>, the conservative Heritage Foundation\u2019s The\u00a0<a target=\"_blank\" href=\"https:\/\/www.dailysignal.com\/author\/johnlott\/\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.dailysignal.com\/author\/johnlott\/&amp;source=gmail&amp;ust=1657153491579000&amp;usg=AOvVaw0gz0HmDVZGeXEVg4Gsoy74\">Daily Signal<\/a>, and\u00a0<a target=\"_blank\" href=\"https:\/\/thefederalist.com\/2022\/04\/18\/montanas-2020-election-irregularities-are-still-unaddressed-despite-recounts-gone-wrong-erased-records-and-suddenly-surfacing-ballots\/\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/thefederalist.com\/2022\/04\/18\/montanas-2020-election-irregularities-are-still-unaddressed-despite-recounts-gone-wrong-erased-records-and-suddenly-surfacing-ballots\/&amp;source=gmail&amp;ust=1657153491579000&amp;usg=AOvVaw0yy2iO7g1ogL7lP9TRAMWB\">The Federalist<\/a>, where he backs Tschida\u2019s conspiracy theory to explain the lack of fraud evidence by suggesting Missoula County messed with the ballots between the Project\u2019s count and that of the GOP committee.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">\u201cWithout the video, there is no way to determine how many envelopes were opened on November 3, 2020.
