{"id":34399,"date":"2022-08-02T20:30:00","date_gmt":"2022-08-02T20:30:00","guid":{"rendered":"https:\/\/cjstudents.com\/index.php\/2022\/08\/02\/justice-department-sues-idaho-over-abortion-law-in-first-legal-challenge-since-roes-reversal\/"},"modified":"2022-08-02T20:30:00","modified_gmt":"2022-08-02T20:30:00","slug":"justice-department-sues-idaho-over-abortion-law-in-first-legal-challenge-since-roes-reversal","status":"publish","type":"post","link":"https:\/\/cjstudents.com\/index.php\/2022\/08\/02\/justice-department-sues-idaho-over-abortion-law-in-first-legal-challenge-since-roes-reversal\/","title":{"rendered":"Justice Department sues Idaho over abortion law in first legal challenge since Roe&#8217;s reversal"},"content":{"rendered":"<p> [ad_1]<\/p>\n<div id=\"\">\n<p><em>Washington \u2014 <\/em>The Justice Department has filed a lawsuit challenging an Idaho law that outlaws nearly all abortions in the state, Attorney General Merrick Garland announced Tuesday, marking the first court fight mounted by the Biden administration after the Supreme Court <span class=\"link\"><a target=\"_blank\" href=\"https:\/\/www.cbsnews.com\/live-updates\/supreme-court-roe-v-wade-abortion-rights\/\" data-invalid-url-rewritten-http=\"\" rel=\"noopener\">eliminated the constitutional right<\/a><\/span> to an abortion in June.<\/p>\n<p>In a press conference announcing the <a target=\"_blank\" href=\"https:\/\/www.justice.gov\/opa\/press-release\/file\/1523481\/download?utm_medium=email&amp;utm_source=govdelivery\" rel=\"nofollow noopener\">new lawsuit<\/a>, Garland said Idaho&#8217;s law, which was enacted in 2020 and takes effect Aug. 25, violates the Constitution and is preempted by federal law, as it is in conflict with the Emergency Medical Treatment and Labor Act (EMTALA).\u00a0<\/p>\n<p>The Justice Department is asking a federal district court in Idaho to invalidate the so-called trigger law and block the state from enforcing it against medical providers.\u00a0<\/p>\n<aside class=\"newsletter_signup \">\n<figure class=\"embed embed--type-newsletter-widget embed--float-none embed--size-large embed--type-iframe\" data-ads=\"{\" wordcount=\"\">\n<\/figure>\n<\/aside>\n<p>&#8220;In the days since the Dobbs decision, there have been widespread reports of delays and denials of treatment to pregnant women experiencing medical emergencies. Today, the Justice Department&#8217;s message is clear: It does not matter what state a hospital subject to EMTALA operates in. If a patient comes to the emergency room with a medical emergency jeopardizing the patients&#8217; life or health, the hospital must provide the treatment necessary to stabilize that patient,&#8221; Garland said. &#8220;This includes abortion when that is the necessary treatment.&#8221;\u00a0<\/p>\n<p>Garland said that any state law that prevents a hospital from fulfilling obligations under EMTALA runs afoul of federal law, and the Idaho statute &#8220;seems on its face&#8221; to directly conflict with it. Brad Little called the lawsuit from the Justice Department &#8220;federal meddling&#8221; and defended the state&#8217;s law.<\/p>\n<p>&#8220;Our nation&#8217;s highest court returned the issue of abortion to the states to regulate \u2014 end of story,&#8221; he said in a statement. &#8220;The U.S. Justice Department&#8217;s interference with Idaho&#8217;s pro-life law is another example of Biden overreaching yet again while he continues to ignore issues that really should demand his attention \u2014 like crushing inflation and the open border with Mexico.&#8221;<\/p>\n<p>Idaho&#8217;s law makes it a felony to perform an abortion in most circumstances, and the Justice Department argues in its suit that the measure makes it a criminal offense for doctors to comply with EMTALA, which requires health care providers that receives Medicare funds to provide necessary stabilizing treatment to a mother whose health is at risk and must undergo an emergency abortion.<\/p>\n<p>Circumstances that may require a doctor to provide an abortion to stabilize a pregnant mother include ectopic pregnancy, severe preeclampsia or complication from pregnancy that threatens septic infection or hemorrhage, the Biden administration said.<\/p>\n<p>&#8220;Idaho&#8217;s law would make it a criminal offense for doctors to provide the emergency medical treatment that federal law requires,&#8221; Garland said. &#8220;Although the Idaho law provides an exception to prevent the death of a pregnant women, it includes no exception for cases in which the abortion is necessary to prevent serious jeopardy to the women&#8217;s health.&#8221;<\/p>\n<p>Lawrence Wasden, Idaho&#8217;s attorney general, faulted the department for failing to discuss the issue with Idaho officials and instead chose to file what he called &#8220;a politically motivated lawsuit.&#8221; Wasden said in a statement that a provision of the EMTALA does not preempt state law except in specific circumstances.<\/p>\n<p>&#8220;Instead of complying with the requirements of this provision and reconciling Idaho&#8217;s law with EMTALA, or even attempting to engage Idaho in a meaningful dialogue on the issue, the federal government has chosen to waste taxpayer dollars on an unnecessary lawsuit,&#8221; Wasden said.<\/p>\n<p>The lawsuit against the state of Idaho is the first brought by the Justice Department since the Supreme Court overturned Roe v.
