Ivey speaks at an event on Merritt Island for the 20th anniversary of the 9\/11 terror attacks in this 2021 file photo.\"\/><\/figure>\n<p class=\"gnt_ar_b_p\">Kimberly Musselman, an assistant state attorney in Brevard County for nearly 20 years,\u00a0told FLORIDA TODAY that\u00a0she was pursued by Ivey in May to bow out of the County Court Judge Group 4 race. Ivey has endorsed one of Musselman\u2019s opponents, victims rights attorney Renee Torpy.<\/p>\n<p class=\"gnt_ar_b_p\">Musselman reached out to FLORIDA TODAY after reading about Hattaway&#8217;s and Overdorf&#8217;s experiences. She said her decision to come forward was a matter of her integrity as a candidate for judge,\u00a0even though it meant\u00a0denouncing inappropriate behavior by a powerful and well-loved figure like Ivey.<\/p>\n<aside aria-label=\"advertisement\" class=\"gnt_m gnt_x gnt_x__lbl gnt_x__al\"\/>\n<p class=\"gnt_ar_b_p\">During two in-person meetings, Musselman said, Ivey repeatedly said\u00a0he could \u00a0use his influence to help her get elected \u2014\u00a0or even appointed \u2014\u00a0as state attorney for the 18th\u00a0judicial circuit, the office currently held by her boss, State Attorney Phil Archer, if she abandoned her bid for the judicial seat.<\/p>\n<p class=\"gnt_ar_b_p\">Musselman was blunt when\u00a0describing the meetings with Ivey to FLORIDA TODAY: &#8220;He said (consider) not running, and I will help you be appointed state attorney,&#8221; she recalled.<\/p>\n<aside class=\"gnt_em gnt_em_anc\" id=\"gnt_atomsnc\" data-g-r=\"lazy\" data-gl-method=\"loadAnc\" aria-label=\"Newsletter signup form\"\/>\n<p class=\"gnt_ar_b_p\">After Musselman refused, she said\u00a0Ivey admonished one of her major supporters, a senior government lawyer,<strong>\u00a0<\/strong>who endorsed her for the seat and donated to her campaign, while another donor, a high-ranking government official,\u00a0reportedly had their<strong\/> name &#8220;trashed,&#8221;\u00a0she said.\u00a0<\/p>\n<p class=\"gnt_ar_b_p\">&#8220;My donors dried up real quick,&#8221;\u00a0Musselman said.<\/p>\n<p class=\"gnt_ar_b_p\">Several attempts to reach both individuals by FLORIDA TODAY were\u00a0unanswered. But<strong>\u00a0<\/strong>similar allegations of donors being pressured have been\u00a0made by Hattaway, too.<strong>\u00a0<\/strong>Hattaway told FLORIDA TODAY\u00a0last week that\u00a0since his story about being asked to leave the race went public, Ivey and his allies have approached some of his donors in what he described as a backdoor effort to rob him of support.<\/p>\n<p class=\"gnt_ar_b_p\">Ivey did not respond to multiple interview requests for this story.<\/p>\n<p class=\"gnt_ar_b_p\">As with the cases described by Hattaway and Overdorf, Ivey\u2019s alleged offer to Musselman could amount to a felony violation of Florida\u2019s elections code. For some ethics experts, it also raises\u00a0questions about the independence of Brevard&#8217;s courts from its largest policing agency.<\/p>\n<p class=\"gnt_ar_b_p\">&#8220;It&#8217;s troubling that\u00a0a sheriff would involve himself in a judicial race,&#8221; said Ben Wilcox, research director for Integrity Florida, a\u00a0nonpartisan Tallahassee government watchdog group.<\/p>\n<p class=\"gnt_ar_b_p\">Ivey \u2014\u00a0whose\u00a0brand of &#8220;Constitutional Sheriff&#8221;\u00a0has <a target=\"_blank\" href=\"\/story\/news\/2021\/03\/05\/wheel-of-fugitive-how-sheriff-iveys-facebook-show-stretches-truth\/6891819002\/\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\" class=\"gnt_ar_b_a\">drawn controversy for its brash, defiant and at times cavalier attitude toward people accused of crimes<\/a> in Brevard \u2014\u00a0has long maintained that elected offices at all levels of government should be aligned ideologically and politically,\u00a0from the sheriff all the way to the School Board.<\/p>\n<p class=\"gnt_ar_b_p\">That has included the courts in recent months, with Ivey warning on social media that Brevard County will not accept what he has called &#8220;soft judges&#8221;\u00a0on the bench.<\/p>\n<aside aria-label=\"advertisement\" class=\"gnt_m gnt_x gnt_x__lbl gnt_x__al\"\/>\n<h2 class=\"gnt_ar_b_h2\">Judge candidate doesn&#8217;t have Ivey endorsement<\/h2>\n<p class=\"gnt_ar_b_p\">Musselman\u00a0has more than 30 years\u00a0of law enforcement experience in her career, including serving as a parole officer\u00a0and law clerk, and nearly two decades in the Brevard and Seminole Counties State Attorney\u2019s Office, where she was first hired as an assistant state attorney in 2004.<\/p>\n<p class=\"gnt_ar_b_p\">Her efforts in the agency \u2014\u00a0which have included training dozens of new attorneys and legal interns, reviewing hundreds of arrest and search warrants and participating in grand jury presentations, she said \u2014\u00a0have helped her earn endorsements from a Who\u2019s Who of current and former Brevard officials.<\/p>\n<p class=\"gnt_ar_b_p\">Among her supporters in the county judge race are Archer, former Clerk of Courts Scott Ellis, current Clerk of Courts Rachel Sadoff, property appraiser Dana Blickley and tax collector Lisa Cullen.<\/p>\n<p class=\"gnt_ar_b_p\">The one endorsement she\u00a0doesn\u2019t have\u00a0is Ivey\u2019s. Not that she didn\u2019t want it, she said.<\/p>\n<p class=\"gnt_ar_b_p\">&#8220;I think some of the things he does are fantastic,\u201d Musselman said. \u201cHe brings in a lot of people (to local charities), he brings in a lot of money. The dog stuff (he supports). He&#8217;s creative.&#8221;<\/p>\n<p class=\"gnt_ar_b_p\">Musselman said she intended to ask Ivey for his support when they first met to talk about her campaign the afternoon of May 20\u00a0at Kays Bar-B-Que and Steaks near Cocoa. The meeting was his idea, she said. The sheriff had sought her out for days, including\u00a0multiple calls and texts from his assistant, Musselman said.<\/p>\n<p class=\"gnt_ar_b_p\">&#8220;It did seem like it was very important that we meet very quickly, all of a sudden,\u201d she said.<\/p>\n<aside aria-label=\"advertisement\" class=\"gnt_m gnt_x gnt_x__lbl gnt_x__al\"\/>\n<p class=\"gnt_ar_b_p\">But when they finally got together, it wasn\u2019t to discuss his endorsement. He had already promised that to Torpy, he told her. Instead, Musselman said, Ivey tried to talk her out of the county court race.<\/p>\n<p class=\"gnt_ar_b_p\">&#8220;He let me kind of go through my pitch. Then he said, &#8216;Oh, you need to be circuit court. Why didn&#8217;t you come out to be circuit court earlier?&#8217;\u201d she said. \u201cThen he started talking about state attorney and said, &#8216;You&#8217;d be great at that.\u201d<\/p>\n<p class=\"gnt_ar_b_p\">\u201cHe was saying, \u2018Get out of this race. This race isn&#8217;t worthy of you,\u2019 was the inference,\u201d Musselman said. &#8220;The whole conversation was, &#8216;You are better suited to these two things. I can help you with these two things.\u2019\u201d<\/p>\n<figure class=\"gnt_em gnt_em_img\"><img class=\"gnt_em_img_i\" style=\"height:607px\" data-g-r=\"lazy\" src=\"https:\/\/www.gannett-cdn.com\/presto\/2022\/07\/26\/PBRE\/abfe2230-281c-48ee-96ba-4a49d5a5c50e-KImberly_Musselman_3.JPG?width=660&amp;height=607&amp;fit=crop&amp;format=pjpg&amp;auto=webp\" srcset=\"https:\/\/www.gannett-cdn.com\/presto\/2022\/07\/26\/PBRE\/abfe2230-281c-48ee-96ba-4a49d5a5c50e-KImberly_Musselman_3.JPG?width=1320&amp;height=1214&amp;fit=crop&amp;format=pjpg&amp;auto=webp 2x\" decoding=\"async\" alt=\"County Judge Group 4 candidate Kimberly Musselman at a July 25 judicial candidate forum hosted by the North Brevard Democratic Club at Dixie Crossroads in Titusville.\"\/><\/figure>\n<p class=\"gnt_ar_b_p\">The meeting, which Musselman said lasted about two hours, ended with Ivey asking her to \u201cthink about it,\u201d she said. \u201cHe said he wanted to talk to me in a couple of days to see if I changed my mind.\u201d<\/p>\n<h2 class=\"gnt_ar_b_h2\">Sheriff gave no specifics on proposed\u00a0 &#8216;help&#8217;\u00a0<\/h2>\n<p class=\"gnt_ar_b_p\">The sheriff left on a trip to the U.S. border in Arizona that weekend, she said. After he returned, they met again on a Tuesday at Panera Bread in Viera. That\u2019s when he laid the offer on the table, she said.<\/p>\n<p class=\"gnt_ar_b_p\">&#8220;He said (consider) not running, and I will help you be appointed state attorney,&#8221; Musselman\u00a0said. \u201cThat&#8217;s when I said, &#8216;No, absolutely not.'&#8221;<\/p>\n<p class=\"gnt_ar_b_p\">While she wasn\u2019t clear on the context of the statement \u2014\u00a0state attorneys are elected positions, and typically only appointed when a sitting attorney resigns before their term of office ends \u2014\u00a0Musselman emphasized Ivey &#8220;meant &#8216;appointment,&#8217;\u00a0for sure,&#8221;\u00a0she said.<\/p>\n<p class=\"gnt_ar_b_p\">&#8220;He used both words, &#8216;appointed&#8217;\u00a0and &#8216;elected,'&#8221;\u00a0she said.<\/p>\n<p class=\"gnt_ar_b_p\">Musselman said\u00a0Ivey didn&#8217;t explain the context and\u00a0gave no specifics about the kind of &#8220;help&#8221;\u00a0he was proposing. For her part, she said, she didn\u2019t believe him.<\/p>\n<aside aria-label=\"advertisement\" class=\"gnt_m gnt_x gnt_x__lbl gnt_x__al\"\/>\n<p class=\"gnt_ar_b_p\">&#8220;I didn\u2019t believe for a second that he would have me appointed as state attorney. He just wanted me out of the race,&#8221;\u00a0Musselman said. &#8220;I think he saw me as a threat&#8221;\u00a0to Torpy, she said.<\/p>\n<p class=\"gnt_ar_b_p\">Still, she felt uneasy about the offer, she said. She was reluctant to talk about it at first \u2014\u00a0&#8220;I want to self-preserve a bit. I don\u2019t know what the repercussions will be,&#8221;\u00a0Musselman said \u2014\u00a0but said in the end she felt it was &#8220;the right thing to do.&#8221;<\/p>\n<p class=\"gnt_ar_b_p\">&#8220;I don\u2019t want this to be about me bashing (Ivey)&#8221;\u00a0or about seeking publicity, she said. She later added: &#8220;I will stand up for what&#8217;s right even if I am standing alone.&#8221;<\/p>\n<p class=\"gnt_ar_b_p\">&#8220;This is the point: As a judge I want to be fair and just and do the right thing, and how can I do that if I take this?&#8221; Musselman said.<\/p>\n<p class=\"gnt_ar_b_p\"><strong class=\"gnt_ar_b_al\">Candidates speak out:<\/strong><a target=\"_blank\" href=\"\/story\/news\/2022\/07\/15\/brevard-candidates-discuss-sheriffs-alleged-election-meddling\/10066812002\/\" rel=\"noopener\" data-t-l=\":b|e|spike click:50|${u}\" class=\"gnt_ar_b_a\">Candidates hold news conference about alleged job offers from sheriff if they agreed to leave races<\/a><\/p>\n<h2 class=\"gnt_ar_b_h2\">A felony offer?<\/h2>\n<p class=\"gnt_ar_b_p\">While some ethics and legal experts have said offers of jobs and appointments worth many tens of thousands of dollars could constitute felony bribery, there are other violations, including at least one other felony, that more directly address the\u00a0alleged actions of the sheriff.<\/p>\n<p class=\"gnt_ar_b_p\">If Ivey intended to eliminate competition for his endorsed candidate, according to\u00a0Wilcox of Integrity Florida, it could qualify as a misuse of public position under the Florida elections code.<\/p>\n<p class=\"gnt_ar_b_p\">Misuse of position, which prohibits elected officials from \u201ccorruptly\u201d using their influence to gain a \u201cspecial benefit\u201d for themselves or someone else, is usually a civil violation, punishable by fines and other administrative disciplinary actions.<\/p>\n<aside aria-label=\"advertisement\" class=\"gnt_m gnt_x gnt_x__lbl gnt_x__al\"\/>\n<p class=\"gnt_ar_b_p\">More seriously, it may have run afoul of F.S. 104.071, a statute in the elections code barring &#8220;remuneration&#8221;\u00a0by a candidate \u2013 or a supporter of a candidate \u2013 for services or support, a third-degree felony.<\/p>\n<p class=\"gnt_ar_b_p\">Among its provisions, and with some exceptions, the law prohibits supporters from promising to secure or help in securing appointment or election to public office to any person in order to aid the election of another candidate.<\/p>\n<p class=\"gnt_ar_b_p\">Tallahassee elections attorney Ronald Meyer, who did not comment for this story due to a potential conflict of interest, referenced the statute during an interview for a prior story about the allegations from Hattaway and Overdorf.<\/p>\n<p class=\"gnt_ar_b_p\">Such promises, he said, rose above mere pledges of future support, which are a legal and common fixture in politics.<\/p>\n<p class=\"gnt_ar_b_p\">&#8220;I think it\u2019s pretty specious in terms of the contribution or value of what\u2019s being promised,&#8221;\u00a0Meyer previously<strong\/> said. &#8220;And yet, it\u2019s illegal in any election to directly or indirectly promise to appoint another person, or promise to secure or aid in securing appointment or election of another person. Both made significant donations to her campaign.<\/p>\n<p class=\"gnt_ar_b_p\">The lawyer told her that Ivey had reached out and encouraged them<strong\/> to back away from her, she said, allegedly warning them\u00a0that they &#8220;didn\u2019t want to make enemies.&#8221;<\/p>\n<p class=\"gnt_ar_b_p\">Neither individual\u00a0responded to multiple requests for comment.\u00a0FLORIDA TODAY has decided not to \u00a0the donors\u00a0as they are appointed officials who did not agree tell their side of the story.<\/p>\n<p class=\"gnt_ar_b_p\"><strong class=\"gnt_ar_b_al\">Wheel of Fugitive?:<\/strong><a target=\"_blank\" href=\"\/story\/news\/2021\/03\/05\/wheel-of-fugitive-how-sheriff-iveys-facebook-show-stretches-truth\/6891819002\/\" rel=\"noopener\" data-t-l=\":b|e|spike click:67|${u}\" class=\"gnt_ar_b_a\">Sheriff Ivey&#8217;s signature Facebook &#8216;show&#8217; features non-fugitives<\/a><\/p>\n<p class=\"gnt_ar_b_p\">But her campaign financing record supports\u00a0that Musselman&#8217;s campaign funding indeed &#8220;dried up&#8221; after rebuffing Ivey.\u00a0Not counting loans to herself, campaign finance records\u00a0show she pulled in $8,300 in the weeks before the May meetings.<strong\/> Since then, as of July 18, she had reported only $4,150.<\/p>\n<p class=\"gnt_ar_b_p\">She is not the only candidate this election cycle to allege similar tactics by Ivey and his allies.<\/p>\n<p class=\"gnt_ar_b_p\">Cocoa police officer and District 2\u00a0County Commission contender\u00a0Chris Hattaway said since\u00a0FLORIDA TODAY reported that\u00a0Ivey asked him to step aside for the sheriff&#8217;s\u00a0favored candidate, former State Rep. Tom Goodson, he has heard from at least three donors who said they received calls from Ivey or Goodson.<\/p>\n<p class=\"gnt_ar_b_p\">The donors \u2014 one elected official and two prominent local businessmen, Hattaway said\u00a0\u2014 described the calls as attempts to undermine his account of the sheriff&#8217;s offer or, in some cases, openly get\u00a0them to reconsider their support before the Aug. 23rd primary, he said.<\/p>\n<p class=\"gnt_ar_b_p\">\u201cHe (Ivey) is going about it by calling my donors and supporters and saying, &#8216;Chris made a mistake, but I am not going to say anything about it,'&#8221;\u00a0Hattaway said, quoting what his supporters told him. He called the efforts &#8220;damage control&#8221; in the wake of the article, but\u00a0said there is no doubt\u00a0in his mind it was meant to have a\u00a0chilling effect on support for his campaign.<\/p>\n<p class=\"gnt_ar_b_p\">Among the donors who were contacted, according to Hattaway, was Cocoa Mayor Michael Blake. Hattaway said that Blake called him a few weeks ago to tell him that he had been contacted by Goodson.<\/p>\n<p class=\"gnt_ar_b_p\">According to Hattaway, Blake said Goodson wanted to know why he, Blake, a Democrat, was supporting Hattaway, a\u00a0Republican,\u00a0and asked for a meeting\u00a0to get him to &#8220;rethink that.&#8221;<\/p>\n<p class=\"gnt_ar_b_p\">Blake told FLORIDA TODAY a meeting with Goodson did occur, in which they spoke about &#8220;concerns for the city of Cocoa,&#8221; including housing needs and other issues, he said.<\/p>\n<p class=\"gnt_ar_b_p\">After initially telling a reporter Hattaway wasn&#8217;t a subject of the conversation, Blake asked if he was being quoted and said he did tell Goodson he endorsed Hattaway in the race, but denied Goodson had asked him to change his support.<\/p>\n<p class=\"gnt_ar_b_p\">When asked about the call, Goodson responded: \u201cNo comment, no comment, no comment. Next question.\u201d<\/p>\n<p class=\"gnt_ar_b_p\">According to Matthew Kachergus, a civil rights attorney in Jacksonville, if Goodson did call Blake to shift\u00a0his support, it was most likely &#8220;fair game politics.&#8221;\u00a0\u00a0&#8220;If he&#8217;s just trying to change his mind, I don&#8217;t really see a problem with that,&#8221; Kachergus said.\u00a0<\/p>\n<p class=\"gnt_ar_b_p\">The allegations involving\u00a0Ivey, however, are\u00a0a different matter, he said.<\/p>\n<p class=\"gnt_ar_b_p\">Kachergus said when a state actor\u00a0tries directing people how to express their political rights, &#8220;just the nature of the request is going to have a chilling effect.&#8221;\u00a0That could cross the line into a First Amendment violation, or\u00a0even an outright crime,\u00a0depending on the context and\u00a0specifics of the case \u2014\u00a0particularly if some form of retaliation is later involved, Kachergus added.<\/p>\n<p class=\"gnt_ar_b_p\">&#8220;Whenever a chief law enforcement officer in a jurisdiction is trying to dissuade people from exercising their First Amendment rights, it certainly smells problematic,&#8221; he said.<\/p>\n<figure class=\"gnt_em gnt_em_img\"><img class=\"gnt_em_img_i\" style=\"height:489px\" data-g-r=\"lazy\" src=\"https:\/\/www.gannett-cdn.com\/presto\/2022\/07\/15\/PBRE\/a787693b-2ce2-4ddd-bd18-451d064f9d8c-Hattaway-Overdorf.JPG?width=660&amp;height=489&amp;fit=crop&amp;format=pjpg&amp;auto=webp\" srcset=\"https:\/\/www.gannett-cdn.com\/presto\/2022\/07\/15\/PBRE\/a787693b-2ce2-4ddd-bd18-451d064f9d8c-Hattaway-Overdorf.JPG?width=1320&amp;height=978&amp;fit=crop&amp;format=pjpg&amp;auto=webp 2x\" decoding=\"async\" alt=\"District 2 County Commission candidate Chris Hattaway (foreground) and District 2 School Board candidate Shawn Overdorf met with the media Friday morning to discuss the sheriff's phone call and alleged job offers.\"\/><\/figure>\n<h2 class=\"gnt_ar_b_h2\">&#8216;Right people into every office&#8217;<\/h2>\n<p class=\"gnt_ar_b_p\">Ivey has stated that elected officials at all levels of government \u2014\u00a0from sheriff to school board to county and city offices \u2014\u00a0should share similar values and views. In practice, that has usually meant his own set\u00a0of constitutional values.<\/p>\n<p class=\"gnt_ar_b_p\">&#8220;I think we may have to make sure that we&#8217;re putting the right people into office. Into every office,&#8221;\u00a0Ivey said on an April 30, 2021, episode of the conservative podcast Liberty Monks. &#8220;We put focus and vigilance on some what we deem are the more important offices, maybe it&#8217;s sheriff, maybe it&#8217;s prosecutor. We often don&#8217;t put that same thought process and diligence into our judicial elections, into our school board elections, into our municipal elections.&#8221;<\/p>\n<p class=\"gnt_ar_b_p\">&#8220;And what we find is people that aren&#8217;t standing up for the Constitution,&#8221;\u00a0he said. &#8220;We&#8217;ve got to get back to thinking across the board that every elected office is important.&#8221;<\/p>\n<p class=\"gnt_ar_b_p\">Publicly, Ivey has framed his own judicial endorsements around his particular views of &#8220;law and order,&#8221;\u00a0imploring constituents to vote for judges that share what he has called his &#8220;no tolerance&#8221;\u00a0attitude on crime.<\/p>\n<p class=\"gnt_ar_b_p\">&#8220;NOW MORE THAN EVER WE NEED TO MAKE SURE WE ARE ELECTING STRONG CONSERVATIVE JUDGES TO THE BENCH!!&#8221;\u00a0Ivey wrote in a March 1 Facebook post. Judicial candidates should be willing to impose maximum sentences and &#8220;throw the key away&#8221;\u00a0on people convicted of crimes, he said, and high bonds to keep those accused but not yet convicted in jail.<\/p>\n<p class=\"gnt_ar_b_p\">&#8220;If you want to know who to vote for in a Judges race that is going to protect your community&#8230;ask your Sheriff!!&#8221;\u00a0he wrote.<\/p>\n<p class=\"gnt_ar_b_p\">Ivey&#8217;s political maneuvering, while not a secret in Brevard, mystifies some experts.<\/p>\n<p class=\"gnt_ar_b_p\">In his 10 years at the helm of the nonpartisan research institute, Wilcox of Integrity Florida said, he couldn\u2019t recall a case of a county sheriff exerting so much control over candidates \u2014\u00a0much less trading support for political favors.<\/p>\n<p class=\"gnt_ar_b_p\">It is legal in Florida for law enforcement leaders to endorse judges for office and engage in other political activities. Still, Wilcox said the extent of Ivey\u2019s involvement in judicial races was \u201ctroubling,\u201d leaving open the door to questions about the independence \u2014\u00a0and ultimately, the integrity \u2014\u00a0of the county courts.<\/p>\n<p class=\"gnt_ar_b_p\">&#8220;The sheriff is going to have to potentially arrest people that would then be prosecuted before that judge,&#8221;\u00a0Wilcox said. &#8220;It violates the spirit of the (Constitutional) separation of powers &#8230; And I think it raises really troubling questions about use of political influence.&#8221;<\/p>\n<p class=\"gnt_ar_b_p\">Incentivizing candidates to drop out of races is problematic precisely because it prioritizes the will of the powerful few over the will of the people, he said.<\/p>\n<p class=\"gnt_ar_b_p\">&#8220;He&#8217;s depriving the public of the choices in elections,&#8221;\u00a0Wilcox said. &#8220;That&#8217;s not fair to the voters. The voters are supposed to make those kinds of choices.&#8221;<\/p>\n<p class=\"gnt_ar_b_p\">Musselman feels the same way.<\/p>\n<p class=\"gnt_ar_b_p\">In Brevard politics, \u201cthere is no level playing field from the start,&#8221; she said. &#8220;There&#8217;s no reason to have an election if one person gets to choose who runs, and what they run for and when they run.&#8221;<\/p>\n<p class=\"gnt_ar_b_p\"><em>Eric Rogers is a watchdog reporter for FLORIDA TODAY.
