{"id":34980,"date":"2022-08-19T23:41:00","date_gmt":"2022-08-19T23:41:00","guid":{"rendered":"https:\/\/cjstudents.com\/index.php\/2022\/08\/19\/advocates-push-to-change-oregons-policy-for-hate-crime-suspects\/"},"modified":"2022-08-19T23:41:00","modified_gmt":"2022-08-19T23:41:00","slug":"advocates-push-to-change-oregons-policy-for-hate-crime-suspects","status":"publish","type":"post","link":"https:\/\/cjstudents.com\/index.php\/2022\/08\/19\/advocates-push-to-change-oregons-policy-for-hate-crime-suspects\/","title":{"rendered":"Advocates push to change Oregon&#8217;s policy for hate crime suspects"},"content":{"rendered":"<p> [ad_1]<\/p>\n<p>A Criminal Justice Advisory subcommittee supported changing the policy so people charged with first-degree bias crime are not released before appearing in court.<\/p>\n<div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>PORTLAND, Ore. \u2014 Asian American groups, prosecutors and crime victims are pushing to change a statewide policy that allowed a man to be <a target=\"_blank\" href=\"https:\/\/www.kgw.com\/article\/news\/crime\/police-search-for-anti-asian-attack-suspect\/283-ffb324e2-71a2-42b0-a6a0-7587299f71e2\" rel=\"noopener noreferrer\">released from jail<\/a> immediately after being booked on a first-degree bias crime in Portland last month.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>Portland police say Dylan Kesterson punched a father and his 5-year-old daughter in a racially motivated attack in early July. Both victims are of Japanese descent.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>Kesterson has since been accused of at least three prior racist attacks in downtown Portland.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>On Monday, a Criminal Justice Advisory Pretrial Subcommittee supported changing the policy so that people who are charged with first-degree bias crime are not released before their case is heard by a judge.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p><strong class=\"cms__embed-related-story\">RELATED: <a target=\"_blank\" class=\"cms__embed-related-story__link\" href=\"https:\/\/www.kgw.com\/article\/news\/crime\/suspect-charged-3rd-bias-crime\/283-d049b217-5536-493c-aa9c-6641b1287b8b\" rel=\"noopener\">Suspect in anti-Asian attacks in Portland charged with a 3rd bias crime<\/a><\/strong><\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>The <a target=\"_blank\" href=\"https:\/\/www.scribd.com\/document\/587958844\/ODAA-CJAC-Bias-Crime-Request\" rel=\"noopener noreferrer\">Oregon District Attorney\u2019s Association<\/a> called for the &#8220;immediate and urgent&#8221; change in statewide policy following Kesterson\u2019s release from jail.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>In a <a target=\"_blank\" href=\"https:\/\/www.scribd.com\/document\/587958943\/JACL-Letter\" rel=\"noopener noreferrer\">letter<\/a> sent to the Criminal Justice Advisory Committee, the Portland Japanese American Citizens League argued that people arrested on a bias crime should remain in custody until arraignment because of the danger they present to the community.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>\u201cWe call on our courts to take bias crimes and public safety seriously. Communities should no longer constantly feel threatened by the \u2018catch &amp; release\u2019 of such perpetrators,\u201d wrote Portland JACL in the letter, which was signed by 15 other Asian American organizations.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>Any change to the court\u2019s release policy would require an order by Oregon Supreme Court Chief Justice Martha Walters, followed by amended guidelines for each circuit court.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p><strong class=\"cms__embed-related-story\">RELATED: <a target=\"_blank\" class=\"cms__embed-related-story__link\" href=\"https:\/\/www.kgw.com\/article\/news\/investigations\/oregon-pretrial-release-and-detention-standards\/283-1aebf1c7-681b-41cf-a1a1-07e4b10cd58b\" rel=\"noopener\">Why the man accused of violently attacking an Asian family in Portland got out of jail the same day he was arrested<\/a><\/strong><\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>Portland police arrested Kesterson, 34, on July 2 after he allegedly yelled anti-Asian slurs and assaulted the man and his daughter along the Eastbank Esplanade.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>After being booked on first-degree bias crime, Oregon\u2019s most serious hate crime, Kesterson was told to call into a court hearing the following week and then allowed to walk free. Kesterson had no prior criminal history in Oregon.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>He failed to show up for a subsequent court hearing, then was was re-arrested on July 6. He pleaded not guilty.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>Kesterson\u2019s release back onto the streets just hours after the alleged attack sparked citywide outrage. Portland Mayor Ted Wheeler demanded a review of the criminal justice system.\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_embed\">\n<blockquote class=\"twitter-tweet\" data-dnt=\"true\" align=\"center\">\n<p lang=\"en\" dir=\"ltr\">I am outraged over the bias crime incident that happened last weekend, and the shortcomings of the criminal justice system during what followed. <a target=\"_blank\" href=\"https:\/\/t.co\/MrizZDFShx\" rel=\"noopener\">pic.twitter.com\/MrizZDFShx<\/a><\/p>\n<p>\u2014 Mayor Ted Wheeler (@tedwheeler) <a target=\"_blank\" href=\"https:\/\/twitter.com\/tedwheeler\/status\/1545170545649393666?ref_src=twsrc%5Etfw\" rel=\"noopener\">July 7, 2022<\/a><\/p><\/blockquote><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>In a statement, city commissioner Mingus Mapps called the attack \u201chorrific\u201d and \u201cunacceptable\u201d and expressed concern that Kesterson was released from jail the same day that he was arrested.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>The guidelines for when to release defendants prior to their first court appearance is based on a statewide order issued by the Chief Justice. The pretrial release guidelines were rewritten as a result of Senate Bill 48, which moved the state away from a bail-based system to one that focuses on a person\u2019s potential threat to the community. It went into effect on July 1, one day prior to Kesterson\u2019s arrest.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>In general, the new guidelines require that people charged with more serious offenses \u2014 including violent felonies, sex crimes and domestic violence felonies or misdemeanors \u2014 not be released until they appear before a judge.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p><strong class=\"cms__embed-related-story\">RELATED: <a target=\"_blank\" class=\"cms__embed-related-story__link\" href=\"https:\/\/www.kgw.com\/article\/news\/crime\/portland-anti-asian-hate-bias-crime-speakers-leaders\/283-30c658a6-e912-4bae-b4dc-adee0643c32e\" rel=\"noopener\">Oregon Rises Above Hate speaks out against anti-Asian hate crimes in Portland<\/a><\/strong><\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>John Kodachi, a Portland attorney and former president of the JACL, said the Kesterson case illustrates why bias crimes need to be added to the list of &#8220;hold until arraignment&#8221; charges.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>\u201cOnce immediately released, that person is potentially capable of engaging in another attack, another assault,\u201d warned Kodachi. \u201cAs a community, we feel it is important to keep that person locked up until they are presented before a judge who can make a better determination about release or not.\u201d<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>Kesterson is facing 23 counts, including charges stemming from two separate incidents months earlier.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>A new indictment filed Monday accused Kesterson of a bias attack on April 9 where he allegedly robbed a woman. Details of that incident have not been released.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>Kesterson is also accused of <a target=\"_blank\" href=\"https:\/\/www.kgw.com\/article\/news\/crime\/second-bias-attack-leads-to-more-charges\/283-785bcd47-4fd3-4396-9cea-dcdce9567260\" rel=\"noopener noreferrer\">racially motivated attacks on April 17<\/a>, where he allegedly harassed three different women in downtown Portland because of their race. \u00a0\u00a0<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>\u201cHate crimes are real and they are detrimental to people\u2019s health,\u201d explained Tyra Blackmon, one of the women targeted in that incident. The Michigan woman said that she\u2019s still dealing with physical and mental effects of the violent, unprovoked attack. A private security guard took photos of Kesterson after the alleged incident.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>Blackmon expressed frustration that Kesterson wasn\u2019t apprehended after he assaulted her in April, and said she was dumbfounded to hear that he was allowed to walk free after a similar attack in July.<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>\u201cHe could have easily assaulted someone else,\u201d said Blackmon. \u201cHe doesn\u2019t see what is wrong with the issue and so if you have people immediately released from jail \u2014 he can easily do it again.\u201d<\/p>\n<\/p><\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>A Japanese student living in Portland told KGW that Kesterson screamed and slapped him in the face on June 25 in downtown Portland.
