Its implementation marks a success for the Biden administration, which has portrayed the rule as a necessary tool to help law enforcement officials combat a surge in gun violence. Other court challenges are pending.<\/p>\n<\/div>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Ghost guns have drawn growing scrutiny in recent years, with law enforcement agencies saying they are increasingly used in crimes. At <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/04\/11\/atf-nomination-dettelbach\/?itid=lk_inline_manual_5\" rel=\"noopener\">a Rose Garden ceremony<\/a> in April that included gun kits as props, President<b> <\/b>Biden called ghost guns the \u201cweapons of choice for many criminals.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p><span class=\"font--article-body font-copy hide-for-print ma-0 pb-md db italic interstitial\"><a target=\"_blank\" data-qa=\"interstitial-link\" href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/04\/11\/atf-nomination-dettelbach\/?itid=lk_interstitial_manual_6\" rel=\"noopener\">Biden turns to stemming gun crimes as violence rises<\/a><\/span><\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Between 2016 and 2021, the Bureau of Alcohol, Tobacco, Firearms and Explosives got more than 45,000 reports of <b>\u201c<\/b>privately made firearms\u201d<b> <\/b>being recovered by authorities during criminal investigations, the Justice Department <a target=\"_blank\" href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-announces-new-rule-modernize-firearm-definitions\" rel=\"noopener\">said<\/a>.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">The increase over that span was dramatic, federal data show. The department reported more than 19,300 such firearms recovered by law enforcement in 2021 \u2014 nearly five times the tally from 2018.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Attorney General Merrick Garland said in <a target=\"_blank\" href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-announces-new-rule-modernize-firearm-definitions\" rel=\"noopener\">a statement<\/a> in April that the new ghost guns rule \u201cwill make it harder for criminals and other prohibited persons to obtain untraceable guns, will help ensure that law enforcement officers can retrieve the information they need to solve crimes, and will help reduce the number of untraceable firearms flooding our communities.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Opponents of the rule denounced it as unconstitutional overreach. A federal lawsuit filed in North Dakota by plaintiffs including a gun store in the state; a group of <a target=\"_blank\" href=\"https:\/\/www.azag.gov\/press-release\/arizona-attorney-general-mark-brnovich-sues-biden-administration-protect-second\" rel=\"noopener\">Republican attorneys general<\/a>; and Gun Owners of America, a gun lobbying group, said the rule \u201cviolates principles of federalism\u201d and \u201cwill sow chaos within large segments of the firearms community.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">On Tuesday, Chief Judge Peter D. Welte of the District of North Dakota denied their requests for a preliminary or permanent injunction, writing that the Biden administration had acted within its authority in laying out the rule. Welte, nominated in 2019 by President Donald Trump, wrote that the new measure \u201cwas and remains constitutional under the Second Amendment.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">\u201cWithout a doubt, this case presents divisive issues that all parties care about deeply and that are of national concern and importance, as demonstrated by the participation of nearly every state in this country in this action,\u201d he wrote in a 27-page order. \u201cNevertheless, the court\u2019s role and responsibility remains the same\u2014to apply the law to the facts (and not the arguments or policy) of each case.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p><span class=\"font--article-body font-copy hide-for-print ma-0 pb-md db italic interstitial\"><a target=\"_blank\" data-qa=\"interstitial-link\" href=\"https:\/\/www.washingtonpost.com\/nation\/interactive\/2022\/gun-deaths-per-year-usa\/?itid=ap_markberman&amp;itid=lk_interstitial_manual_17\" rel=\"noopener\">The staggering scope of U.S. gun deaths<\/a><\/span><\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">The new rule changes how a \u201cfirearm frame or receiver\u201d is defined in federal regulations, expanding it to \u201cinclude a weapon parts kit\u201d that can be quickly assembled. The Justice Department said the rule does not ban anyone from having a privately made firearm.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">But in lawsuits challenging the rule, opponents assailed it as overly broad and said it would have a catastrophic effect on businesses and workers.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">In a separate Texas case, the measure was opposed by Division 80, a company that distributes receiver blanks, which are also used by people looking to build firearms themselves.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">The Biden administration rule violates Division 80\u2032s constitutional rights and \u201cwill destroy Division 80\u2032s entire business,\u201d the company argued<b> <\/b>in a federal lawsuit that asks for the rule be blocked or delayed.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">The Justice Department argued against any injunction in that case, saying the rule was properly issued and is constitutional. Not long after Welte\u2019s order was issued on Tuesday, federal authorities submitted a filing in the Texas case highlighting the North Dakota ruling.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">In the North Dakota case, the <a target=\"_blank\" href=\"https:\/\/mcusercontent.com\/cc1fad182b6d6f8b1e352e206\/files\/4f1e698e-30f7-324e-644a-870cb1f805fd\/Complaint_with_States_7_27_TO_FILE.pdf\" rel=\"noopener\">lawsuit<\/a> challenging the new federal rule said it would subject gun owners \u201cto ever encroaching, illegal and unconstitutional infringements of their right to keep and bear arms.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Gun dealers, it said, \u201cwill be conscripted into federal service to keep illegal records of privately made firearms on behalf of the federal government \u2013 records that are not required by any federal law.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">The rule, the lawsuit argued, could cost businesses tens or hundreds of million dollars in sales. \u201cProtected Second Amendment activity will grind to a halt, numerous companies will falter or go out of business, and jobs will be lost.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p><span class=\"font--article-body font-copy hide-for-print ma-0 pb-md db italic interstitial\"><a target=\"_blank\" data-qa=\"interstitial-link\" href=\"https:\/\/www.washingtonpost.com\/dc-md-va\/2022\/05\/31\/baltimore-ghost-guns-lawsuit\/?itid=lk_interstitial_manual_31\" rel=\"noopener\">Baltimore plans to sue \u2018ghost gun\u2019 part maker as state law takes effect<\/a><\/span><\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">A spokesperson for Arizona Attorney General Mark Brnovich (R), who in July had <a target=\"_blank\" href=\"https:\/\/www.azag.gov\/press-release\/arizona-attorney-general-mark-brnovich-sues-biden-administration-protect-second\" rel=\"noopener\">announced<\/a> that he was co-leading a group of 17 states joining the North Dakota case, said Brnovich\u2019s office \u201cwill continue to defend the 2nd Amendment against overly burdensome regulations.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">\u201cThe right to keep and bear arms includes the ability to procure guns, as well as parts and ammunition,\u201d spokesperson Brittni Thomason said in a statement. Lawyers for the other plaintiffs in that case did not immediately respond to a request for comment.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">The Justice Department had argued in court filings that the new rule was necessary \u201cto provide clarity to the public and the firearms industry on the proper application of federal law.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">In the North Dakota case, the department wrote that technological advances made it easier to create kits and parts that \u201callow unlicensed persons to make firearms quickly and easily\u201d \u2014 usually without serial numbers, making it hard for law enforcement officials to trace the weapons if they are used in crimes.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p><span class=\"font--article-body font-copy hide-for-print ma-0 pb-md db italic interstitial\"><a target=\"_blank\" data-qa=\"interstitial-link\" href=\"https:\/\/www.washingtonpost.com\/dc-md-va\/2022\/08\/11\/dc-ghost-guns-polymer80-judgment\/?itid=lk_interstitial_manual_38\" rel=\"noopener\">D.C. wins $4 million judgment against \u2018ghost gun\u2019 parts maker<\/a><\/span><\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">The department argued that the rule was \u201ca valid exercise of the authority ATF has been expressly granted by Congress\u201d and pushed back against the idea that the rule created \u201can unlawful national gun registry.\u201d Instead, the department wrote in court papers, the rule only extended how long certain records already kept must be maintained.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">The Justice Department said<b> <\/b>the rule does not prohibit businesses from selling the products, but instead makes it so that they \u201cmust comply with the same regulatory framework that all federally licensed firearms dealers must comply with.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Granting the requested injunction, the department said in the North Dakota case, \u201cwould significantly harm the government\u2019s interests in law enforcement and public safety.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">In his order on Tuesday, Welte wrote: \u201cThe rather speculative risk of harm to the plaintiffs, on the one hand, does not outweigh the harm to the ATF\u2019s interest in law enforcement and public safety, on the other.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Authorities representing a group of cities \u2014 including New York, Chicago, Los Angeles and Philadelphia \u2014 also weighed in to support the federal rule in the North Dakota case.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">They wrote in a filing that their cities had experienced \u201cdramatic increases\u201d in ghost guns being used in criminal activity.
