But in reality both the electoral and substantive arguments behind it are weak.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Democrats aren\u2019t returning fully to 1990s-style centrism on criminal justice issues, but they are moving in that direction. Over the past year, Biden has both urged cities and states <a target=\"_blank\" href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2022\/05\/13\/remarks-by-president-biden-highlighting-state-and-local-leaders-who-are-investing-american-rescue-plan-funding\/\" rel=\"noopener\">to use American Rescue Plan funding to hire more police officers<\/a> and <a target=\"_blank\" href=\"https:\/\/www.theguardian.com\/us-news\/2022\/feb\/03\/joe-biden-defund-police-new-york-eric-adams\" rel=\"noopener\">repeatedly denounced calls to defund the police<\/a>, most notably in his<a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/03\/05\/biden-fund-the-police\/?itid=lk_inline_manual_4\" rel=\"noopener\"> State of the Union address<\/a>. In Philadelphia on Tuesday, the president touted<a target=\"_blank\" href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2022\/07\/21\/fact-sheet-president-bidens-safer-america-plan\/\" rel=\"noopener\"> his new proposal<\/a> to hire 100,000 additional police officers over the next five years and once again attacked the defund movement.<\/p>\n<\/div>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Meanwhile, centrist House Democrats Josh Gottheimer (N.J.) and Abigail Spanberger (Va.) are <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/07\/26\/early-202-house-progressives-balk-police-funding-bills\/?itid=lk_inline_manual_5\" rel=\"noopener\">pressing the party to hold votes before November<\/a> on <a target=\"_blank\" href=\"https:\/\/gottheimer.house.gov\/news\/documentsingle.aspx?DocumentID=2975\" rel=\"noopener\">their bills<\/a> to increase funding<a target=\"_blank\" href=\"https:\/\/spanberger.house.gov\/posts\/spanberger-rice-urge-house-leadership-to-bring-to-the-floor-their-bipartisan-bill-to-increase-law-enforcement-pay-hiring\" rel=\"noopener\"> to local police departments.<\/a> New York <a target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2022\/02\/08\/nyregion\/crime-plan-eric-adams.html\" rel=\"noopener\">Mayor Eric Adams<\/a> and new San Francisco District Attorney Brooke Jenkins are among the numerous figures in the party pushing for a rollback of bail reforms and <a target=\"_blank\" href=\"https:\/\/theappeal.org\/brooke-jenkins-san-francisco-district-attorney\/\" rel=\"noopener\">other more lenient criminal justice policies<\/a>. Many Democratic leaders in Minneapolis last year <a target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2021\/10\/29\/us\/minneapolis-police-ballot-measure.html\" rel=\"noopener\">strongly opposed a ballot initiative<\/a> that would have replaced the city\u2019s police force with a comprehensive public safety department. In San Francisco, <a target=\"_blank\" href=\"https:\/\/www.sfgate.com\/politics-op-eds\/article\/Democratic-official-supports-Boudin-recall-17214953.php\" rel=\"noopener\">prominent Democrats<\/a> cheered on the recall of reform-minded prosecutor <a target=\"_blank\" href=\"https:\/\/www.sfgate.com\/bay-area-politics\/article\/London-Breed-shifts-on-Boudin-recall-16986908.php\" rel=\"noopener\">Chesa Boudin<\/a>.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">There are three reasons for this shift. <a target=\"_blank\" href=\"https:\/\/www.npr.org\/2021\/09\/27\/1040904770\/fbi-data-murder-increase-2020\" rel=\"noopener\">2020<\/a> and <a target=\"_blank\" href=\"https:\/\/www.cnbc.com\/2022\/08\/11\/us-murder-rates-stayed-high-last-year-but-trend-may-be-reversing-.html\" rel=\"noopener\">2021 <\/a>saw big spikes in murders, and the homicide rate in many cities <a target=\"_blank\" href=\"https:\/\/www.ahdatalytics.com\/dashboards\/ytd-murder-comparison\/\" rel=\"noopener\">remains higher than before the covid-19 pandemic began.<\/a> Second, many Democrats, including <a target=\"_blank\" href=\"https:\/\/theintercept.com\/2020\/12\/10\/biden-audio-meeting-civil-rights-leaders\/\" rel=\"noopener\">Biden <\/a>and <a target=\"_blank\" href=\"https:\/\/twitter.com\/mkraju\/status\/1324445099430940673?lang=en\" rel=\"noopener\">Spanberger<\/a>, have argued that the party didn\u2019t win by as much as it could have in 2020 because it was too closely associated with the defund-the-police rhetoric. Third, criminal justice reforms have been a particular focus of the party\u2019s left wing, so centrist Democrats find that attacking these reforms and their advocates is a useful way to win intraparty power.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<div tabindex=\"0\" class=\"flex justify-between w-100 pointer b bt pt-xs pb-xs pl-0 pr-0 pr-md border-box font-xxs\" role=\"button\"><span class=\"flex items-center flex-shrink-0\"><\/p>\n<figure aria-hidden=\"true\" class=\"hide-for-print mw-100 dib bg-gray-lightest h-auto overflow-hidden brad-50 bw-0 mr-xs\" style=\"width:32px;height:32px\"\/><span class=\"transition-all duration-200 o-100\"><strong>Follow<\/strong>\u00a0<!-- -->Perry Bacon Jr.<!-- -->‘s opinions<\/span><\/span><span class=\"flex items-center\"><span class=\"bold mr-xs gray-dark overflow-hidden transition-all duration-200 o-0 gold\">Follow<\/span><span title=\"Follow author\" aria-label=\"Follow author\" aria-pressed=\"false\" class=\"flex items-center transition-all duration-200 o-100\"><svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" class=\"content-box fill-gold pointer\" width=\"16\" height=\"16\" viewbox=\"0 0 16 16\" aria-hidden=\"true\" focusable=\"false\" role=\"img\"><title>Add<\/title><path d=\"M7 7V1h2v6h5.929v2H9v5.929H7V9H1V7h6z\" fill-rule=\"nonzero\"\/><\/svg><\/span><\/span><\/div>\n<p><span class=\"db border-box overflow-hidden duration-500 ease-in-out db\" style=\"opacity:0;transform:translateY(-10px)\"\/><span class=\"db b bb border-box mb-sm\"\/><\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Taking the last reason first: Harming the criminal justice movement to gain advantage in intraparty feuds is petty and counterproductive. But that\u2019s what happening, even if centrist Democrats don\u2019t admit it. The campaign and mayoral tenure of Adams, the recall of Boudin and other political fights in Democratic-dominated cities have featured the same dynamics: centrist Democrats <a target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2022\/07\/15\/nyregion\/eric-adams-crime-nyc.html\" rel=\"noopener\">exaggerating the increase in crime<\/a>, blaming not only the crime surge but also <a target=\"_blank\" href=\"https:\/\/slate.com\/business\/2022\/06\/los-angeles-mayor-election-san-francisco-boudin-recall-progressives-crime-homelessness.html\" rel=\"noopener\">long-standing problems like homelessness and drug abuse on progressive reforms<\/a>, and implying their left-wing opponents want to immediately and drastically reduce police spending with no plan to keep people safe. It\u2019s fine for centrist Democrats to want to defeat the left. But they should use a strategy that doesn\u2019t involve a misleading portrayal of criminal justice reforms that will end up weakening a much-needed movement.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">What if, however, Democrats are moving rightward on criminal justice to win elections and prevent Trumpian Republicans from taking power? That would be morally defensible. But the case for that electoral strategy is thin. Democrats lost the 1994 congressional elections right after passing a major anti-crime bill that included funding for 100,000 more police officers. Democrats won the House, Senate and presidency in 2020 after <a target=\"_blank\" href=\"https:\/\/www.nytimes.com\/interactive\/2020\/07\/03\/us\/george-floyd-protests-crowd-size.html\" rel=\"noopener\">some of the largest<\/a> and most police-skeptical protests in U.S. history \u2014 protests that were, by the way, a massive mobilizer of younger Americans who <a target=\"_blank\" href=\"https:\/\/www.brookings.edu\/research\/turnout-in-2020-spiked-among-both-democratic-and-republican-voting-groups-new-census-data-shows\/\" rel=\"noopener\">then turned out at unusually high numbers in the 2020 presidential election<\/a>.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">And despite what you may have heard, <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/opinions\/2022\/03\/01\/democrats-republicans-2022election-midterms-wokeness-defund-education\/?itid=lk_inline_manual_13\" rel=\"noopener\">no 2020 Democratic candidate lost by running on<\/a> defunding the police because the few who invoked that slogan campaigned in heavily liberal areas. The idea that significant numbers of voters who would have backed Democratic candidates in 2020 did not do so because they believed those candidates would defund local police departments has always been far-fetched \u2014 especially since Biden and the overwhelming majority of other Democratic politicians explicitly rejected defunding.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Biden and Spanberger might sincerely believe this theory. But it\u2019s also possible what we are seeing is motivated reasoning. Biden, Spanberger and other Democrats who think the party should have done better in 2020 can either blame themselves for their underperformance or they can blame unnamed activists. It\u2019s disappointing but not surprising that they have chosen activist-bashing over self-reflection.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Since 2020, Democrats have spent much of their time emphasizing their centrist stands on issues such as policing and infrastructure in an effort to appeal to moderate and conservative White voters. This is nothing new for the party, which for decades has employed <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/opinions\/2021\/11\/11\/white-appeasement-politics-democrats\/?itid=lk_inline_manual_15\" rel=\"noopener\">a political strategy<\/a> of distancing itself from activists and avoiding issues of race and identity for supposed electoral benefits that often don\u2019t materialize. And the past few months have further illustrated why this strategy is misguided. Democrats\u2019 electoral fortunes improved markedly once they started aggressively attacking Republicans on abortion and democracy issues in particular, instead of emphasizing bipartisanship and centrist stands.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-el=\"text\" class=\"font--article-body font-copy gray-darkest ma-0 pb-md font--article-body gray-darkest ma-0 pb-md\">The most defensible reason for Democrats\u2019 new posture on crime is the murder-rate increase. It\u2019s possible, at least in the short term, <a target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2021\/11\/08\/us\/police-crime.html\" rel=\"noopener\">that adding officers in some cities will help<\/a>. But Biden and other Democrats aren\u2019t simply calling for more cops in a few places as a quick, targeted fix. In using \u201cfund them\u201d rhetoric, Biden and other Democrats are venerating police and rebuking those calling for reform. These Democrats are also pumping new resources into local and state police departments across the country with little oversight or accountability. It\u2019s almost as if everything that was unearthed about police abuses over the past decade has been forgotten by Democrats.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">It\u2019s not that all or even most police officers act improperly. But as a group, <a target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2021\/10\/31\/us\/police-ticket-quotas-money-funding.html\" rel=\"noopener\">the police<\/a> still kill <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/graphics\/investigations\/police-shootings-database\/?itid=lk_inline_manual_19\" rel=\"noopener\">more than 1,000<\/a> civilians a year, <a target=\"_blank\" href=\"https:\/\/www.npr.org\/2021\/01\/25\/956177021\/fatal-police-shootings-of-unarmed-black-people-reveal-troubling-patterns\" rel=\"noopener\">often without justification<\/a>. They still oppose and <a target=\"_blank\" href=\"https:\/\/capitalbnews.org\/police-active-shooting-suspect-demographics\/\" rel=\"noopener\">subvert<\/a> virtually<a target=\"_blank\" href=\"https:\/\/www.themarshallproject.org\/2022\/08\/15\/see-if-police-in-your-state-reported-crime-data-to-the-fbi\" rel=\"noopener\"> all accountability measures<\/a>. They still disproportionately <a target=\"_blank\" href=\"https:\/\/www.sfchronicle.com\/projects\/2022\/california-racial-profiling-police-stops\/\" rel=\"noopener\">stop <\/a>Black people. And politically, police officers, and particularly their unions, are increasingly tied to former president Donald Trump and his style of politics, while being wary of Democrats and <a target=\"_blank\" href=\"https:\/\/www.pbs.org\/newshour\/nation\/police-officers-posts-to-private-facebook-group-show-hostility-and-hate\" rel=\"noopener\">actively hostile to Black Lives Matter activists<\/a>.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">That means Biden is not only attacking a group of people (BLM protesters) <a target=\"_blank\" href=\"https:\/\/www.politico.com\/news\/2020\/08\/22\/underneath-democratic-convention-a-deep-divide-between-blm-activists-and-biden-400065\" rel=\"noopener\">who largely voted for him<\/a> to <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/national\/election-police-officers-bias\/2020\/10\/31\/78eba664-1ae8-11eb-82db-60b15c874105_story.html?itid=lk_inline_manual_20\" rel=\"noopener\">appease those who didn\u2019t <\/a>(the police). He\u2019s also empowering a group of people (the police) who in many cases <a target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2021\/03\/20\/us\/protests-policing-george-floyd.html\" rel=\"noopener\">physically assaulted their critics<\/a> (the protesters) in 2020.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Biden and Democrats are also squandering the opportunity that the 2020 protests created for a much-needed rethinking of how America can permanently reduce its crime rate and<a target=\"_blank\" href=\"https:\/\/time.com\/6208047\/police-crime-america\/\" rel=\"noopener\"> reimagine its approaches to public safety<\/a>.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">A true campaign to reduce the nation\u2019s number of murders from more than <a target=\"_blank\" href=\"https:\/\/www.npr.org\/2021\/09\/27\/1040904770\/fbi-data-murder-increase-2020\" rel=\"noopener\">20,000 <\/a>last year to close to zero <a target=\"_blank\" href=\"https:\/\/civilrightscorps.org\/wp-content\/uploads\/2021\/10\/Evidence-on-Noncarceral-Safety-DOJ_V4.docx.pdf\" rel=\"noopener\">would mean addressing some of the root causes of crime<\/a>: poverty, deprivation, drug addiction, mental illness. High murder rates are concentrated in communities <a target=\"_blank\" href=\"https:\/\/www.huduser.gov\/portal\/periodicals\/em\/summer16\/highlight2.html\" rel=\"noopener\">with low incomes and little social mobility<\/a>. America needs to work to revive those areas with social services, jobs, great schools and community-connecting institutions. We know <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/politics\/2020\/06\/07\/over-past-60-years-more-spending-police-hasnt-necessarily-meant-less-crime\/?itid=lk_inline_manual_24\" rel=\"noopener\">more cops and police spending aren\u2019t the ultimate answer<\/a>. America <a target=\"_blank\" href=\"https:\/\/www.pewresearch.org\/fact-tank\/2021\/08\/16\/americas-incarceration-rate-lowest-since-1995\/\" rel=\"noopener\">incarcerates a higher percentage of people than any other country<\/a> but is<a target=\"_blank\" href=\"https:\/\/ourworldindata.org\/homicides\" rel=\"noopener\"> nowhere close to having the lowest murder rates<\/a>.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">And one reason to be skeptical of Biden\u2019s seriousness about crime is that conspicuously round number, 100,000. Then-President Bill Clinton included funding for 100,000 more officers in his <a target=\"_blank\" href=\"https:\/\/www.presidency.ucsb.edu\/documents\/remarks-signing-the-violent-crime-control-and-law-enforcement-act-1994\" rel=\"noopener\">1994 anti-crime legislation<\/a>, which was pushed through the Senate by then-<a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/archive\/politics\/1994\/08\/26\/senate-gives-up-on-health-care-passes-crime-bill\/d988b2c8-da35-4fea-8621-3e5c6ab61845\/?itid=lk_inline_manual_25\" rel=\"noopener\">Judiciary Chair Joe Biden<\/a>. Even if adding police is a great way to reduce crime (<a target=\"_blank\" href=\"https:\/\/www.researchgate.net\/publication\/315794349_Adding_More_Police_Is_Unlikely_to_Reduce_Crime_A_Meta-Analysis_of_Police_Agency_Size_and_Crime_Research\" rel=\"noopener\">and that is very contested<\/a>), it is hard to imagine that the right number of new officers is exactly the same as it was 28 years ago. I suspect a better explanation for the figure can be found in the fact that the president and many of his aides worked on the 1994 bill.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">\u201cIt\u2019s political pandering, welfare for law enforcement and a sop to the police as a political constituency,\u201d said <a target=\"_blank\" href=\"http:\/\/www.alex-vitale.info\/\" rel=\"noopener\">Alex S. Vitale<\/a>, a policing expert and professor at Brooklyn College, of Biden\u2019s plan to fund more officers. \u201cIt\u2019s not evidence-based.\u201d<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">Biden and other Democrats haven\u2019t completely walked back their 2020 posture on policing. The party tried last year to pass a <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/powerpost\/policing-george-floyd-congress-legislation\/2021\/09\/22\/36324a34-1bc9-11ec-a99a-5fea2b2da34b_story.html?itid=lk_inline_manual_29\" rel=\"noopener\">police-reform measure<\/a>, but it was blocked by congressional Republicans. Biden instead issued an executive order <a target=\"_blank\" href=\"https:\/\/www.whitehouse.gov\/briefing-room\/presidential-actions\/2022\/05\/25\/executive-order-on-advancing-effective-accountable-policing-and-criminal-justice-practices-to-enhance-public-trust-and-public-safety\/\" rel=\"noopener\">that includes limits on no-knock warrants<\/a>. The Justice Department <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/national-security\/police-reform-biden-justice-department\/2021\/05\/02\/dab9cb90-a932-11eb-8c1a-56f0cb4ff3b5_story.html?itid=lk_inline_manual_29\" rel=\"noopener\">is once again launching investigations of local police departments,<\/a> a policy that had been stalled during the Trump presidency.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">And while Biden and many Democratic mayors want more police funding, they are also putting more money (although not nearly enough) into expanding mental health services and other non-police crime-reduction strategies.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-qa=\"drop-cap-letter\" data-el=\"text\" class=\"font-copy font--article-body gray-darkest ma-0 pb-md\">But Democrats are moving in the wrong direction overall. 2020 was just two years ago.
