{"id":35606,"date":"2022-09-12T10:56:19","date_gmt":"2022-09-12T10:56:19","guid":{"rendered":"https:\/\/cjstudents.com\/?p=35606"},"modified":"2022-09-12T10:56:19","modified_gmt":"2022-09-12T10:56:19","slug":"trump-threatens-the-legal-profession-as-a-whole","status":"publish","type":"post","link":"https:\/\/cjstudents.com\/index.php\/2022\/09\/12\/trump-threatens-the-legal-profession-as-a-whole\/","title":{"rendered":"Trump threatens the legal profession as a whole"},"content":{"rendered":"<p> [ad_1]<\/p>\n<div id=\"\">\n<p class=\"default__StyledText-sc-1wxyvyl-0 fxgoSg body-paragraph\">The mounting evidence that Donald Trump mishandled classified information after leaving office \u2014 and the response of his legal team to the Department of Justice investigation \u2014 reveals the former president\u2019s threat to another critical institution: the legal profession.<\/p>\n<p class=\"default__StyledText-sc-1wxyvyl-0 fxgoSg body-paragraph\">As part of the Justice Department\u2019s efforts to recover classified materials Trump took with him from the White House, Trump\u2019s lawyer Christina Bobb <a target=\"_blank\" href=\"https:\/\/www.documentcloud.org\/documents\/22272913-220830-exhibits#document\/p16\/a2144462\" rel=\"noopener\">certified on June 3<\/a> that all of the documents had been relinquished. The FBI\u2019s search of Mar-a-Lago debunked this certification, placing Bobb and others in <a target=\"_blank\" href=\"https:\/\/www.newsweek.com\/trump-lawyers-fbi-search-evan-corcoran-christina-bobb-1738628\" rel=\"noopener\">legal jeopardy<\/a>.<\/p>\n<p class=\"default__StyledText-sc-1wxyvyl-0 fxgoSg body-paragraph\">The legal threat to Trump\u2019s lawyers is hardly new. The sheer number of prominent lawyers accused of violations of the American Bar Association\u2019s Model Rules of Professional Conduct \u2014 the law that governs lawyers \u2014 in their advocacy for Trump is unparalleled in American history.<\/p>\n<p class=\"default__StyledText-sc-1wxyvyl-0 fxgoSg body-paragraph\">Throughout Trump\u2019s presidency, <a target=\"_blank\" href=\"https:\/\/www.newsweek.com\/prosecute-donald-trump-jan6-insurrection-laurence-tribe-1717371\" rel=\"noopener\">constitutional scholars<\/a> and <a target=\"_blank\" href=\"https:\/\/www.pnas.org\/doi\/10.1073\/pnas.2024125118\" rel=\"noopener\">political scientists<\/a> raised alarms about his blatant disregard for the law and his ongoing efforts to undermine democratic institutions. The legal troubles facing Trump\u2019s lawyers are frequently interpreted, however, as a secondary consequence of his presidency \u2014 certainly a danger to Trump and the <a target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2022\/08\/31\/us\/trump-lawyers-witnesses-investigation.html\" rel=\"noopener\">individuals involved<\/a>, but hardly a threat to the broader system of justice.<\/p>\n<p class=\"default__StyledText-sc-1wxyvyl-0 fxgoSg body-paragraph\">But that perspective overlooks the critical role that lawyers play in our system of jurisprudence and the extent of the ethical lapses. Our society places a practical reliance on prosecutors to try cases and on defense attorneys to ensure the law does not overreach. The justice system also requires lawyers to act ethically when discharging these duties. If, for example, lawyers knowingly were to help their clients lie on the stand or make false attestations to judges, our justice system would crumble. There is a reason lawyers are \u201cofficers of the court\u201d \u2014 their responsibilities extend not only to their clients but also to the rule of law itself.<\/p>\n<p class=\"default__StyledText-sc-1wxyvyl-0 fxgoSg body-paragraph\">For that same reason, in addition to passing the bar exam and swearing <a target=\"_blank\" href=\"https:\/\/cdn.ymaws.com\/www.inbar.org\/resource\/resmgr\/litigation\/Oaths.pdf\" rel=\"noopener\">an oath to uphold the law<\/a>, lawyers must comply with the Model Rules of Professional Conduct that govern their professional behavior. It is these rules, particularly those proscribing <a target=\"_blank\" href=\"https:\/\/www.americanbar.org\/groups\/professional_responsibility\/publications\/model_rules_of_professional_conduct\/rule_8_4_misconduct\/\" rel=\"noopener\">criminal acts<\/a>, <a target=\"_blank\" href=\"https:\/\/www.americanbar.org\/groups\/professional_responsibility\/publications\/model_rules_of_professional_conduct\/rule_8_4_misconduct\/\" rel=\"noopener\">dishonesty<\/a>, <a target=\"_blank\" href=\"https:\/\/www.americanbar.org\/groups\/professional_responsibility\/publications\/model_rules_of_professional_conduct\/rule_8_4_misconduct\/\" rel=\"noopener\">deceit<\/a> and <a target=\"_blank\" href=\"https:\/\/www.americanbar.org\/groups\/professional_responsibility\/publications\/model_rules_of_professional_conduct\/rule_4_1_truthfulness_in_statements_to_others\/\" rel=\"noopener\">misrepresentation<\/a>, that have repeatedly ensnared Trump\u2019s lawyers.<\/p>\n<p class=\"default__StyledText-sc-1wxyvyl-0 fxgoSg body-paragraph\">The purpose of the rules is both common-sense and grave: For our justice system to function, lawyers have a \u201cgreater duty than ordinary citizens to be scrupulously honest at all times, for honesty is basic to the practice of law,\u201d the District of Columbia Court of Appeals said in a 1987 opinion. Lawyers must balance their duty to provide zealous client representation with their equally important obligation for candor. A lawyer must play the game as best she can \u2014 using every tactic in her arsenal to defend her client \u2014 but she must play by the rules.<\/p>\n<p class=\"default__StyledText-sc-1wxyvyl-0 fxgoSg body-paragraph\">While many lawyers in Trump\u2019s orbit refused to compromise their ethics, others skirted the rules or brazenly overstepped them. These lawyers fall into two categories. First are those like <a target=\"_blank\" href=\"https:\/\/www.nycourts.gov\/courts\/ad1\/calendar\/List_Word\/2021\/06_Jun\/24\/PDF\/Matter%20of%20Giuliani%20(2021-00506)%20PC.pdf\" rel=\"noopener\">Rudy Giuliani<\/a>, <a target=\"_blank\" href=\"https:\/\/www.courthousenews.com\/texas-judge-refuses-to-dismiss-disciplinary-case-against-former-trump-attorney\/\" rel=\"noopener\">Sidney Powell<\/a> and <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/world\/national-security\/michael-cohen-scheduled-to-be-sentenced-for-crimes-committed-while-working-for-trump\/2018\/12\/11\/57226ff2-fcbf-11e8-83c0-b06139e540e5_story.html\" rel=\"noopener\">Michael Cohen<\/a>, who appeared to have knowingly participated in deceptive practices and criminal practices to further their client\u2019s personal and political aims. All three have been subject to disciplinary consequences, including, <a target=\"_blank\" href=\"https:\/\/www.cnn.com\/2019\/02\/26\/politics\/michael-cohen-disbarred-in-new-york\" rel=\"noopener\">in the case of Cohen<\/a>, disbarment. The second group are those like Trump\u2019s lawyers in the recent DOJ investigation, who likely became enmeshed in ethics challenges because they fell prey to Trump\u2019s relentless pressure to shield him from justice.<\/p>\n<p class=\"default__StyledText-sc-1wxyvyl-0 fxgoSg body-paragraph\">As a lawyer who represents other lawyers in disciplinary cases, I balk at prejudging the guilt of any of Trump\u2019s lawyers. I have seen too many lawyers falsely accused of misconduct to assume that accusation alone equates to guilt. But what is clear is that Trump\u2019s lawyers are repeatedly forced to choose between their obligations to the former president and their commitment to legal ethics. Trump\u2019s prominence and the flagrancy of his efforts to subvert democracy exacerbate the exceptional threat he poses to the legal profession as a pillar of our system of government. By successfully coercing his lawyers into violating their ethical obligations, Trump is setting a precedent that threatens to dilute the legal profession\u2019s commitment to the rule of law.<\/p>\n<p class=\"default__StyledText-sc-1wxyvyl-0 fxgoSg body-paragraph\">What can be done to combat this threat?<\/p>\n<p class=\"default__StyledText-sc-1wxyvyl-0 fxgoSg body-paragraph\">First, lawyers who represent Trump must be prepared to resist any pressure to violate the ethics rules, not only to protect themselves but also to mitigate his continued damage to their profession. Like every American caught up in our criminal justice system, Trump has a right to representation. That right does not extend, however, to abusing his legal relationships to escape justice. If Trump pressures his lawyers to offer <a target=\"_blank\" href=\"https:\/\/www.americanbar.org\/groups\/professional_responsibility\/publications\/model_rules_of_professional_conduct\/rule_3_3_candor_toward_the_tribunal\/comment_on_rule_3_3\/\" rel=\"noopener\">false evidence<\/a> or to assist him in <a target=\"_blank\" href=\"https:\/\/www.americanbar.org\/groups\/professional_responsibility\/publications\/model_rules_of_professional_conduct\/rule_1_2_scope_of_representation_allocation_of_authority_between_client_lawyer\/\" rel=\"noopener\">criminal conduct<\/a>, they must be prepared to withdraw. In the battle between maintaining loyalty to client and preserving the integrity of the justice system, the former must always give way.<\/p>\n<p class=\"default__StyledText-sc-1wxyvyl-0 fxgoSg body-paragraph\">Secondly, the broader legal profession must respond to this unique period of public attention with a recommitment to professional responsibilities. The overwhelming majority of lawyers treat their ethical responsibilities with the gravity they deserve. Nevertheless, perception can become its own reality, and Trump\u2019s onslaught on the reputation of the legal profession requires an equally forceful response. All lawyers must be doubly sure they are familiar with the ethics rules and comply with them assiduously.<\/p>\n<p class=\"default__StyledText-sc-1wxyvyl-0 fxgoSg body-paragraph\">Despite Trump\u2019s predilection for undermining the rule of law, U.S. courts have thwarted his worst instincts. But critical to the ultimate strength of the judiciary as an institution is the ethical commitment of the lawyers who serve it.<\/p>\n<p class=\"default__StyledText-sc-1wxyvyl-0 fxgoSg body-paragraph\"><i>Hilary Gerzhoy is a partner at HWG LLP where she serves as vice chair of the firm\u2019s legal ethics group.
