It includes multiple requests to government agencies and officials, some of them binding, some just suggestions.<\/p>\n<p><a target=\"_blank\" href=\"https:\/\/www.civilbeat.org\/category\/column\/\" rel=\"noopener\"><img decoding=\"async\" src=\"https:\/\/d1l18ops95qbzp.cloudfront.net\/wp-content\/2020\/06\/23134618\/opinion-badge-IDEAS-3-160x160.png\" loading=\"lazy\" class=\"alignleft size-cb-160 wp-image-1392090\" alt=\"Opinion article badge\" width=\"160\" height=\"160\"\/><noscript><img decoding=\"async\" loading=\"lazy\" class=\"alignleft size-cb-160 wp-image-1392090\" src=\"https:\/\/d1l18ops95qbzp.cloudfront.net\/wp-content\/2020\/06\/23134618\/opinion-badge-IDEAS-3-160x160.png\" alt=\"Opinion article badge\" width=\"160\" height=\"160\"\/><\/noscript><\/a><\/p>\n<p>The <a target=\"_blank\" href=\"https:\/\/lrb.hawaii.gov\/wp-content\/uploads\/2022_Requests.pdf\" rel=\"noopener\">requests from the 2022 session<\/a> were posted online this summer, and it\u2019s a snapshot of the work of legislators that may not garner headlines and yet is often consequential. The enactment of important laws often follows.<\/p>\n<p>But it also illustrates that what comes out of a legislative session can appear to outsiders as bureaucratic and Byzantine and avoiding responsibility. Let me explain.<\/p>\n<p>During this past session, Rep. Nicole Lowen from the Big Island pushed a bill to increase the percentage requirement of Kona coffee blends from 10% to 51%.<\/p>\n<p>As Lowen wrote <a target=\"_blank\" href=\"https:\/\/www.civilbeat.org\/2022\/03\/rep-nicole-lowen-support-local-farmers-by-fixing-hawaiis-coffee-labeling-law\/\" rel=\"noopener\">in a Community Voice<\/a> on <a target=\"_blank\" href=\"https:\/\/www.capitol.hawaii.gov\/measure_indiv.aspx?billtype=HB&amp;billnumber=1517&amp;year=2022\" rel=\"noopener\">House Bill 1517<\/a>, \u201cThe deception is the point: to use the name Kona or Kau or Hawaii on coffee that is 90% not that, and then to sell it for more by exploiting the good reputation of real Hawaii coffee to increase the amount of money that blenders can make on imported coffee beans by passing them off as a boutique local product.\u201d<\/p>\n<p>By end of session, however, HB 1517 was watered down to call for the state Department of Agriculture to study the issue and report back to the Legislature in January 2024.<\/p>\n<figure id=\"attachment_1479979\" style=\"width: 640px\" class=\"cb-image wp-caption aligncenter\"><img decoding=\"async\" src=\"https:\/\/d1l18ops95qbzp.cloudfront.net\/wp-content\/2022\/02\/11201815\/Coffee-Big-Island-Hawaii-Grown-09-640x360.jpg\" loading=\"lazy\" class=\"wp-image-1479979 size-cb-640\" alt=\"Soil Coffee Big Island Hawaii Grown Kona\" width=\"640\" height=\"360\"\/><noscript><img decoding=\"async\" loading=\"lazy\" class=\"wp-image-1479979 size-cb-640\" src=\"https:\/\/d1l18ops95qbzp.cloudfront.net\/wp-content\/2022\/02\/11201815\/Coffee-Big-Island-Hawaii-Grown-09-640x360.jpg\" alt=\"Soil Coffee Big Island Hawaii Grown Kona\" width=\"640\" height=\"360\"\/><\/noscript><figcaption><span class=\"wp-caption-text\">The battle over how best to label products containing Kona coffee continues, with the Hawaii Legislature ordering a study of the issues.\u00a0<\/span><span class=\"wp-caption-source\">Ku&#8217;u Kauanoe\/Civil Beat\/2022<\/span><\/figcaption><\/figure>\n<p>I\u2019m not going to talk about why Lowen\u2019s bill was altered. (You can read <a target=\"_blank\" href=\"https:\/\/www.civilbeat.org\/2022\/05\/how-a-powerful-lawmaker-forced-through-a-contentious-energy-bill\/\" rel=\"noopener\">that story here<\/a>.) But it captures something that happens a lot at the Leg in lieu of passing actual legislation: Call for a study! Or a report!<\/p>\n<p>No surprise, then, that the words \u201cstudy\u201d and \u201creport\u201d crop up hundreds of times in the 133-page chronicle of requests this year. You will also find plenty of mentions of the words \u201ctask force\u201d and \u201cworking group,\u201d as in this example: \u201cEstablishes the blockchain and cryptocurrency task force to be placed within the department of commerce and consumer affairs for administrative purposes.\u201d<\/p>\n<p>That particular piece of legislation, <a target=\"_blank\" href=\"https:\/\/www.capitol.hawaii.gov\/measure_indiv.aspx?billtype=SB&amp;billnumber=2695&amp;year=2022\" rel=\"noopener\">Senate Bill 2695<\/a>, stipulates 14 points regarding the composition of said task force and nine points on what it must do before it sends its work to the Legislature 15 months from now.<\/p>\n<p>I can understand lawmakers wanting fresh intel on crypto, which has been all the rage in financial markets. But the debate over Kona coffee labeling has been around for decades. Do we really need another study or a task force?<\/p>\n<p>It depends, say government leaders.<\/p>\n<h2>\u2018Vital Role\u2019<\/h2>\n<p>\u201cTask forces can play a vital role in preparing for the next session,\u201d said House Speaker Scott Saiki. \u201cIn most cases the Legislature creates a task force because the policy issue is really complicated and there are varying opinions on what should be done. And we just run out of time during regular session to resolve it.\u201d<\/p>\n<p>Saiki acknowledges that task forces and working groups \u2014 essentially, interchangeable terms, just like \u201cstudies\u201d and \u201creports\u201d \u2014 can be perceived as evidence of the Legislature\u2019s inability to resolve problems. In fact, he argues, they can actually \u201copen up the process\u201d to allow members of the public to be involved, and not just members of the Legislature.<\/p>\n<p>Saiki pointed to the example of the Mauna Kea Stewardship and Oversight Authority, something that came out of a working group in 2021 during the interim and became enabling legislation this year. On Monday, Gov. David Ige <a target=\"_blank\" href=\"https:\/\/www.civilbeat.org\/beat\/prominent-native-hawaiians-named-to-mauna-kea-authority\/\" rel=\"noopener\">appointed several people<\/a>, including prominent Native Hawaiian activists, to the authority. The nominations await Senate confirmation.<\/p>\n<p>Another example cited in the new Legislative Reference Bureau report is House Resolution 9, approved in February in response to the high-profile bribery cases involving two former lawmakers. The Commission to Review Ethics Code, Lobbyist laws and Campaign Spending laws has already met several times and discussed many ideas on how to improve ethics at the Leg, and a final set of recommendations is expected in December.<\/p>\n<figure id=\"attachment_1476258\" style=\"width: 640px\" class=\"cb-image wp-caption aligncenter\"><img decoding=\"async\" src=\"https:\/\/d1l18ops95qbzp.cloudfront.net\/wp-content\/2022\/01\/19121050\/Opening-Day-Legislature-2022-floor-session-v1-640x427.jpg\" loading=\"lazy\" class=\"size-cb-640 wp-image-1476258\" alt=\"Opening Day of the 2022 Legislature with plastic dividers during a surge in Covid-19 cases statewide. January 19, 2022.\" width=\"640\" height=\"427\"\/><\/noscript><figcaption><span class=\"wp-caption-text\">The Legislature meets formally from January to May each year, but its work extends through the interim \u2014 in part through the work of task forces and request for reports.\u00a0<\/span><span class=\"wp-caption-source\">Cory Lum\/Civil Beat\/2022<\/span><\/figcaption><\/figure>\n<p>Whether meaningful ethics reform or smoother operations on the mauna ever develop remains to be seen, of course. But good laws and policies often begin with careful research and brainstorming by experts.<\/p>\n<p>Karl Rhoads, chair of the Senate Judiciary Committee, reminded me of the slew of proposed criminal justice reforms that <a target=\"_blank\" href=\"https:\/\/www.courts.state.hi.us\/house-concurrent-resolution-134-2017-criminal-pretrial-task-force\" rel=\"noopener\">originated in 2017<\/a>.<\/p>\n<p>\u201cLook at cash bail reform,\u201d said Rhoads. \u201cThat bill came out the Criminal Pretrial Task Force recommendations. That was a very influential proposal.\u201d<\/p>\n<p>Sometimes good ideas take time, and Rhoads said he and his colleagues could not reach agreement on a cash bail measure in 2019. But <a target=\"_blank\" href=\"https:\/\/www.capitol.hawaii.gov\/measure_indiv.aspx?billtype=HB&amp;billnumber=1567&amp;year=2022\" rel=\"noopener\">House Bill 1567<\/a> passed in 2022.<\/p>\n<p>The bill, however, encountered strong opposition from powerful voices in the law enforcement community, and Ige ended up vetoing it in July. That does not mean it was a waste of time, although it may be some time before the concept is introduced again.<\/p>\n<p>\u201cBut a task force can be very useful,\u201d said Rhoads. \u201cIt can be when you get a lot of people who know a lot about a particular topic in the same room where they can hash things out.\u201d<\/p>\n<h2>Mixed Outcomes<\/h2>\n<p>One thing the LRB is not responsible for is keeping track of what happens to all those studies, reports, requests, working groups and task forces, although they are <a target=\"_blank\" href=\"https:\/\/lrb.hawaii.gov\/publications\/session-reports\" rel=\"noopener\">posted online<\/a>. Saiki and Rhoads say that follow-up is the responsibility of the introducers of the proposals themselves.<\/p>\n<p>Still, follow through can result in mixed outcomes.<\/p>\n<p>The LRB\u2019s <a target=\"_blank\" href=\"https:\/\/lrb.hawaii.gov\/wp-content\/uploads\/2019_Requests.pdf\" rel=\"noopener\">2019 report<\/a>, for example, cites a legislative requirement that the state auditor conduct a performance audit of the Agribusiness Development Corporation. The highly critical audit that followed, however, ultimately led to some House lawmakers <a target=\"_blank\" href=\"https:\/\/www.civilbeat.org\/2022\/01\/house-panel-recommends-further-investigation-of-hawaii-state-auditor\/\" rel=\"noopener\">taking far more issue<\/a> with State Auditor Les Kondo himself than the beleaguered ADC.<\/p>\n<p>Another task that came from 2019 required the Department of Agriculture and the Office of the Governor to \u201cdevelop a strategic plan\u201d to <a target=\"_blank\" href=\"https:\/\/www.capitol.hawaii.gov\/Archives\/measure_indiv_Archives.aspx?billtype=SB&amp;billnumber=375&amp;year=2019\" rel=\"noopener\">double local food production<\/a> and increase food exports by 2030.<\/p>\n<p>Ige, who promised to double food production by 2020 \u2014 that is, two years ago \u2014 told Civil Beat <a target=\"_blank\" href=\"https:\/\/www.civilbeat.org\/2022\/08\/the-civil-beat-editorial-board-interview-hawaii-gov-david-ige\/\" rel=\"noopener\">in an interview<\/a> last month that, while he believes there is anecdotal evidence that production has grown, it has also been difficult to measure that growth.<\/p>\n<p>The Legislature\u2019s work continues. Among the many requests detailed in the LRB\u2019s most recent report are these seemingly worthwhile endeavors:<\/p>\n<ul>\n<li><a target=\"_blank\" href=\"https:\/\/www.capitol.hawaii.gov\/measure_indiv.aspx?billtype=HB&amp;billnumber=1539&amp;year=2022\" rel=\"noopener\">House Bill 1539<\/a>, which requires a judicial security task force to examine methods for securing online personal information of federal and state judges and appropriate judiciary personnel.<\/li>\n<li><a target=\"_blank\" href=\"https:\/\/www.capitol.hawaii.gov\/measure_indiv.aspx?billtype=HB&amp;billnumber=1741&amp;year=2022\" rel=\"noopener\">House Bill 1741<\/a>, which requires the Department of Human Services to continue to lead a working group to address visitation and support needs of children and families of incarcerated people at Waiawa Correctional Facility on Oahu.<\/li>\n<li><a target=\"_blank\" href=\"https:\/\/www.capitol.hawaii.gov\/measure_indiv.aspx?billtype=HB&amp;billnumber=1800&amp;year=2022\" rel=\"noopener\">House Bill 1800<\/a>, which requires the director of health to submit a report to the Legislature by December 2023 measuring greenhouse gas emissions in Hawaii, including from airplanes.<\/li>\n<\/ul>\n<p>Internet security, criminal justice reform and climate change mitigation will forever be with us, no?
