Etienne Laurent\/Pool via REUTERS<\/figcaption><\/figure>\n<p>Sentencing is tentatively scheduled Monday for former film producer Harvey Weinstein, who was <a target=\"_blank\" href=\"https:\/\/timesofsandiego.com\/crime\/2022\/12\/19\/harvey-weinstein-convicted-of-3-of-7-charges-including-rape-in-los-angeles-trial\/\" rel=\"noopener\">found guilty in December<\/a> of sexually assaulting a woman in the Los Angeles area, but acquitted of charges related to a second alleged victim.<\/p>\n<p>He was convicted Dec. 19, 2022 of three of the seven counts he was facing \u2014 forcible rape, forcible oral copulation and sexual penetration by a foreign object. All three of those counts related to a woman identified as Jane Doe #1, with the crimes occurring on or about Feb. 18, 2013.<\/p>\n<p>The eight-man, four-woman jury, which deliberated for 41 hours, deadlocked on charges related to two other women and on whether there were aggravating factors that would have lengthen his maximum potential prison sentence.<\/p>\n<p>Weinstein, 70, who was extradited from New York to stand trial in Los Angeles, faces up to 18 years in prison.<\/p>\n<p>He has remained behind bars following his conviction in New York for raping an aspiring actress and of a criminal sex act against a former production assistant. The state\u2019s highest court has since agreed to hear his appeal in that case.<\/p>\n<aside class=\"scaip scaip-1    \">\n\t\t<\/aside>\n<p>Los Angeles prosecutors still have to decide whether they want to retry the alleged aggravating factors, along with charges on which jurors deadlocked involving Jane Doe #2 and Jane Doe #4 \u2014 the latter of whom has been publicly identified by her attorney as <a target=\"_blank\" href=\"https:\/\/timesofsandiego.com\/crime\/2022\/11\/14\/gov-newsoms-wife-begins-testimony-in-harvey-weinstein-sex-crimes-trial\/\" rel=\"noopener\">Jennifer Siebel Newsom<\/a>, the wife of Gov. <a target=\"_blank\" href=\"https:\/\/www.gov.ca.gov\/\" rel=\"noopener\">Gavin Newsom<\/a>. Deputy District Attorney Paul Thompson told the judge that the prosecution wants to consult with the alleged victims.<\/p>\n<p>Superior Court Judge Lisa B. Lench has also noted that she needed to research whether Weinstein\u2019s sentencing could go forward on the charges for which he was convicted, while separating that conviction from the charges on which the jury could not reach verdicts.<\/p>\n<p>During the trial, jurors also heard from four other women who were allegedly sexually assaulted by Weinstein, but are not listed as charged victims in the case.<\/p>\n<p>Weinstein \u2014 who Deputy District Attorney Marlene Martinez had earlier called a \u201ctitan of the film industry\u201d \u2014 engaged in \u201cdespicable behavior\u201d and made sure that the alleged victims knew he \u201ccould destroy them,\u201d the prosecutor said in her closing argument.<\/p>\n<aside>\t\t\t\t\t<amp-analytics class=\"i-amphtml-layout-fixed i-amphtml-layout-size-defined\" style=\"width:1px;height:1px\" i-amphtml-layout=\"fixed\"><\/p>\n<p>\t\t<\/amp-analytics><\/p>\n<\/aside>\n<p>But in his argument, defense attorney Alan Jackson told the jury that the entirety of the prosecution\u2019s case could be summed up with five words \u2014 \u201cTake my word for it\u201d \u2014 and said the alleged victims lied on the stand about what was actually \u201cconsensual\u201d or \u201ctransactional\u201d sex with the now-disgraced filmmaker.<\/p>\n<aside class=\"scaip scaip-2    \">\n\t\t<\/aside>\n<p>\u201cDid one person come in here and say, \u2018I said no to Harvey Weinstein and he screwed my career?\u2019 Was there one? \u2026 Not one person said that because it\u2019s a fable \u2026 It just isn\u2019t true,\u201d Jackson said.<\/p>\n<p>Weinstein\u2019s attorney contended that two of the alleged attacks involving Jane Doe #1 and Jane Doe #2\u00a0\u00a0\u201csimply never happened\u201d and that they were \u201cfictionalized\u201d accounts of events that never occurred. He said Weinstein\u2019s relationships with the other two alleged victims, including the governor\u2019s wife, were \u201c100% consensual\u201d and amounted to \u201ctransactional<br \/>relationships.\u201d<\/p>\n<p>The defense attorney ended his closing argument with an attack on the testimony of Siebel Newsom, which he called a \u201ctheatrical, overly dramatized performance\u201d that was a \u201cpretty good act\u201d that had \u201cno basis in truth.\u201d<\/p>\n<p>\u201cJane Doe 4 cannot square in her mind that she\u2019s a successful, well-educated, well-bred, refined woman who had consensual sex with Harvey Weinstein in exchange for opportunity and access,\u201d he said of the governor\u2019s wife. \u201cRegret is far from rape. You don\u2019t get to rewrite your own history no matter who you\u2019re married to.\u201d<\/p>\n<p>As she wrapped up her closing argument, the prosecutor told jurors, \u201cIt is time for the defendant\u2019s reign of terror to end \u2026 It is time for the kingmaker to be brought to justice.\u201d<\/p>\n<aside class=\"scaip scaip-3    \">\n\t\t<\/aside>\n<p>Martinez had told jurors earlier in her closing argument that Weinstein used his power to prey on and silence women. She called him a \u201cpredator,\u201d and said none of the women making accusations against Weinstein knew each other.<\/p>\n<p>She noted that the women knew they would come to court and face tough questioning from the defense, and that they knew \u201chis attorneys would call them bimbos in open court for having been raped.\u201d<\/p>\n<p>Prosecutors have described Weinstein as one of the most powerful people in the industry at the time of the alleged crimes. Deputy District Attorney Paul Thompson told jurors at the start of the case that Weinstein and his brother, Bob, created Miramax Films, which produced a number of \u201ciconic and award-winning films\u201d including \u201cPulp Fiction,\u201d \u201cThe English Patient,\u201d<br \/>\u201cGood Will Hunting\u201d and \u201cShakespeare In Love,\u201d among others.
