Publishing the government&#8217;s <strong><a target=\"_blank\" href=\"https:\/\/www.lawgazette.co.uk\/news\/fatal-blow-raab-sounds-death-knell-for-criminal-defence\/5114458.article\" rel=\"noopener\">final response<\/a><\/strong> a year later, the Ministry of Justice said solicitor firms would see a total fee increase of around 11%. Today, Chancery Lane said it has sent a pre-action letter to the government.<\/p>\n<p>Society president Lubna Shuja said: \u2018We argue the lord chancellor\u2019s decision not to remunerate solicitors by the bare minimum 15%, which the independent review said was needed immediately over a year ago to prevent the collapse of the criminal defence sector, is unlawful, as is the decision not to take action to address the risk of local market failure.<\/p>\n<p>\u2018We are seeking a commitment by the government to withdraw both decisions and reconsider them within a mutually agreed timetable. If not, we will issue a judicial review seeking an order to quash them.\u2019<\/p>\n<div class=\"inline_image inline_image_right image_size_med\" data-attachment=\"108239\" data-sequence=\"2\">\n<p class=\"picture\"><img loading=\"lazy\" decoding=\"async\" alt=\"Lubna Shuja\" src=\"https:\/\/d1d8vslyhr7rdg.cloudfront.net\/Pictures\/480xAny\/2\/3\/9\/108239_lubnashuja_266550.jpg\" srcset=\"https:\/\/d1d8vslyhr7rdg.cloudfront.net\/Pictures\/480xAny\/2\/3\/9\/108239_lubnashuja_266550.jpg 480w\" class=\" lazyload\" width=\"2433\" height=\"2835\"\/><\/p>\n<\/div>\n<p>The Society argues that the government\u2019s decisions are inconsistent with the constitutional right to access to justice.<\/p>\n<p>Shuja said: \u2018The government is choosing to ignore the economic advice and analysis which Lord Bellamy\u2019s review team painstakingly produced, using data the government itself supplied.
