{"id":36164,"date":"2023-01-12T14:49:34","date_gmt":"2023-01-12T14:49:34","guid":{"rendered":"https:\/\/cjstudents.com\/?p=36164"},"modified":"2023-01-12T14:49:34","modified_gmt":"2023-01-12T14:49:34","slug":"can-the-formerly-incarcerated-get-a-second-chance-in-michigan","status":"publish","type":"post","link":"https:\/\/cjstudents.com\/index.php\/2023\/01\/12\/can-the-formerly-incarcerated-get-a-second-chance-in-michigan\/","title":{"rendered":"Can the formerly incarcerated get a second chance in Michigan?"},"content":{"rendered":"<p> [ad_1]<\/p>\n<div>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ZEJUMROG2JD45LINHKI767P7SY\">When Tony Gant was first released from prison in 2015, he was optimistic about what opportunities awaited him as a free man.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"NSMEMEK3ORBE5NBAC46VEBQ7AE\">What he didn\u2019t expect, was the rough, six-month period it took for him to be hired at a temp job where he could only hope to be given employment each day.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"7VI3FPT6RVHMJIQKXCLP4BKR6Y\">\u201cI came out of prison kind of expecting that education and willingness to work hard would be what got me past those denials based on my record, but that just wasn\u2019t true,\u201d Gant said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"BCVJSDWSWVHBJMH323PBDPZSXU\">Last week\u2019s comments by Michigan Supreme Court Justice Richard Bernstein criticizing fellow Justice Kyra Bolden\u2019s decision to hire a former prisoner as a law clerk brought back memories for Gant, and others like him, who feel like society gives the formerly incarcerated little chance at redemption.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"TQN773GL7RGX5OT4A7BKF2OPXI\">\u201cWhat Bernstein said was hurtful,\u201d Gant recalled. \u201cIt triggered me and a lot of other folk because it just seemed so callous.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"GBNYYBY6ABB6NJ3YQT7WRSBQE4\">B<a target=\"_blank\" href=\"https:\/\/www.mlive.com\/news\/2023\/01\/michigan-supreme-court-justice-apologizes-for-criticizing-colleague-who-hired-former-convict.html?utm_campaign=mlive_sf&amp;utm_medium=social&amp;utm_source=twitter\" rel=\"noopener\">ernstein apologized to Bolden and Peter Martel<\/a>, the clerk in question, days later.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"HVOAM2GKZRFTLJLJ2JZBILC24A\">By that point, Martel had already resigned from his new job. Bolden said Martel, \u201cdid not want to be a distraction or in any way divert the Court from its important work.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"QSLGZOVRCVHMVEJCKHQBMMP35U\">Criminal justice reform activists in Michigan say the incident speaks to a bigger problem about how those who have served their time are treated, what prisoners awaiting parole have to look forward to and how society speaks about those with a criminal record.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"VI7U2SMFXJHZTIQPT54SMFEKXQ\">\u201cWe have people like Pete Martel, who are amazing individuals, are brilliant, they have talent that\u2019s beyond belief and they are held back because of that sentence,\u201d said Lois Pullano, executive director of Citizens for Prison Reform. \u201cTo me, that is really sad. I think that\u2019s something we as people need to ask to be changed.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"AOJN4G37HJGCXPJQWWULQXLJNU\">Pullano has known Martel for 10 years, working with him in and out Michigan\u2019s prisons on various projects related to prison reform and criminal justice.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"D3ONUD73YJHAFOXGBRTQXFJYOU\">She said that the justice system too often sets these people up for failure\u2014 individuals are turned down from hundreds of jobs, denied sufficient housing and more simply because of their record, no matter how hard working.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"Y3KTGEDCV5GYVJPFYIXXZBA42E\">And in a system where people aren\u2019t too often given second chances, what Martel was able to accomplish was \u201can extremely rare occasion,\u201d Pullano said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"2IT6WPNLMZH7JBWVF5I5HQXRZY\">Martel robbed a convenience store in Genessee County nearly three decades ago and \u201chad a bit of a shootout with the police,\u201d as he put it <a target=\"_blank\" href=\"https:\/\/soundcloud.com\/field-days\/pete-martel?fbclid=IwAR1MlOfQRLiWiIQ-PBktFYemCVbOVIF7j1GiFKzx1ZUP84tVD5Ffj4NK86c\" rel=\"noopener\">in a 2017 interview<\/a>. He spent 14 years in prison served prison time for armed robbery and felony assault before being released on parole in 2008.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"7J3N666LCFBMJDDEMYTCEO3OE4\">He went on to earn a law degree, found a job with the State Appellate Defender Office and enrolled in a doctoral program at the University of Michigan.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"6NEOFIJW4JAC3HJOSXSE6WMMSA\">Like Martel, Gant was sentenced for a violent crime, spending over 20 years in a Michigan Department of Corrections facility. Also, like Martel, Gant said he knew the importance of seeking out education and skills that would improve his life upon his release.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"RKJXMGN3DZDYVOPP5HNACQCTCM\">Over the last several years, Gant has become an author, entrepreneur, father and director of policy and program operations with Nation Outside, a criminal justice reform organization made up of those affected by the criminal justice system.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"WIXTF4KS2ZEJRHOCQIGATWRHKE\">\u201cMy passion has always been trying to figure out how to address some of the harms I saw during those 20 years, and to address the harms I experienced firsthand,\u201d Gant said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"GBO3TSSNHRD7FMAMMYCVGPRZQY\">And the stigma that follows the formerly incarcerated is unfounded, advocates say.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"4IENKDZCNBA3FLMBNY646YXSJY\">In 2022, the Michigan Department of Corrections reported that the state\u2019s recidivism rate\u2014 which measures the percentage of individuals who return to prison within three years of release\u2014 <a target=\"_blank\" href=\"https:\/\/www.michigan.gov\/corrections\/recidivism-rate\" rel=\"noopener\">had dropped to 23.6%<\/a>, a historic low. When compared to recidivism rates in other states, Michigan ranks fourth in the country.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"TNIDKWUE5FFLNBTJ7FIA5J3MW4\">\u201cIt\u2019s a difficult pill because it feels like you will never get past that no matter how hard you work, and I think Pete\u2019s situation is an example,\u201d Gant said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"3UNAYHNPF5FBXCTIH6HYFOH3NY\">Bernstein and Bolden were both nominated by the Democratic Party. Bernstein resumed his role as justice after winning his midterm reelection, while Bolden was appointed to the bench by Gov. Gretchen Whitmer.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ZUUTYTPQVZFIVED6ZSIOPHKS2U\">Whitmer could not be reached for comment on the situation, but fellow Democrats have had mixed reactions about Bernstein\u2019s apology.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"LFDJJ3WPBVHJ3OXQHXXIT4VRIE\">\u201cNothing in Justice Bernstein\u2019s statement accepts accountability for costing someone his job or affirms the critical life experience and value that returning citizens bring to the criminal justice conversation,\u201d <a target=\"_blank\" href=\"https:\/\/twitter.com\/lpohutsky19\/status\/1612625964143345664\" rel=\"noopener\">tweeted<\/a> Rep. Laurie Pohutsky, D-Livonia.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"VKZIXEABXZHM3JOIGR3BGQXG5Y\">Meanwhile, Jordan Acker, a University of Michigan regent, <a target=\"_blank\" href=\"https:\/\/twitter.com\/JordanAckerMI\/status\/1612616945039179776\" rel=\"noopener\">tweeted<\/a> that Justice Bernstein did the right thing in apologizing, having \u201cspent his career fighting for the right things, and a mistake does not define all of the good work he does.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"BNPEYM2HJFASJJ6WUZADFBXFGM\">Gant said he applauds Bernstein\u2019s position of expanding access to legal careers for people with criminal records, which he mentioned in his apology letter, but he would like for him to have conversations with inmates and advocates in the future so he can learn from their experiences.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"NY6NS6NHO5HAXGK7XZIMFLXRLM\">As for Martel, Gant said he supports him and is confident he\u2019ll have more opportunities lined up soon.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"QP6UNPLQCJFBVFZJ36BB6DAUIA\">\u201cPete is a person who\u2019s been through a lot already in his life, I\u2019m sure he\u2019s going to bounce back from this,\u201d
