The city\u2019s police chief <\/span><a target=\"_blank\" href=\"https:\/\/nypost.com\/2023\/01\/26\/police-chief-warns-memphis-not-to-react-violently-after-release-of-tyre-nichols-video\/\" rel=\"nofollow noopener\" data-ylk=\"slk:warned\" class=\"link \"><span>warned<\/span><\/a><span> Thursday that the footage will depict violence that is \u201cheinous, reckless and inhumane.\u201d<\/span><\/p>\n<p><span>\u201cI expect you to feel outrage in the disregard of basic human rights, as our police officers have taken an oath to do the opposite of what transpired on the video,\u201d Memphis Police Chief Cerelyn \u201cCJ\u201d Davis said in a video statement.<\/span><\/p>\n<p>She urged residents to remain calm in the wake of the video\u2019s release, something Shelby County District Attorney Steve Mulroy met with activists to request as well. On Thursday, President Joe Biden <a target=\"_blank\" href=\"https:\/\/www.huffpost.com\/entry\/joe-biden-tyre-nichols_n_63d2d883e4b0c8e3fc7cfae0\" data-ylk=\"slk:called for\" class=\"link \" rel=\"noopener\">called for<\/a>\u00a0peaceful protests.<\/p>\n<p><span>Davis and prominent civil rights attorney Benjamin Crump <a target=\"_blank\" href=\"https:\/\/www.huffpost.com\/entry\/memphis-police-chief-video-tyre-nichols_n_63d3c893e4b01e92886a49a9\" data-ylk=\"slk:compared the video\" class=\"link \" rel=\"noopener\">compared the video<\/a> to the 1991 beating of Rodney King by Los Angeles police, which sparked mass protests and riots when the officers involved were acquitted.\u00a0<\/span><\/p>\n<p><span>In the Nichols case, five officers \u2015 Desmond Mills, Justin Smith, Tadarrius Bean, Demetrius Haley and Emmitt Martin \u2015 were identified for their involvement. They were fired from the department on Monday.\u00a0<\/span><\/p>\n<p><span>On Thursday, a grand jury <a target=\"_blank\" href=\"https:\/\/www.huffpost.com\/entry\/memphis-police-custody-tyre-nichols_n_63d2bed4e4b01e9288696594\" data-ylk=\"slk:charged them with second-degree murder\" class=\"link \" rel=\"noopener\">charged them with second-degree murder<\/a>, two counts of official misconduct, one count of official oppression, one count of aggravated assault and two counts of aggravated kidnapping. The former cops bonded out of jail later that day.\u00a0<\/span><\/p>\n<p><span>An independent autopsy commissioned by the family indicated Nichols \u201csuffered extensive bleeding caused by a severe beating,\u201d according to Crump and\u00a0<\/span><span>attorney Antonio Romanucci, who are representing the family. Nichols\u2019 family and attorneys viewed body camera footage of the beating earlier this week.\u00a0<\/span><\/p>\n<p><span>Davis said Friday morning that while police initially said Nichols was stopped for reckless driving, she now believes there is no evidence for that allegation.<\/span><\/p>\n<p><span>The incident became a harsh reminder that police in the city regularly use excessive force on Black residents, who make up\u00a0<a target=\"_blank\" href=\"https:\/\/censusreporter.org\/profiles\/16000US4748000-memphis-tn\/\" rel=\"nofollow noopener\" data-ylk=\"slk:63% of its population\" class=\"link \">63% of its population<\/a>. It was not the first time a traffic stop has turned either violent or fatal in Memphis,<\/span><span>and a study found that Black drivers were stopped there at disproportionate rates. Driving while Black in Memphis and the state of Tennessee have been costly, and at times deadly, for residents.<\/span><\/p>\n<p><button class=\"link caas-button collapse-button\" aria-label=\"\" title=\"\" data-ylk=\"elm:readmore;slk:Story continues\">Story continues<\/button><\/p>\n<p><span>Moreover, emerging details suggest the five officers were not random bad apples, but rather part of the department\u2019s controversial\u00a0<\/span><a target=\"_blank\" href=\"https:\/\/www.actionnews5.com\/2021\/11\/15\/memphis-police-department-launches-scorpion-unit-fight-violent-crime\/\" rel=\"nofollow noopener\" data-ylk=\"slk:SCORPION unit\" class=\"link \"><span>SCORPION unit<\/span><\/a>.\u00a0<span>Nichols\u2019 family and local activists are already calling for the unit to be broken up.\u00a0<\/span><\/p>\n<h2><strong>A Pattern Of Bias\u00a0<\/strong><\/h2>\n<p><span>From 2017 to 2021, Black drivers were twice as likely to receive multiple citations on one ticket, according to a study conducted by the criminal justice advocacy group <a target=\"_blank\" href=\"https:\/\/decarceratememphis.com\/\" rel=\"nofollow noopener\" data-ylk=\"slk:Decarcerate Memphis\" class=\"link \">Decarcerate Memphis<\/a>.\u00a0<\/span><\/p>\n<p><span>Additionally, in a sample of 487 criminal court cases that stemmed from traffic stops in 2019 and 2021, about 90% of defendants were found to be people of color, with the majority of them facing misdemeanor charges. Prosecutors later dropped two-thirds of those cases.<\/span><\/p>\n<p>Decarcerate Memphis organizer Chelsea Glass said the group presented the information to the city council and public officials last year, but that they were ignored.<\/p>\n<p><span>Traffic stops have turned fatal before. A city police officer pulled over <\/span><a target=\"_blank\" href=\"https:\/\/wreg.com\/news\/martavious-banks-settles-lawsuit-with-city-of-memphis\/\" rel=\"nofollow noopener\" data-ylk=\"slk:Martavious Banks\" class=\"link \"><span>Martavious Banks<\/span><\/a><span>\u00a0in 2018 for an alleged lack of car insurance. Police shot him 20 times; he survived and <\/span><a target=\"_blank\" href=\"https:\/\/wreg.com\/news\/martavious-banks-settles-lawsuit-with-city-of-memphis\/\" rel=\"nofollow noopener\" data-ylk=\"slk:settled\" class=\"link \"><span>settled<\/span><\/a><span> a lawsuit against the city in 2021.\u00a0<\/span><\/p>\n<p><span>Also in 2018, police pulled over <\/span><a target=\"_blank\" href=\"https:\/\/www.commercialappeal.com\/story\/news\/2019\/08\/30\/dmario-perkins-shooting-no-charges-memphis-police\/2165870001\/\" rel=\"nofollow noopener\" data-ylk=\"slk:D\u2019Mario Perkins\" class=\"link \"><span>D\u2019Mario Perkins<\/span><\/a><span>\u00a0because they said his license plate was not registered to his vehicle. Perkins told officers he was suicidal, but during a confrontation, they shot him 10 times. He died at the scene and the officers were never charged.\u00a0<\/span><\/p>\n<p><span>\u201cIn the case of Tyre Nichols, it is a culmination of all of the things we have warned them about,\u201d Glass told HuffPost.\u00a0<\/span><\/p>\n<figure class=\"caas-figure\">\n<div class=\"caas-figure-with-pb\" style=\"max-height: 473px\">\n<div>\n<div class=\"caas-img-container caas-img-loader\" style=\"padding-bottom:75%;\"><img decoding=\"async\" class=\"caas-img caas-lazy has-preview\" alt=\"A portrait of Tyre Nichols is displayed at a memorial service on Tuesday in Memphis.\" src=\"https:\/\/s.yimg.com\/ny\/api\/res\/1.2\/.9.IF1g.jCqCexw4e0R1TA--\/YXBwaWQ9aGlnaGxhbmRlcjt3PTk2MDtoPTcyMQ--\/https:\/\/media.zenfs.com\/en\/the_huffington_post_584\/41fee84285d323ec417750077c1a98cc\"\/><noscript><img decoding=\"async\" alt=\"A portrait of Tyre Nichols is displayed at a memorial service on Tuesday in Memphis.\" src=\"https:\/\/s.yimg.com\/ny\/api\/res\/1.2\/.9.IF1g.jCqCexw4e0R1TA--\/YXBwaWQ9aGlnaGxhbmRlcjt3PTk2MDtoPTcyMQ--\/https:\/\/media.zenfs.com\/en\/the_huffington_post_584\/41fee84285d323ec417750077c1a98cc\" class=\"caas-img\"\/><\/noscript><\/div>\n<\/div>\n<\/div>\n<p><figcaption class=\"caption-collapse\">A portrait of Tyre Nichols is displayed at a memorial service on Tuesday in Memphis.<\/figcaption><\/p>\n<\/figure>\n<p>A portrait of Tyre Nichols is displayed at a memorial service on Tuesday in Memphis.<\/p>\n<p>The Decarcerate Memphis analysis also found that the state suspended driver\u2019s licenses mainly for unpaid traffic debt, and that more than 93 percent of residents with non-reinstated licenses in the state were living in poverty.\u00a0Revenues from traffic fines in Memphis increased from $10 million in 2009 to $13 million.<\/p>\n<p><span>Last year, Tennessee instituted a law on reckless driving that lawmakers claimed would help prevent road rage incidents.\u00a0<\/span><span>The bill made reckless driving a class A misdemeanor.\u00a0<\/span><\/p>\n<p><span>But Glass argued the law criminalizes Black drivers and gives police too much leeway to over-charge people for crimes while driving.<\/span><\/p>\n<p><span>\u201cThere is a whole lot of scare tactics and fear campaigns going on around people speeding and actual reckless driving,\u201d Glass said.<\/span><\/p>\n<h2><strong>An Aggressive Unit<\/strong><\/h2>\n<p>Police launched the<span>\u00a0SCORPION unit in November 2021, utilizing an acronym that stands for Streets Operation to Restore Peace In Our Neighborhoods. It was ostensibly designed to address violent crime, but developed into what critics see as a rogue police force unit with a harsh bias toward Black residents of Memphis.\u00a0<\/span><\/p>\n<p><span>When the unit initially launched, it claimed to have taken 29 guns off the streets and arrested 30 people over just a\u00a0<\/span><a target=\"_blank\" href=\"https:\/\/www.actionnews5.com\/2021\/11\/15\/memphis-police-department-launches-scorpion-unit-fight-violent-crime\/\" rel=\"nofollow noopener\" data-ylk=\"slk:three-day span\" class=\"link \"><span>three-day span<\/span><\/a><span>. Within three weeks of the unit\u2019s inception, it made <\/span><a target=\"_blank\" href=\"https:\/\/www.actionnews5.com\/2021\/12\/04\/memphis-police-departments-scorpion-unit-makes-over-300-arrests-since-launching\/\" rel=\"nofollow noopener\" data-ylk=\"slk:338 arrests, including for 125 felony offenses\" class=\"link \"><span>338 arrests<\/span><span>, including for 125 felony offenses<\/span><\/a>,<span>\u00a0and recovered 95 weapons.<\/span><\/p>\n<p><span>On Thursday night, Crump and Romanucci penned a letter comparing SCORPION to the widely criticized Gun Trace Task Force in Baltimore and a similar roving unit in Chicago, where officers were involved in robberies and home invasions. They demanded that the city disband the unit.\u00a0<\/span><\/p>\n<p><span>In SCORPION\u2019s case, officers operated in unmarked cars targeting specific areas, often predominantly Black neighborhoods.\u00a0<\/span><\/p>\n<figure class=\"caas-figure\">\n<div class=\"caas-figure-with-pb\" style=\"max-height: 425px\">\n<div>\n<div class=\"caas-img-container caas-img-loader\" style=\"padding-bottom:67%;\"><img decoding=\"async\" class=\"caas-img caas-lazy has-preview\" alt=\"Pastor Andre Johnson speaks at a candlelight vigil for Tyre Nichols. Officials expect further protests after police release footage of the beating.<\/p>\n<p><span>The unit appeared to be targeting residents during traffic stops as recently as two months before Nichols\u2019 arrest, according to court documents found by HuffPost.<\/span><\/p>\n<p>In some cases, the unit loaded up charges that were later dropped. <span>Back in October, all five officers in Nichols\u2019 case were present when officers stopped a man named Jamarian Johnson due to a \u201cstrong odor\u201d of marijuana coming from his car.<\/span><\/p>\n<p><span>The officers said they discovered marijuana paraphernalia and a handgun in the vehicle and later accused Johnson of using the vehicle to transport drugs. Police charged Johnson with evading arrest; possession of a controlled substance with intent to sell, manufacture or deliver; and unlawful possession of a weapon.<\/span><\/p>\n<p><span>But on Jan 19, prosecutors dropped the case against Johnson. <\/span>HuffPost reached out to MPD about the arrest but did not get a response.<\/p>\n<p><span>Another man, <\/span><a target=\"_blank\" href=\"https:\/\/wreg.com\/news\/local\/tyre-nichols\/man-recalls-encounter-with-scorpion-unit-before-nichols-death\/\" rel=\"nofollow noopener\" data-ylk=\"slk:Cornell McKinney, told local station WREG\" class=\"link \"><span>Cornell McKinney, told local station WREG<\/span><\/a><span> that the same unit stopped him on Jan. 3, three days before Nichols was pulled over.\u00a0<\/span><\/p>\n<p><span>Mckinney said they approached him in unmarked cars and didn\u2019t initially say what the stop was for, though they later accused him of carrying drugs. He said their vests said \u201cMPD SCORPION UNIT\u201d on the back. <\/span><\/p>\n<p><span>When McKinney asked for a lawyer, he said that one officer told him, \u201cThis ain\u2019t court.
