Questions remain as to why Nichols was stopped, with the Memphis Police Chief Cerelyn \u201cCJ\u201d Davis saying they have <a target=\"_blank\" href=\"https:\/\/www.cnn.com\/2023\/01\/26\/us\/what-we-know-tyre-nichols-death\/index.html\" rel=\"noopener\">not been able to confirm claims that he had been driving recklessly<\/a>.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"archive.cms.cnn.com\/_components\/paragraph\/instances\/paragraph_D6D869D8-2A79-15AA-9076-FA99869D534E@published\" data-editable=\"text\" data-component-name=\"paragraph\">\n      Nichols, who struggled to his feet and ran off, was <a target=\"_blank\" href=\"https:\/\/www.cnn.com\/us\/live-news\/tyre-nichols-memphis-news-1-28-23\/h_f173af7259af0785ce51a47abdf9b178\" rel=\"noopener\">found minutes later<\/a>. Police body camera and surveillance footage released Friday showed the officers striking Nichols with a baton, kicking him in the head and repeatedly punching him before propping him against a police car.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"archive.cms.cnn.com\/_components\/paragraph\/instances\/paragraph_16FEA814-857B-D3AA-2A65-FA99869DA602@published\" data-editable=\"text\" data-component-name=\"paragraph\">\n      The officers then milled around, with no one rendering aid in the critical minutes following the beating. It took an ambulance more than 20 minutes to arrive on the scene, and Nichols, who suffered \u201cextensive bleeding caused by a severe beating,\u201d according to <a target=\"_blank\" href=\"https:\/\/www.cnn.com\/2023\/01\/28\/us\/tyre-nichols-beating-video-takeaways\/index.html\" rel=\"noopener\">preliminary results of an autopsy<\/a> commissioned by attorneys for his family, died three days later.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"archive.cms.cnn.com\/_components\/paragraph\/instances\/paragraph_16372C3C-FBC7-CD32-5855-FA99869DC69E@published\" data-editable=\"text\" data-component-name=\"paragraph\">\n      Based on my 28 years of experience as a former police officer and captain, it was clear to me that the officers lacked supervision, showed little professional maturity and escalated a situation into what would eventually become a deadly encounter through gross negligence and a complete disregard for human life.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"archive.cms.cnn.com\/_components\/paragraph\/instances\/paragraph_8B467820-A1B7-F14F-3E2A-FA99869EF02A@published\" data-editable=\"text\" data-component-name=\"paragraph\">\n      The damage is even more traumatic for the Black community, given that the five officers who were charged with murder, are all Black. Members of the Black community often expect Black officers to be their vanguard.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"archive.cms.cnn.com\/_components\/paragraph\/instances\/paragraph_6E707E27-DC47-4929-D541-FA9AF08D920A@published\" data-editable=\"text\" data-component-name=\"paragraph\">\n      To see Black officers embracing brutality and aligning themselves with a police subculture that calls for loyalty to even the most heinous of police behaviors \u2014 such as beating subjects who run from the police \u2014  is beyond devastating, especially since modern day policing in this country can be traced back to <a target=\"_blank\" href=\"https:\/\/naacp.org\/find-resources\/history-explained\/origins-modern-day-policing\" rel=\"noopener\">slave patrols<\/a>, and abuses within the criminal justice system continue to result in the over-policing and death of Black people.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"archive.cms.cnn.com\/_components\/paragraph\/instances\/paragraph_79824F78-5D0F-F00B-02E7-FA99869F24AE@published\" data-editable=\"text\" data-component-name=\"paragraph\">\n      After Nichols\u2019 death, the union representing the officers issued a <a target=\"_blank\" href=\"https:\/\/urldefense.com\/v3\/__https:\/www.facebook.com\/memphispoliceassociation\/posts\/pfbid022rfPpgn2r9xs7GH1NLQLqHpk1ra34YdJXfz7N9ZvrU9qNgg6RvxspSH1z8DTz3eul__;!!AQdq3sQhfUj4q8uUguY!mTKTUTeCgbzIvbw9G5bLOike8z1p8yBGysIZBr2XnhET1QWMvr4P-EKvd_4hxT6oADSIyvGs4c8NdHwf4Ys4CxdcIQ$\" rel=\"noopener\">statement on Facebook<\/a> that read, \u201cThe Memphis Police Association would, again, like to extend condolences to the family of Mr. Tyre Nichols. The Memphis Police Association is committed to the administration of justice and NEVER condones the mistreatment of ANY citizen nor ANY abuse of power.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"archive.cms.cnn.com\/_components\/paragraph\/instances\/paragraph_CCD4A8AF-E87A-61D6-D093-FA99869F683F@published\" data-editable=\"text\" data-component-name=\"paragraph\">\n      The association\u2019s current stance is unusual. It did not defend the arrested officers outright or say that they were just doing a difficult job that required them to make split-second decisions \u2013 responses we\u2019ve come to expect from police unions that so often <a target=\"_blank\" href=\"https:\/\/www.cnn.com\/2020\/06\/08\/politics\/police-union-reform-protests\/index.html\" rel=\"noopener\">help shield officers accused of misconduct from accountability<\/a>.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"archive.cms.cnn.com\/_components\/paragraph\/instances\/paragraph_E3C07EAC-85BD-8A84-8E1B-FA99869F26D5@published\" data-editable=\"text\" data-component-name=\"paragraph\">\n      The public has noted the swift action taken against the five officers, all members of a specialized unit tasked with addressing crime, known as Street Crimes Operation to Restore Peace in Our Neighborhoods (SCORPION). In less than two weeks, all five were fired. Criminal charges were filed and body worn camera video was released in three weeks. These actions were appropriate. As Ben Crump, the attorney representing Nichols\u2019 family, said in a press conference on Friday, we now know that swift transparency and accountability is indeed possible in cases of death involving police officers, and <a target=\"_blank\" href=\"https:\/\/www.cnn.com\/us\/live-news\/tyre-nichols-memphis-news-1-27-23\/h_4adbdb19ae4a7a34a6ef344eb9fcd1bc\" rel=\"noopener\">the case in Memphis is a blueprint<\/a>.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"archive.cms.cnn.com\/_components\/paragraph\/instances\/paragraph_1D0ACE72-796B-4A47-9429-FA9AD62640E3@published\" data-editable=\"text\" data-component-name=\"paragraph\">\n      Many have noted the police assault on Nichols is reminiscent of that on Rodney King, a Black man whose beating at the hands of Los Angeles police officers in 1991 was captured on video. But the beating of Nichols is actually much worse because it shows that after nearly 32 years, the needle of police reform has barely moved, and seemingly minor traffic violations continue to lead to the deaths of Black and other minority men and women in police encounters.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"archive.cms.cnn.com\/_components\/paragraph\/instances\/paragraph_B8D6BDDC-D15A-7467-0181-FA99869FA705@published\" data-editable=\"text\" data-component-name=\"paragraph\">\n      Efforts to push for police reform in the aftermath of George Floyd\u2019s death in 2020 have been largely replaced with calls to address <a target=\"_blank\" href=\"https:\/\/www.pewresearch.org\/fact-tank\/2022\/10\/31\/violent-crime-is-a-key-midterm-voting-issue-but-what-does-the-data-say\/\" rel=\"noopener\">the fear of rising crime<\/a>, partially through hiring more police officers. Last year, President Joe Biden <a target=\"_blank\" href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2022\/08\/01\/fact-sheet-president-bidens-safer-america-plan-2\/\" rel=\"noopener\">proposed funding<\/a> for 100,000 new police officers as part of his Safer America Plan and the 2023 omnibus appropriations bill includes <a target=\"_blank\" href=\"https:\/\/www.appropriations.senate.gov\/imo\/media\/doc\/HIGHLIGHTS%20DOCUMENT%20FY%2023.pdf\" rel=\"noopener\">$324 million<\/a> in funding to hire more police officers.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"archive.cms.cnn.com\/_components\/paragraph\/instances\/paragraph_2847F2E0-46F1-41D3-7DCF-FA99869FA92E@published\" data-editable=\"text\" data-component-name=\"paragraph\">\n      However, I know from experience that crime prevention is achieved through trusting relationships between the police and the community it serves, rather than feeding a broken system more police officers. There can be no trust when there is over-policing of disadvantaged communities with suppression units such as the SCORPION unit, which were formed to protect communities \u2013 not terrorize them. (On Saturday, the Memphis Police Department <a target=\"_blank\" href=\"https:\/\/www.cnn.com\/us\/live-news\/tyre-nichols-memphis-news-1-28-23\/h_e627d2a99f49642303a99e6725002149\" rel=\"noopener\">announced<\/a> it will permanently disband its SCORPION unit.)\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"archive.cms.cnn.com\/_components\/paragraph\/instances\/paragraph_716D0F8C-6B3C-084C-FFA9-FA9986A0FDB3@published\" data-editable=\"text\" data-component-name=\"paragraph\">\n      The <a target=\"_blank\" href=\"https:\/\/www.cnn.com\/2021\/09\/30\/us\/george-floyd-police-reform-victims-families\/index.html\" rel=\"noopener\">federal policing bill<\/a> that bears George Floyd\u2019s name failed to pass in the Senate and efforts to end qualified immunity, a judicial doctrine that protects police officers from being held personally liable for violating a person\u2019s rights, have <a target=\"_blank\" href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/1470\" rel=\"noopener\">not succeeded in Congress<\/a>.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"archive.cms.cnn.com\/_components\/paragraph\/instances\/paragraph_A7683745-60C0-C16E-09D7-FA9986A08954@published\" data-editable=\"text\" data-component-name=\"paragraph\">\n      <a target=\"_blank\" href=\"https:\/\/urldefense.com\/v3\/__https:\/leg.colorado.gov\/bills\/sb20-217__;!!AQdq3sQhfUj4q8uUguY!mTKTUTeCgbzIvbw9G5bLOike8z1p8yBGysIZBr2XnhET1QWMvr4P-EKvd_4hxT6oADSIyvGs4c8NdHwf4Yt9m4jo3A$\" rel=\"noopener\">States <\/a>and <a target=\"_blank\" href=\"https:\/\/urldefense.com\/v3\/__https:\/www.princegeorgescountymd.gov\/3542\/Police-Reform__;!!AQdq3sQhfUj4q8uUguY!mTKTUTeCgbzIvbw9G5bLOike8z1p8yBGysIZBr2XnhET1QWMvr4P-EKvd_4hxT6oADSIyvGs4c8NdHwf4Yu9B4XIxg$\" rel=\"noopener\">local jurisdictions<\/a> have tried to tackle police misconduct through new policies and legislation. Law enforcement has conducted training time and again and revised policy over and over, and yet we still have too many unnecessary deaths at the batons, feet, hands, fists, and guns of police.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"archive.cms.cnn.com\/_components\/paragraph\/instances\/paragraph_B94406A3-D765-4693-59B2-FA9A6BC6BEF9@published\" data-editable=\"text\" data-component-name=\"paragraph\">\n      Such deaths are preventable, but training or a patchwork of local policies will not be sufficient.
