With broad discretionary powers, prosecutors take a stand against laws they view as unjust — including Ohio’s ‘heartbeat law’

Progressive prosecutors nationwide increasingly have declared that hey just will not enforce some GOP-backed state laws in the name of doing right by their constituents. They’ve shown defiance on issues ranging from abortion bans to voting restrictions, from limits on protest activity to restrictions on mask requirements.
CLEVELAND, Ohio – Proponents of Ohio’s so-called “heartbeat law,” banning abortion after a fetal heartbeat can be detected, will find no ally in Cuyahoga County Prosecutor Michael O’Malley.
He has already joined about 90 other prosecutors across the country, who have boldly pledged not to prosecute violations of anti-abortion laws, arguing that doing so would shift focus from serious crimes, divide communities and erode trust in the justice system.
